RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
APPROVING RELEASE AND EXTINGUISHMENT OF BRYDON RESTRICTIVE
COVENANT
The City Council of the City of Port Townsend, Washington, does resolve as follows:
WltEREAS, on December 16, 1992, Robert and Joy Brydon recorded a restrictive
covenant tying together Lots 2 and 7 and the north 10 feet Lots 3 and 6 of Block 192 in the
Eisenbeis Addition to the City of Port Townsend. The covenant was recorded at Jefferson County
Auditor's File No. 355831, for the purpose of enabling the City to issue permits for construction
of an outbuilding accessory to a primary residence building; and
WHEREAS, the Brydons now propose a lot line adjustment, demolition of the accessory
building, and conveyance of the affected lots to a purchaser. Tbe building will no longer be
"accessory" to the original residence on the property, in that it will be demolished. The Brydons
wish to sell the property, but cannot do so unless the covenant is extinguished; and
WHEREAS, the City Council finds that so long as the accessory building is demolished,
the reason for requiring a restrictive covenant no longer exists, and the Brydons should be free
to use and sell their property without the limitations imposed by the restrictive covenant,
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port
Townsend that the Mayor is authorized to sign the "Release and Extinguishment of Restrictive
Covenant" in substantially the form attached hereto.
ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor
on this 17th day of August, 1998.
