In an email of 7/31/09 Vern basically withdrew his request for an extension so no actual consideration of the request was made by Rick Sepler. There is no other correspondence of any type in the BLD08-198 file referencing a request for an extension of that permit. Therefore, the permit is expired as of 4/20/09. However, that caused a problem because we need to lock one of the doors that is in an exit route. We deleted one of the exits and removed an exit light over the door that we need to lock. After respectful consideration of the above-referenced application, the Director of the Development Services Department(DSD) makes the follow Findings, Conclusions, and Decision. FINDINGS OF FACT 1 Proposal. The applicant proposes the construction of 17,472 square feet of commercial retail/office space, on approximately 40,000 square feet of land located within the C-I1 zoning district. Parking for approximately 60 cars would be provided, accessed via Howard Street. Maple Hill Office Center(Re-h ;enter) DSD Director's Findings,Conclusions and Decision Commercial Design Review Page 2 2. Project Location. The subject parcel is located in a C-II zoning district. It is legally described as Lot 1 of the Wolcott Short Plat, located at the northwest corner of Sims Way (SR 20)and Howard Street. The Jefferson County Assessor's parcel number for the parent property is 001 094 003 lying within Section 10, Township 30 North, Range 1 West, WM. 3. Review History. Commercial and office projects equal to or exceeding 4,000 square feet of gross floor area are subject to SEPA review. A Mitigated Determination of Non- Significance (MDNS) was issued on June 2, 2004. The MDNS was not appealed. A SEPA addendum was required to address modifications to the proposal that involved the construction of a singular, larger building and increased site grading. Revised and/or additional mitigating measures that address the revised project have been required. No Public Hearing is required for this application. 4. Design Review Required. Pursuant to PTMC 17.46 all new development within the C-II zone proposing structures exceeding 1,000 square feet in size must comply with the Commercial Architectural and Site Design Standards. The subject project is not exempt and is subject to Track 2 - Administrative Review with an Advisory Committee pursuant to PTMC 17.46.70 5. Application Submitted. The applicant submitted plans and supporting materials on January 25, 2005 and the application was found substantially complete on that date. The Advisory Committee met with the applicant's representative on February 25, 2005 to address design review issues. 6. Advisory Committee Meeting_ At their February 251h, 2005 meeting, the Advisory Committee expressed concern regarding the general orientation of the proposed building toward the primary street frontage and the manner in which the design addressed the intersection of Sims Way (SR 20) and Howard Street (consistent with the requirements of PTMC 17.44.050). The applicant's representative agreed to prepare revisions to refine the design. A continuation of the meeting was scheduled date specific to March 8, 2005. The applicant submitted revised elevations and floor plans on March 3, 2005. The Advisory Committee met on March 81h to review the revised materials. After discussion and consideration of the revised materials, the Committee recommended approval of the project with the following recommended conditions: a. Increased Emphasis on the Corner Elevation. The plan as submitted did not fully meet the requirement for emphasis on the corner intersection consistent with PTMC 17.44.050. The applicant shall prepare a revised building corner elevation for review by the Advisory Committee prior to the installation of exterior siding. The revised building corner elevation shall use architectural detailing and elements that reinforce the entrance to the building and place greater emphasis on the intersection. Such elements and/or detailing may include special siding patterns or the use of special materials. The applicant is encouraged to investigate Maple Hill Office Center(Re-_ .A Center) DSD Director's Findings,Conclusions and Decision Commercial Design Review Page 3 the use of a cornice line architectural element that incorporates the building name. Such an element may, if allowed by code, exceed the maximum building height for the zoning district. b. Streetscape Improvements. The applicant shall submit a sidewalk, street furniture and signage plan for review by the Advisory Committee. This plan shall be submitted upon completion of the design for street frontage improvement by the proposed SR 20/Howard Street Local Improvement District (LID). Should the LID not be successfully, the applicant shall submit the plan within 45 days of receipt of notification by the City that the LID will not be established. C. Preservation of Existine Trees in Parking Lot. The applicant should preserve groups of existing trees located within the parking area serving the building. The applicant is encouraged to preserve and protect groupings or"islands" of trees where possible on-site to provide visual relief. d. Future Pedestrian Connectivi , to o Adjacent Lots. The applicant has stated that the proposed project may one day become part of a larger"campus" of commercial office uses. The applicant should ensure that pedestrian connections are provided or are possible between the subject project and Lot 2 and 3 of the Wolcott Short Plat. CONCLUSIONS OF LAW Procedural: 1. Administrative Authority. DSD Staff is required to administratively review applications for Track-2 Design Review after consideration of the application by the Advisory Committee consistent with the requirements of Section 17.46.70 PTMC. Substantive: 2. Zoning; and Comprehensive Plan Designation. The subject parcel is located in a C-11 zoning district. The Comprehensive Plan designation is C-II. Review Criteria and Application. Section 17.44 PTMC governs the criteria for design review. The following summarizes the applicable criteria with corresponding Conclusions of Law: PTMC 17.44.050: Maximum building setback from primary street frontage. Commercial buildings shall be oriented towards the primary street frontage and public paths and/or sidewalks. Commercial buildings on corner lots should be oriented towards the primary intersection. As originally proposed, the subject building was oriented toward the internal parking area and not toward the SR 20 and/or Howard Street intersection and/or frontage. The proposal has been revised to better address the intersection consistent with this criterion. However, the design for the corner entry and fagade warrants further revision and refinement. The Advisory Committee has recommended a condition of approval that would allow for further design development. Therefore, this guideline as conditioned would be satisfied. PTMC 17.44.060: Topography. Existing trees, topography and other existing natural features shall be incorporated into the project design. 4. The existing site represents the remainder of a small hill that spanned the Sims Way (SR 20) and Howard Street Rights of Way. The Sims Way portion of the hill was removed many years ago to facilitate the establishment of SR 20. The Howard Street portion was removed in 1994 concurrent with the construction of the Port Townsend Business Park. Preservation of the hill would be difficult due to the need to excavate along the SR 20 frontage to install pedestrian improvements and facilitate commercial uses as envisioned by zoning. The environmental effects of the grading of the site have been evaluated through SEPA. The loss of existing trees on-site has been addressed through the provision of the Tree Conservation Plan. Therefore,this guideline is satisfied. PTMC 17.44.080: Landscaping Landscaping shall be incorporated into new development design to soften the manmade environment,provide vegetative buffers, open space and mitigate any unavoidable loss of existing native vegetation. The preferred method of landscaping is to first incorporate and preserve existing trees and shrubs, topography and other existing natural features into the project design. Any unavoidable loss of existing native vegetation shall be mitigated. 5. The proposed Landscaping Plan(Exhibit 2) will effectively support the architectural design of the proposed building. The proposed placement of trees and shrubs will partially screen views of the building from adjacent public street rights-of-way, thereby reducing the perceived mass of the building and better integrating it into the site. Future streetscape improvements will include street trees that will also help to reduce the perception of building mass. The proponent has meet or exceeded the requirements of the Tree Conservation chapter of the PTMC. The Advisory Committee has recommended a condition of approval to encourage the preservation of groups of trees in the proposed parking area. Therefore, this guideline as conditioned would be satisfied. PTMC 17.44.090: Off-Street Parking Lots. Development shall minimize the impact of parking on the building(s) relationship to the street and pedestrian-oriented character and character of the neighborhood. 6. The siting of the parking to the rear of the building effectively minimizes the impact of parking on the building(s)relationship to the street. Therefore,this guideline is satisfied. Maple Hill Office Center(Re-m x Center) DSD Director's Findings,Conclusions and Decision Commercial Design Review Page 5 PTMC 17.44.100: On-Street Parking On-street parking is encouraged along the streets, access drives, and alleys in commercial areas in order to provide convenient access and reduce the need for off-street parking lots. 7. The subject property and the proposed building location are located adjacent to the unopened Howard Street ROW. Howard Street is identified in the City's Comprehensive Plan as a potential alignment to provide a major north/south circulation connector. The establishment of a Local Improvement District(LID) is being investigated to provide needed improvements at the State Route (SR 20)/Howard Street intersection and along the Howard Street corridor. In order not to preclude potential alignments and avoid unnecessary costs associated with the short-term provision of required frontage improvements, the proponents have agreed to provide "interim" improvements and participate in the formation of the LID. Interim improvements will include the provision of a compacted temporary trail along both the SR 20 and the Howard Street ROW's. Future on-street parking opportunities will be addressed effectively through the LID design process. The proponents have also agreed (should the LID not be established)to construct street infrastructure consistent with adopted development standards. Adopted development regulations effectively address on-street parking requirements. Therefore, adequate on-street parking will be provided and this guideline will be satisfied. PTMC 17.44.110: Pedestrian- and bicycle.- iendly commercial development. Provide safe, bicycle and pedestrian friendly development. 8. A soft-surfaced pedestrian trail will be provided along the SR 20/Howard Street frontage of the site. Street improvements, including sidewalks, landscaping and possibly bicycle lanes (along the project's frontage on Howard Street)would be constructed as an element of the LID (see discussion at Conclusion 7, above) or would be provided subsequently. Therefore, adequate pedestrian and bicycle accommodations will be provided and this guideline will be satisfied. PTMC 17.44.130: Building Design, Materials and Colors. New development should recognize the city's architectural heritage through the use of building materials, building proportions, forms and details, and other architectural devices compatible with those design principles inherent in historic architecture, without replicating historical buildings. 9. The proposed building plans are consistent with the intent of this guideline in terms of design, materials and colors. The proposed building does not replicate existing buildings, but applies a common commercial vernacular style to a medium-scale commercial building. This design approach is appropriate for both the site context and proposed use of the structure as commercial offices. The applicant has used building footprint modulation, changes in siding material, window openings, and projecting canopy elements to provide building articulation and appropriate scale. Colors are earth tones (Exhibit 6) and are appropriate for the site. Therefore, this guideline is satisfied. The primary entrances of building shall be identified and highlighted through architectural details, lighting, and signage. The design of buildings shall enhance the relationship between buildings and streets by creating easily identifiable building entrances. 10. The proposed building has multiple entrances, with a major emphasis placed on the parking area. As revised and conditioned (see discussion at Conclusion 3, above) the proposed entry which addresses the SR 20/Howard Street intersection will incorporate architectural details that enhance the relationship between the building and the street by creating an easily identifiable building entrance. Therefore, this guideline as conditioned will be satisfied. PTMC 17.44.160: Weather Protection. Buildings should provide protection for pedestrians from adverse weather conditions. 11. The proposed building incorporates projecting canopies that will provide pedestrian weather protection along walking areas and at building entrances. Therefore, this guideline is satisfied. PTMC 17.44.170: Transparency. Buildings shall provide generous amounts of windows to create ground floors with a "transparent" quality in order to provide visual interest. 12. The proportion of window area to fagade is appropriate to the scale and size of the proposed building. Larger windows are located at the building entrances and at street level. Therefore, this guideline is satisfied. PTMC 17.44.180:LiQhtinQ. All exterior lighting, including that used to illuminate sign, shall be designed to reduce glare impacts to adjacent properties and public rights-of-way, to use energy efficiently, and to reduce nighttime "light pollution. " 13. Exterior lighting has not been proposed at this time. Street lamps that allow for adequate pedestrian illumination will likely be provided as part of the LID. However, should the LID not be established the applicant shall provide them. All proposed lighting for the building should be low-intensity, shielded and downward facing. A condition of approval requiring the provision of a lighting plan prior to issuance of a certificate of occupancy has been proposed. Therefore, as conditioned this guideline is satisfied. PTMC 17.44.190: Support Elements. Mechanical elements,-loading areas, trash, and recycling containers shall be located and/or screened to minimize their visibility from public view. 14. All proposed mechanical elements will be screened. Trash and recycle areas are proposed to be located at the west end of the parking lot. DECISION Based on the foregoing Findings of Fact and Conclusions of Law the application for C-II Design Review is hereby APPROVED subject to compliance with the following conditions: 1 Increased Emphasis on the Corner Elevation. The plan as submitted does not fully meet the requirement for emphasis on the corner intersection consistent with PTMC 17.44.050. The applicant shall prepare a revised building corner elevation for review by the Advisory Committee prior to the installation of exterior siding. The revised building corner elevation shall use architectural detailing and elements that reinforce the entrance to the building and place greater emphasis on the intersection. Such elements and/or detailing may include special siding patterns or the use of special materials. The applicant is encouraged to investigate the use of a cornice line architectural element that incorporates the building name. Such an element may, if allowed by code, exceed the maximum building height for the zoning district. 2. Streetscape Improvements. The applicant shall submit a sidewalk, street furniture and signage plan for review by the Advisory Committee. This plan shall be submitted upon completion of the design for street frontage improvement by the proposed SR 20 /Howard Street Local Improvement District (LID). Should the LID not be successfully, the applicant shall submit the subject plan within 45 days of receipt of notification by the City that the LID will not be established. 3. Preservation of Existing Trees in Parking Lot. The applicant should preserve groups of existing trees located within the parking area serving the building. The applicant is encouraged to preserve and protect groupings or"islands" of trees where possible on-site to provide visual relief. 4. Future Pedestrian Connectivily to Adjacent Lots. The applicant has stated that the proposed project may one day become part of a larger"campus" of commercial office uses. The applicant should ensure that pedestrian connections are provided or a possible between the subject project and Lot 2 and 3 of the Wolcott Short Plat. 5. Lighting Plan Required. The applicant shall submit a detailed lighting plan to DSD for their review and approval prior to issuance of a certificate of occupancy.
