A RESOLUTION APPROVING SHORELINE SUBSTANTIAL DEVELOPMENT/
CONDITIONAL USE PERMIT
APPLICATION NO. LUP9211-03
WHEREAS, Mr. Ron Pak has petitioned the City for a Shoreline Substantial
Development/Conditional Use Permit in accordance with the 1989 Port Townsend Shoreline
Master Program to allow construction of a twenty-one (21) unit addition to the Tides Inn Motel;
and
WHEREAS, the application was originally submitted on or about November 16, 1992 by Service
Activities Corporation represented by Mr. John Pickett and the application is vested under the
substantive rules then in effect; and
WHEREAS, the Building and Community Development (BCD) Director issued a State
Environmental Policy Act (SEPA) Mitigated Determination of Non-Significance (MDNS) on
May 11, 1994; and
WHEREAS, the MDNS was appealed by Stewart and Elinor Nelson on May 26, 1994. This
appeal was later assigned to James and Nelly Tretter; and
WHEREAS, the BCD Director issued a SEPA addendum addressing light and glare impacts on
August 19, 1994; and
WHEREAS, the Port Townsend City Council conducted hearings on the SEPA appeal on
September 6 and NOvember 7, 1994, and lune 19, 1995 to consider the Nelson/Tretter appeal;
and
WHEREAS, Service Activities Corporation submitted several project redesign alternatives
during the course of the SEPA appeal intended to address the concerns of the appellants; and
WlIEREAS, on June 19, 1995 the City 'Council denied the SEPA appeal subject to the
imposition of four (4) additional SEPA mitigation measures including revision of the project
consistent with the "preferred alternative" design as proposed by the applicant; and
WHEREAS, on May 26 and June 22, 1998 the Port. Townsend Historic Preservation Committee
(HPC) reviewed the proposed addition for conformity with the policies of the Port Townsend
Urban Waterfront Plan "BluffNarrows District" and the design guidelines for the downtown
historic district; and, subsequently found the project to be "contributing" and approved the
project's architectural form, colors, and building materials; and
WHEREAS, a second SEPA addendum was issued by the BCD Director on August 19, 1998 to
address revisions to the proposed Tides Inn addition including window locations, lighting, off-site
parking, shoreline improvements, and the retention of the "Officer and a Gentleman" suites,
which differed from the design approved by the City Council SEPA appeal determination on June
19, 1995; and
WHEREAS, the proposed Shoreline Substantial Development/Conditional Use Permit was duly
noticed pursuant to Chapter 20.01 of the Port Townsend Municipal Code; and
WHEREAS, Planning Commission conducted an open record public hearing for the purpose of
taking testimony, hearing evidence, considering the facts germane to the proposal, and evaluating
the proposal for consistency with adopted plans and regulations; and
WHEREAS, City Council has held a closed record public hearing for the purpose of considering
the Planning Commission's recommendation and evidence in the record including any written
comments and/or public testimony received,
NOW THEREFORE, City Council hereby accepts and adopts the findings of fact, conclusions
and project conditions as recommended by the Planning Commission dated September 17, 1998;
subject to the following amendments to the project conditions:
4. To be consistent with Sections 4.105 and 5.140, landscaping consistent with the approved
landscaping plan (MDNS #5) shall be installed around the building, waterwalk, parking
areas, street-end park, and along the Water Street streetscape. Pursuant to the
r¢c0mmcn0ations of the Washington State Department of Ecology and Washington State
Department offish and Wildlife. native vegetation shall be used where appropriate and
feasible including the waterwalk, street end park and landscaped areas around the parking,
lot(s). Herbicides shall not be used in anv vortion of the vroiect in public rights-of-way
q~xcept where specifically exempted by P~s-olution 96-~. _,q-(M-ay)

A bicycle parking rack shall be provided in the off-street parking area in or adjacent to the
Walker Street right-of-way.
ADOPTED by the City Council of the City of Port Townsend in regular session assembled this
