HomeMy WebLinkAbout1999.04.01 - Memo RE_ Status of roadway commonly referred to as Thomas StreetCITY OF PORT TOWNSEND DEPARTMENT OF PUBLIC WORKS ENGINEERING DIVISION WATERMAN & KATZ BUILDING 181 QUINCY STREET, SUITE 201 PORT TOWNSEND, WASHINGTON 98368 360) 385 -7212 (360) 385 -7675 FAX MEMORANDUM Date: April 1, 1999 To: Dave Peterson y-5LA Judy Surber Francesca Franklin ry Fm; Doug Mason Re: Status of roadway commonly referred; to as "Thomas Street" As requested by Colette Kostelec in connection with a subdivision application submitted by Daniel Molotsky, I looked into the legal status of the roadway that links the West end of the 43 foot right of way for 25th Street, as dedicated in the plat of Laurel Shade Addition to the City of Port Townsend, as per plat recorded in Volume 1 of Plats, page 45, records of Jefferson County, Washington, and the 100 foot right of way for Hastings Avenue, as dedicated in the plat of Yep Suey's Addition to Port Townsend in the Southwest quarter of Section 3, Township 30 North, Range 1 West, W.M. This plat was vacated by the City Council on May 14, 1895. The order vacating the plat specifically reserved the right of way for Hastings Avenue, but all other rights of way were vacated, including a 30 foot right of way along the West boundary of the plat. C'tie, S ,) Daniel Molotsky is the owner of the portion of the vacated Yep Suey plat lying to the South of the Hastings Avenue right of way, with the exception of a parcel in the Southwest corner. His residence is on the West edge of the property and is accessed by a roadway that runs from Hastings Avenue to the West end of 25th Street. Following the plat vacation, there was no land under City control or ownership for such a roadway until 1930. By deed recorded under Auditor's No. 65473 in Volume 101 of Deeds, page 358, J. J. Lohman and Grace Lohman conveyed to the City a 30 foot wide strip of land adjacent to the East line of the Southeast quarter of the Northeast quarter of the Southeast quarter of Section 4, Township 30 North, Range 1 West, W.M. That deed actually contains an incorrect legal description for the strip of land, but a subsequent conveyance by Mr. and Mrs. Lohman of a larger parcel of which the strip had been a part clarifies the intent of the deed containing the incorrect description; this clarifying deed is recorded under Auditor's No. 181616 in Volume 165 of Deeds, page 531. A deed recorded in Volume 55 of Deeds, page 100, also from Mr. and Mrs. Lohman, conveyed to the City the North 40 feet of the Southeast quarter of the Northeast quarter of the Southeast quarter of Section 4, Township 30 North, Range 1 West, W.M. This deed provided additional width for Hastings Avenue to the West of the portion dedicated in the Yep Suey plat. ? The effect of the three deeds described above is the creation of a 30 foot strip of land owned by the City that links the West end of 25th Street to Hastings Avenue. This is all that is currently available for road purposes adjacent to the West boundary of the Molotsky property. I have highlighted the attached copy. of the Jefferson County Assessor's map of the Southeast quarter of Section 4 to show the land described in the deeds referred to in this memo.
