RESOLUTION NO. 20-012
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON AUTHORIZING THE CITY MANAGER TO EXECUTE A
SETTLEMENT AGREEMENT WITH THE ESTATE OF WILLIAM SHORT IN
JEFFERSON COUNTY SUPERIOR COURT CASE NO. 18-2-00013-16
WHEREAS, the late William Short occupied three properties consider public nuisances per
the Port Townsend Municipal Code; and,
WHEREAS, the City of Port Townsend initiated a lawsuit in Jefferson County Superior
Court seeking a declaration that two properties were a public nuisance, a warrant of abatement, and
$90,500 in fines and penalties; and,
WHEREAS,the Estate of William Short has successfully cleaned two properties and made
significant progress in cleaning the third property; and,
WHEREAS, City Staff and the Estate of William Short have negotiated a settlement that
includes continued effort in cleaning and maintaining the properties as well as establishing a lost
boundary line between 1158 Van Ness and the adjacent City right-of-way;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend, Washington, that the City Manager is authorized to execute a settlement agreement
with the Estate of William Short in Superior Court Case No. 18-2-0013-16 and execute all
documents necessary to fulfill the settlement obligations, including a boundary line agreement with
the Ruth Short Loving Trust establishing the property line between 1158 Van Ness and the adjacent
City Street.
ADOPTED by the City Council of Port Townsend, Washington, at a regular meeting
thereof, held this 16th day of March 2020,
