NOTICE IS HEREBY GIVEN to the Grantor(s)/Owner(s) of the above-referenced real
property, to potential purchasers and future owners, to agents or representatives, and to any other
concerned person or entity:
1: The City's Critical Areas Maps identify the shoreline bluff as a geologically
hazardous area. Development is proposed within the Marine Bluff Management Zone.
The property and any future development on it may therefore be subject to Port
Townsend Municipal Code 19.05, Critical Areas, and limitations on action in or affecting
:such critical area or its buffer may exist. The regulations for geologically hazardous areas
are intended to protect the public health, safety, and welfare by reducing the potential for
personal injury, loss of life or property damage due to erosion; landslides, seismic events
or soil subsidence. Pursuant to the City's Shoreline Master Program Development
Regulation 6.8.1, the minimum buffer width for a marine bluff is determined by the
erosion rate over at least 75 years plus 20-feet. The city estimates the erosion rate to be 4
inches per year resulting in a buffer of 45 feet which is to be retained (i e , left
undisturbed) from the edge of all slopes and marine bluffs subject to landslide or erosion
hazards. The actual erosion rate and this associated buffer may be less; however, this
determination would require a report by a licensed geologist and City approval of said
report.
2. This shoreline bluff is also sensitive due to its habitat value. Eagles listed as a
"threatened" species under the Endangered Species Act, nest nearby in Fort Worden State

Park and feed along the shoreline. The Washington Department of Fish& Wildlife
recommends leaving strips of tall perch trees from 160-330 feet wide along the shoreline.
3. Per the Critical Areas Ordinance, retain the buffer. There shall be no further
expansions to or addition of any structures/impervious surfaces without prior review for
conformance with the Critical Areas Ordinance codified in Chapter 19.05 of the PTMC
and any other applicable laws and ordinances. Existing native vegetation on the face of
the slope and within the 45-foot buffer shall not be disturbed. Provided however, that
routine landscape maintenance of existing landscaped areas including pruning, weeding,
and planting is permitted, provided natural drainage patterns and topography are not
altered. A licensed arborist to afford views may prune trees. Water intensive plants (e.g.,
lawn) are not recommended within the 25-foot buffer along the top of the bluff.
4. Please, No dumping. The shoreline bluff fronting the property is a geologically
hazardous area. Any land disturbing activities are prohibited within the critical area and
its buffer. Dumping, filling, clearing of vegetation, and even disposing of yard waste can
adversely affect the bluff. On your property, stabilize soils by landscaping as soon as
possible. Stockpiles of soil and/or mulch should be covered until they can be used on the
garden. [NOTE: A permit is required before any land disturbing activity occurs within
the critical area or its required buffer.]
5. VOLUNTARY STEWARDSHIP
As a homeowner adjacent to the shoreline bluffs, you are invited to join in the
stewardship of this important resource. To do your part, please observe the following:
Plant Native or Naturalized Species. Exotic plants overcome native vegetation and alter
the function and value of the shoreline bluffs. Seeds from plants within your garden may
be dispersed to native areas by wind, water, or animals. Before you buy, ask your local
nursery about the invasive properties of plants. Choose native or naturalized plants over
exotic plant varieties.
Avoid use of Pesticides/Herbicides. The use of pesticides and fertilizers is discouraged.
Contact Washington Toxics Coalition, Washington State Department of Ecology (1-800-
633-7585),your local Soil Conservation District, or the Jefferson County Health
Department for alternatives to these products.
Utilize-Best Management Practices (BMPs). To reduce the risk of erosion, run-off
should be directed away from the bluff edge. Heavy watering adjacent to the bluff should
be avoided. The Department of Ecology's Stormwater Management Manual provides
additional measure to reduce the risk of erosion.
Educate your family and friends. The Applicants and future homeowners are
encouraged to implement the recommendations in the DOE pamphlet"Vegetation

Management: A Guide for Puget Sound Bluff Property Owners, including preservation
of native species, use of drought-tolerant, native or naturalized species, limbing of trees
verses tree removal. If you wish to learn more about shoreline resources, contact the
Department of Ecology or the City of Port Townsend Development Services Department.
6. Stormwater. All development shall comply with the 2005 Department of Ecology
Stormwater Management Manual for Western Washington(SWMM-WW(2005)), City
engineering design standards manual, City stormwater master plan, and adopted drainage
lans.

MISCELLANEOUS CLARIFICATIONS
1. Owner is responsible for acquiring all permits except for electrical permit.
2. Owner will supply power and water.
3. Column Stone will be Honey ledge Stone with a 25 % mix of Pennsylvania Bluestone.
4 Wilkerson stone is an acceptable alternate for the plinth cap with owners approval --

Recently we rece " o ,�`= W 0 1 the residence addressed as 5 12 5 North Pearl
Street located on u 1" M O a. 2 `� bluff, and you were listed as the

We researched the original land use applications submitted by the former owners, [Vir. and Mrs. Price, in
1999. The land use file LUP99-047 included a shoreline exemption permit, letter from staff and Hold
Harmless Agreement recorded by the Price's (copies enclosed). The original deck was built within 44
feet of the bluff. BLD09-147 proposes to demolish this deck and build a new deck that would extend an
additional 11 feet towards the bluff.
Because this property is mapped as a seismic Critical Area and is located within 200 feet of the ordinary
high water mark, both the Port Townsend Municipal Code's (PTMC) Critical Area Chapter 19.05 and
Shoreline Master Program were reviewed for potential need for land use permits. Both of these Codes
have been revised and updated since 1999.
The Critical Area Chapter 19.05 discusses Geologically Hazardous Areas in section 19.05.100; this
Code is available on-line at \w\vw.citvofpt.us. Section 19.05.100.D.2 states that when the bluff height is
between 51 and 100 feet, the marine bluff management zone is equal to the height of the bluff. The
Shoreline Exemption letter dated July 20, 1999 states that the bluff height on this property is
approximately 80-90 feet. Therefore, staff has determined that the proposed exterior additions require a
Minor Critical Area permit per PTMC section 19.05.040.B.La and b, which allow Minor Critical Area
permits for work that is "minor in nature" and "conducted in an insolated, self-contained area where
there is no danger to private or public property and minimal impact to the environment". In addition, a
shoreline exemption would be required for the exterior remodeling work including the deck, front porch,
and other minor exterior changes. A Critical Area and Shoreline Exemption application is enclosed.

Further, PTMC 19.05.040.e states, "if a critical area is confirmed to exist on site, an applicant may be
required to provide a critical area special report prepared by a qualified critical area consultant."
According to PTMC 19.050.020, the definition of such a consultant for areas of potential geological
instability must be an engineering geologist with a Washington specialty license in engineering geology
as specified in Chapter 18.220 RCW.
Therefore, please provide such a special report evaluating the proposal to build closer to the bluff(i.e.
extend the existing deck) with the Minor Critical Area and Shoreline Exemption applications. These
permits must be issued prior to the building permit.

1/8/10 John McD. And Suzanne met with Mr. Lyle about 2 issues:
1) He would still like to build a rear deck. 45' from the bluff is a no touch zone. His
geotech would not disagree with the 4"per year for 75 years +20 feet. He may be
proposing a deck below 30". Even though it wouldn't need a building permit, told him to
submit it so DSD could approve it.
2) He said the drawing with BLD09-147 was incorrect. Based on a survey, there would
only be/ of 20' between the front porch and the property line. He needs to meet the
20 feet (which would involve a revision to the building permit) or apply for a variance.
See setbacks drawn on survey, attached.
