Legal Description of Easement ("Easement"or "Easement Area"):
That area of the Property which isthe eastern twelve and one halffeet(12.5)of Lots 17,
and 15 which isadjacent to and eastof the Secondary road on the eastsideof the Port
Townsend Business Park
SUBJECT TO THE FOLLOWING:
1.Grantee shallhave the rightatalltimes toenterthedescribedEasement Area forthe
purpose of making utilityimprovements,inspectionsand maintainingutilityimprovements,
includingbut not limitedto,inspecting,maintaining,improving,repairing,constructing,
reconstructing,locating,and relocatingany utilitylines,and removing trees,shrubs or brush as
necessaryto accomplish thesepurposes and protecttheutility.This issubjecttoparagraphs 2
and 6 below,and tothe City giving24-hours'noticeexcept inthe case of an emergency.
2.Any costsassociatedwith inspection,maintenance,improvement,repair,construction,
reconstruction,and improvements upon the propertyundertaken by theGrantee shallbe borne by
theGrantee.
3.This Agreement shallbe binding upon theGrantors and Grantee and theirsuccessorsand
assigns,and constitutesa covenant running with the land.
4.Structuresand/orpermanent storagewithinthe above-describedEasement Area are
prohibited.This does not apply to fences,which arepermitted.
5.No treesshallbe plantedinthe easement area.Grantee has the righttoremove
vegetationor treesthatinGrantee'sjudgment endanger or increasethe coststo maintain,repair
or reconstructGrantee'simprovements.
6.In connectionwith any inspection,maintenance,improvement,repairor constructionor
reconstruction,Grantee shallrestorethe property(Easement Area and any immediately adjacent
area)to rough grading,but isnot responsibleforany restorationor repairof landscaping,
vegetation,fences,or any improvements withintheEasement Area.
7.This Easement isforthebenefitof theCity ofPortTownsend,itssuccessorsand assigns.
