WHEREAS, the CITY OF PORT TOWNSEND., a municipal corporation now has an
easement for a water supply line across the L9j!A--- of the Sf,-y except that portion
lying east of the established road running in a Northerly and Southerly direction
across said premises in Section 21, Township 28. N, Range 2 w, W. M. All situate
in the County of Jefferson., State of Washington, to -wit:
Easement for pipe line granted to the City of Port Townsend from
Chas, R. McCormick Lumber Company,, for a strip of land 30 feet
wide, being 15 feet on each side of the center line of said pipe
line, dated April 24, 1928, and recorded in Volume 96 of Deeds$
on page 307., records of Jefferson County.
WHEREAS., this property is now owned by No -man P. Worthington., a bachelor -
as to an undivided one-half interest, and Robert E. Worthington and Janet Main
Worthington, husband and wife., presumptively as community property., as to the
remainder,, and
WHEREAS: the City of Port Townsend now wishes to renew the pipe through this
area., and in doing so wishes to relocate sane for the purposes of straightening
and shortening the right-of-way to an extent.
BE IT HEREBY AGREED., that for the sum of One Hundred Dollars at the time of
execution of this Agreement and additional remuneration upon completion.mutual-
ly agreed upon,, at the rate of One Hundred Dollars per acre for all area in ex-
cess of one acre included in that part of the new 30 foot wide right-of-way lying
outside of the existing right-of-way, plus One Hundred Dollars per acre for any
area outside of the 30 foot night -of -way used for borrowing of dirt, cutting or
clearing of trees for any purpose or wasting dirt., trees or debris. etc,, there-
on, said Norman P. Worthington., Robert E. Worthington and Janet Main Worthington
grant and convey to the City of port Townsend permission to relocate said water
supply line., it being understood that the easement now in force will continue to
be in force, but pertain to the pipe line in its new location, and that the City
of Port Townsend will, after the replacement pipe line is completed and placed
in service, no longer have any rights in that portion of the existing right-of-
way lying outside of the right-of-wzy as relocated.
