You surely do not want to secure permits or approval to build on Lots 8 and 9, (see alternatives below) without Lots I thru 5 already being merged with Lots 7 thru 9 to have one whole parcel that is on the north of Discovery Road. I sure would not want to buy 6 additional lots that I could not do anything more than the seller could have done with them. I mean you do not want to be left with five lots at the end of this whole process. There appears to be one problem to make a property boundary adjustment to make Lot 1 thru 5 and 7 thru 9 on the north side of Discovery Road into one parcel There is a 15" alley right of way (ROW) between the lots. At least the land survey, I obtained, shows an alley. Now the city is probably never going to put an alley there because it is wetland. Port Townsend Public Works seems to be going to great lengths to keep the Harold Street extension from going through any wetlands. So it may not be too hard to get the city to vacate the alley ROW. I am not an expert in the vacating of ROW or the ending results so you will have to find someone to do that as well as doing the boundary adjustments. That leaves Lot 6 and a portion of Lot 7 on the south side of Discovery Road_ It will probably be easy to do a boundary adjustment on these to make one parcel separate from the lots on the north side Discovery Road. This will give you one more potential building site for the total number of lots. The building site here is also in the wetland buffer. Building Foot Prints I have developed 4 alternatives for you to review. The alternatives only show the outline of the building foot print and how the building would fit in the buffers. A reasonable use exception variance will have to be obtained because all the building foot print areas that are possible are at least within the protective buffers of the wetland and one alternative fills requires fill a portion of the wetland_ All the potential building areas in the buffers will require a waver for street and wetland set backs to get the buildings on the areas. This will be part ofthe reasonable use exception permit if approved by the city. Once you decide that you wish to pursue one ofthe alternatives then there will have to be considerable documentation done with relation to the functions and values ofthe buffers and wetlands and the impacts of single family residence on the wetland and associated resources. I have only shown alternatives that are directly accessible to either Eddy Street or Discovery Road. I have not provided an alternative for a building site on the large buffer area on Lots 3.4 and 5, because there would be so much wetland filling and permitting for a road to get to the area. Also, the appropriate infrastructures, such as power, sewage line, telephone and water would have to taken to Lots 3, 4 and 5, whereas, infrastructures are readily for the alternatives along Eddy Street and Discovery Road. ru' n ' ova These alternatives are just on paper, based on the compass and tape measurements of the wetland 1 ` boundary that I made from the two known property corner marker on the south end of Lot 5. 1 have not been able to find any property corner markers on the east corners ofLots 8, 9-and 10 to allowme " - -tac oble check my plotted wetland boundary ocatzon on the lots associated with the 1j1 ` r alternatives_ When standing on site, the areas on the drawing looks pretty close but there is no real way to know exactly (within t 2 feet) where the east property line and corners are for Lots 8 and 9 :north of Discovery Road and Lot 6 and 7 south of Discovery Road_ The city will require a serve to be done for the alternative areas as part ofthe reasonable use exception process. The four alternatives are shown on the enclosed drawings. All the alternatives are located on Lots 8 and 9 north of Discovery Road and on the west side of Eddy Street and on Lots 6 and 7 that are south of Discovery Road on the west side of Eddy Street. Alternatives 1, 2, and 4 are all within the buffers of the wetland. Keeping the building foot prints within the buffer areas should limit government agencies involvement to the City_ of Port Townsend who will be the regulatory government level. Alternative 3 shows a building foot print that will be in the buffer and in the wetland. To achieve this alternative will require filling at a minimum 630 sq. ft. of wetland. Port Townsend will still be the regulatory government level but because this alternative involves filling wetlands to obtain the required building foot print, there will be an additional two state and two federal agencies involved in the permitting process_ A Nation Wide Permit (NWP) will have to be approved from the Army Corp of Engineers to fill the wetland area. It may also require replacing the fill wetland at 2:1 _ For example, filling 630 sq. ft. ofwetland will Cis- require the replacement of 1,260 sq. ft. of wetland.
