A RESOLUTION APPROVING THE FOURTH AMENDMENT
TO THE PROPERTY USE AND DEVELOPMENT AGREEMENT
FOR THE ROSEWIND PLANNED UNIT DEVELOPMENT
WHEREAS, the City and the Rosewind Cohousing Association (Rosewind), entered into a
certain Property Use and Development Agreement for the Rosewind Planned Unit Development
on May 12, 1994; and
WHEREAS, Rosewind has requested an amendment to reduce building setback from the west
property line of Rosewind Lot 28 from 20 feet to 10 feet; and
WHEREAS, the abutting property owners of Rosewind Lot 19, David and Della Walker, do not
object to the proposed setback reduction; and
WHEREAS, the proposed setback reduction will not affect access to Lot 19 and is consistent
with the minimum building separation standards throughout Rosewind; and
WHEREAS, the proposal is consistent with the minimum 10 foot side yard setback requirement
of the (R-II) Medium Density Single-Family Zoning District per PTMC 17.16.030; and
WHEREAS, the Planning Commission concluded that the proposed setback reduction would not
substantially change the development and that consequently a public hearing is not required. The
City Council has accepted the Planning Commission's recommendation,
NOW THEREFORE, City Council hereby accepts and adopts the findings of fact, conclusions
and project conditions as recommended by the Planning Commission dated November 12, 1998,
and authorizes the Mayor to sign the fourth amendment to the Rosewind PUDA in substantially
the form attached hereto.
ADOPTED by the City Council of the City of Port Townsend in regular session assembled this
7th day of December, 1998.
