RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
ADOPTING THE PORT TOWNSEND TELEVISION (PTTV) PUBLIC OPERATING
RULES AND FOR USE OF THE PEG ACCESS STUDIO AND CHANNEL 42 (PTTV),
AND ESTABLISHING AN EFFECTIVE DATE
The City Council of the City of Port Townsend, Washington, does resolve as follows:
WHEREAS, as a consequence of the funding obtained from the renewal of the franchise
agreement with Summit Cablevision in 1996, the City's decision to devote the entire 5 % franchise
fee to the Public, Education and Government (PEG) Access Channel, and the Interlocal
Agreement with the Port Townsend School District, the City has proce~ed with its plans to
establish a PEG access studio; and
WlW~REAS, the City has hired two independent contractors to act as the PEG
Coordinators; they and the PEG Access Coordinating Committee project that the full operation
of PTrV will begin by early 1999; and
WHEREAS, the City has already adopted roles for the PTTV "community calendar,"
which enables PTTV to directly communicate to all cable subscribers in Jefferson County; and
WHEREAS, the City is in the process of leasing capital equipment for the operation of
the studio, and is planning (barring any problem with equipment arrival) on opening the studio
for Government, Education, and Public use on or about February 15, 1999; and
WHEREAS, in drafting the PTrV Public Operating Rules, staff reviewed similar roles
from many other jurisdictions and consulted with staff from other jurisdictions, including Seattle;
Port Angeles; Bremerton; Olympia; Vancouver; Missoula, Montana; and the National Community
Alliance for Cable Television Advocacy, Washington, DC; and
WHEREAS, the Operating Rules have been reviewed by and discussed with
representatives from Port Townsend School District 50, Peninsula College, Washington State
University and Chimacum School; and
WHEREAS; PEG Access Coordinating Committee has extensively reviewed the Public
Operating Rules and has unanimously recommended its adoption; and
WHE~, although the City Council desires to adopt these rules at the December 21,
1998 meeting of the City Council, they will not be effective until February 15, 1999, so that staff
can prepare the necessary forms to implement the rules, and has time to ensure that the equipment
is installed and operating correctly,
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Port
Townsend that the Port Townsend Television (PTrV) Public Operating Rules are hereby adopted
in substantially the same form as attached. The PEG Access Coordinating Committee is
authorized to make changes to these Operating Rules without further Council action; provided,
however, that any major changes (i.e., changes of a substantive versus purely procedural nature)
shall be copied to the City Council. All changes (other than format or editorial changes) shall first
be reviewed by the City Attorney and approved by the City Manager.
This resolution shall take effect February 15, 1999.
ADOPTED by the City Council of the City of Port Townsend and signed by the Mayor
on this 21st day of December, 1998.
