A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF PORT TOWNSEND
REQUESTING THAT THE JEFFERSON COUNTY BOARD OF COMMISSIONERS
REJECT THE ADMINISTRATIVE RULE CHANGE PROPOSED BY THE CRITICAL AREAS
ADMINISTRATION CONCERNING ASPHALT BATCH PLANTS
and
WHEREAS, the City of Port Townsend is the water provider for the Tri-Area in Jefferson County;
WHEREAS, the City desires that the aquifer supplying water to the two City wells remains clean
and pure in perpetuity; and
WHEREAS, the City appealed the Aquifer Recharge section of the Jefferson County Critical Areas
Ordinance (CAO) to the Western Growth Management Hearings Board in July, 1994; and
WHEREAS, the City and the County negotiated under a Consent Decree a new Aquifer Recharge
section of the Critical Areas Ordinance; and
WHEREAS, the City has communicated with concerns regarding the above rule change in its letter
of July 15, 1994 to the Planning Commission; and
WHEREAS, the Jefferson County Planning Commission on July 15, 1998 provided Findings and
Conclusions which by a vote of 5-1 recommended to the Board of County Commissioners that they deny the
proposed administrative rule change; and
WHEREAS, the Jefferson County Board of Health voted in its meeting on July 16, 1998 to
recommend to the County Commissioners that they reject the administrative rule change and support the
Findings and Conclusions of the Planning Commission,
NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Port Townsend that
the Board of County Commissioners should support the Jefferson County Planning Commission's Findings
and Conclusions, and the Jefferson County Board of Health's Resolution of July 16, 1998, and reject the
administrative rule concerning asphalt batch plants.
ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor on this 20th
day of July, 1998.
