Dear Andy:
I have decided to back off my position requiring a StreetDevelopmentPermitatthistimewith, however, the followingunderstandings:
The intention you have at this time is to create a basin, lined-._out as per your plans, on City right -of -way and on yourproperty.
2. An appropriate easement must be granted to the City, informandsubstanceacceptabletotheCity, for that portion of thebasinlocatedonyourproperty, since the creation of a basin willresultinstormdrainagefromtheCityflowingontoyourproperty.
3. Construction of this basin shall not constitute approvalforanyfuturebuildingorstreetdevelopmentpermits. Allrequiredpermitsinthefuturewillstillberequired, subject toanythen - existing regulations or standards.
4. The requirements set forth in my letter of May 10 , 1991, are our understanding of future requirements as they stand now.
5. Any determination now or in the future that the basin isorhasbecomea "wetland" and not able to accept storm drainage , or is the basin should hereafter be subject to DOE or-Corps ofEngineersjurisdiction, will need to be dealt with appropriately. More specifically,'if the basin is determined to be a "wetland" orotherbodyofwater, an alternative storm drainage plan may berequiredandotherstateorlocallawsorregulations, or SEPAconditions, may limit or otherwise affect development in the area. We cannot make assurances at this time concerning developmentPotential, because the consequences of such a. classification cannotbepredicted.
6. The basin shall be maintained by you in a condition as5utlinedinyourproposalanddrawings.

7. The easement, or a separate instrument, must set forthappropriatecovenantsassuringthattheseconditionsarecompliedwithandrunwiththeland.
