Charles D. Broder and Marie Broder, husbaad and wife, successor(s) to the
W. J. Adams Estate Company, is hereinafter termed "Grantor" of a right-of-
way and easement, dated the 4th day of September 1941, to lay, construct, maintain,
operate, repair, renew, from time to time change the size of, and remove a pipe-
line for the transportation of water in, under, along, and across that certain real
property situate in the county of Jefferson, State of Washington, and described as
follows, to-wit:
A strip of land of the uniform width of ten (10) feet, the center
line of which is described as follows:
Beginning at a point five hundred seventy-three (573) feet, more
or less, south of the northwest corner of Section 12, Township 29
North, Range 1 West, Willamette Meridian (being the point of inter-
section with the center line of the existing pipeline right-of-way of
the city of Port Townsend, as shown by map filed in the office of the
Auditor of Jefferson County, Washington, on March 1, 1905, under
Auditorls file #20427), thence along the said pipeline right-of-way
south eighty-four degrees, fifty-four minutes (840 541) east one thousand
four hundred fifty-three (1, 453) feet, more or less, across Lot 2 and
a portion of Lot 1 of said Section 12, to an intersection with the southerly
right-of-way line of the county road at approximately the northwest
corner of Tax No. 15, in said Section 12.
THE UNITED STATES OF AMERICA, "Grantee", under above identified
right-of-way and easement, proposes to assign said easement to the city of Port
Townsend, county of Jefferson, State of Washington, and the city of Port Townsend,
will assume all obligations of the Grantee, with respect to such easement. Grantor
herein agrees to the assignment, all other terms and conditions of the right-of-way
and easement to remain unchanged.
The assignee City of Port Townsend, in consideration of the approval of the
assignment by grantor, agrees that the grantor or successors will be provided a
minimum of four four-inch water taps for the described property, at the usual cost
therefor, upon application by the grantee or successors.
