RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND CONFIRMING THE CITY MANAGER'S DECISION TO
AWARD THE CONTRACT FOR THE TRI-AREA STORAGE TANK TO
T BAILEY INC.
The City Council of the City of Port Townsend, Washington, resolves as
follows:
WHEREAS, the City Council of the City of Port Townsend by
Resolution 00-025, passed May 1, 2000, authorized the City Manager to award the
contract for the construction of the Tri-Area Storage Tank project to the lowest
responsible, responsive bidder; and
WHEREAS, the City Manager, following review of the bid documents, the
bidder's bids, and the City Engineer's Memorandums dated May 23, 2000, and June 7,
2000, and letters submitted by the City's consulting engineers (CH2M Hill dated May
18, 2000, and May 8, 2000; R.W. Beck dated May 22, 2000; Grey & Osborne dated
May 22, 2000 (2 letters), May 17, 2000, May 10, 2000), and review of letters and
transmittals submitted by Seton Construction Inc. dated June 7, 2000, May 16, 2000,
May 10, 2000 and May 5, 2000 (and accompanying materials), and further discussions
with the City Engineer and consulting engineers, has determined that the bids submitted
by Seton Construction Inc. (Seton) and Hisey Construction, Inc. (Hisey) do not meet
the material terms of the bidding documents in all material respects, and particularly
that they do not meet Section 132089 of the specifications concerning Contractor's
experience, and that their bids are not responsive to the invitation for bids, and that the
bid Submitted by T Bailey Inc. (T Bailey) does meet the material terms of the bidding
documents in all material respects ahd is the lowest responsive, responsible bid,
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City
of Port Townsend that the decision of the City Manager to award the Tri-Area Storage
Tank Contract (Contract) to T Bailey, and reject the bids of Seton and Hisey as non
responsive, particularly in that they do not meet Section 132089 of the specifications
concerning Contractor's experience, is confirmed, and the City Manager is authorized
to proceed to award the Contract to T. Bailey, and to take all necessary and proper
steps to carry out the Contract, including improving appropriate change orders that do
not exceed the amount previously authorized by Council for this project in the approved
2000 Budget.
ADOPTED by the City Council of the City of Port Townsend and signed by the
Mayor on this 8th day of June, 2000.
