A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND
AUTHORIZING THE GRANTING OF A SEWER EASEMENT OVER UPON, ACROSS,
UNDER, AND THROUGH A PORTION OF LOT 4, BLOCK 3 OF THE MONOGRAM
ADDITION TO THE CITY OF PORT TOWNSEND AND AUTHORIZING THE CITY
MANAGER TO SIGN THE DOCUMENTS REQUIRED FOR RECORDATION OF SAID
EASMENT
Mr. David Deering dedicated Lots 1-8 of Block 3 of the Monogram Addition to
the City of Port Townsend in the year 1999 for the purpose of protecting an
environmentally sensitive area (i.e., wetland and critical drainage corridor) and
preserving valuable open space as identified in the city's comprehensive plan; and
WHEREAS, Mr. David Deering owns two building sites situated on Lots 5-8 inclusive in Block
4 of the Monogram Addition; and
in order to provide gravity flow sewer service to Mr. Deering's sites on Block 4, a
sewer easement is required over a portion of Lot 4, Block 3 of the Monogram
Addition; and
Mr. Deering has submitted for and received approval of an Environmentally
Sensitive Areas permit (LUP No. 97-00059) which addresses the impacts
associated with development of two residences on Lots 5-8 of Block 4 of the
Monogram Addition including impacts associated with a gravity sewer line over
and across portions of Lot 4, Block 3 of the Monogram Addition,
NOW THEREFORE, BE IT RESOLVED, that the City Council for the City of Port
Townsend does hereby grant and convey to Mr. David Deering (Grantee) the perpetual right in
the nature of an easement ten feet in width, over, upon, across, under and through real property of
the City of Port Townsend (Grantor) generally described as a portion of Lot 4, Block 3 of the
Monogram Addition and authorizes the City Manager to sign the required documents for
recordation.
Adopted by the City Council of the City of Port Townsend and signed by the Mayor this 18th day
of January, 2000.
