The following sections of the 2006 IEBC are noted to aid in project review: Section 305.1: "Subject to the approval of the Building Official,the use or occupancy of existing buildings shall be permitted to be changed and the building is allowed to be occupied for purposes in other groups without conforming to all the requirements of the International Building Code for those groups,provided the new or proposed use is less hazardous, based on life and fire risk,than the existing use." Note: Group R-3 is not less hazardous than Group B,but neither is it more hazardous. It is at the same hazard level in all 3 hazard level Tables 912.4,912.5, and 912.6. Section 305.4 Structural: "When a change of occupancy results in a structure being reclassified to a higher occupancy category,the structure shall conform to the seismic requirements for a new structure." Seismic upgrade is not required by this section: The building will remain classified as a Category II structure. Section 404 Alteration—Level 2: "Level 2 alterations include the reconfiguration of space,the addition or elimination of any door or window,the reconfiguration or extension of any system, or the installation of any additional equipment." Because space is being reconfigured and doors are being added and eliminated,this remodel project is considered a Level 2 alteration. Section 703.1: The egress stairway is outside of the work area, and the work area does not exceed 50 percent of the second floor area, so Section 703.2 does not apply. Section 703.4: Interior finishes to be in compliance with requirements for Occupancy Group R-3. Section 704 Fire Protection: There are no requirements for fire protection for Occupancy Group R-3 in this Section,except for smoke alarms as specified in the International Fire Code. Section 705 Means of Egress: Per 705.1,under this section there are no requirements for the means of egress because it is not shared by more than one tenant in the work area. Section 706 Accessibility: Not applicable for Occupancy Group R-3. Section 707 Structural: No requirements per 707.1 and 707.4.2. Section 708 Electrical: New wiring shall be in compliance with the requirements of Section 708 Section 709 Mechanical: No changes proposed to existing mechanical systems. Section 901.3.1: Partial change of occupancy classification. "Where a portion of an existing building is changed to a new occupancy classification , Section 912 shall apply." Section 912.2: This section indicates that an automatic fire sprinkler system should be installed throughout the area where the change of occupancy occurs, and that sleeping rooms and corridor areas outside of sleeping rooms shall be equipped with hard-wired smoke detectors. See notes on Section 306 below. Section 912.3: References Section 703.4, see above. Section 912.4: Hazard levels for Groups B and R-3 are equal, therefore existing means of egress shall meet the standards for Occupancy Group R-3. This means that per Section 805, means of egress lighting and exit signs are required, and per Section 705.2 Exception, the existing means of egress shall be considered compliant if it does not constitute a distinct hazard to life in the opinion of the code official. Section 912.5: Hazard levels for Groups B and R-3 are equal,therefore the height and area of the existing building is acceptable. Section 912.6: Hazard levels for Groups B and R-3 are equal,therefore the existing exterior walls, including openings, are acceptable. Section 912.8 Accessibility: See Section 706 above. Section 306 Historic Buildings: "The provisions of this chapter relating to the construction, repair, alteration, addition, restoration and movement of structures and change of occupancy shall not be mandatory for historic buildings where such buildings are judged by the building official to not constitute a distinct life safety hazard." The proposed change adds square footage to an apartment that already exists in the building and has existed for many years. No new residential units are being created. The apartment is partially on the second floor and partially on the ground floor of the building. There are two means of egress from the interior of the apartment. The proposed change gives access to the second means of egress to more of the second floor area. The new sleeping room will be equipped with hard-wired smoke detectors as required by code. The egress stairway is equipped with lighting and an exit sign as required by code. Section 912.2 requires that the 3 rooms subject to this renovation be equipped with an automatic fire sprinkler system. However,there is no existing sprinkler system in the building, so it is not available to be extended into these 3 rooms. Adding a sprinkler system to the whole building would seem to be unnecessary in this situation, since the rooms formerly used by a business are being added to an existing apartment and the day-to-day population of the building will actually decrease. The owners encourage the building official to find that there is no distinct life safety hazard, and that an automatic fire sprinkler system should not be required on account of this minor renovation project.
