A Notice of Application (NOA) and pending SEPA threshold determination was duly noticed pursuant to Chapter 20.01 PTMC. Ten comment letters (Exhibit C 1 - C9) were received during public review of the SEPA MDNS and the subdivision. Nine letters were sent by property owners and residents of the Fowler's Park community. Nearly all the letters expressed strong opposition to the project and listed a variety of concerns including: impacts to existing streets in the neighborhood, the need for a direct access street to the new lots from 53rd Street, potential conflicts between additional traffic and pedestrians on existing streets, potential impacts to adjacent wetlands, concerns about loss of open space and wildlife habitat areas, concerns about the future maintenance of new streets, and the aesthetic compatibility of the new homes with the existing homes in Fowler's Park. Environmental concerns raised in these letters were addressed in the SEPA MDNS. The tenth letter was sent by the Department of Ecology and urged that the developer take measures to prevent erosion and control the runoff of sediments. The clearing and grading permit process will require temporary erosion and sediment controls be in place prior to beginning grading activities. No changes to the SEPA MDNS were needed to address these concerns. The SEPA MDNS was not appealed and became final on June 24, 1999. 11. Through the SEPA process, the applicant has agreed to measures to mitigate probable significant adverse environmental impacts, including but not limited to: preserving native trees and vegetation wherever possible, constructing a second access street from the north end of Mason street to 53rd Street, providing traffic calming along Mason Street if it is opened for several blocks without interruption, improving the existing non-motorized pathway in East Diamond Street, participating in the provision of additional non-motorized pathways adjacent to this subdivision, and the installation of stormwater management facilities including biofiltration swales. Compliance with all mitigation measures will be a condition of final appIroval. 12 The subject r s � property does not contain environmentally sensitive areas (FBAs) as defined by PTMC 19.04. The eastern boundary of the subject property is adjacent to the City of Port Townsend Levinski Wetland reserve. The subject property lies approximately 400 feet northwest of the nearest wetland boundary, well outside applicable wetland buffers established by the Port Townsend Environmentally Sensitive Areas Ordinance. Potential impacts to the wetland posed by stormwater runoff from this development will be addressed and mitigated by the applicant's engineered stormwater plan which must assure the hydrology and water quality of the wetland will not be altered as a result of this project. 13. The subject property is not located within an identified flood hazard area as determined by the Federal Emergency Management Agency(FEMA). 14.
