Date tree clearing needed for this work(Exhibit A— Scout House septic and tree removal plan). This approval is further conditioned as outlined below. The Scout House property is zoned General Commercial (C-II). It is also encumbered with a series of utility, non-motorized and conservation easements reserved as part of a street vacation process approved by the City Council in 2009. Per the City's Tree Conservation code (PTMC 19.06), tree removal on developed properties in the General Commercial zone (C-II)require a written exemption to ensure compliance with adopted tree retention standards continues to be met. For C-II properties, tree retention standards are set at 20 tree unit credits per 40,000 square feet of land area. A tree unit (t.u.) is a weighted credit based on the diameter of a tree at breast height(d.b.h.). As the Scout House property is approximately 3.5 acres in size it requires the retention of approximately 75 t.u. credits. (Exhibit A shows the area being cleared would involve the removal of approximately 28 trees of varying sizes, species and health. Given the extensive forested canopy that will remain on the Scout House property site afterwards (Exhibit B—2004 aerial photo), it is clear the City's required tree standards will continue to be met. A formal calculation of existing and removed t.u.'s is not necessary given the scope of this proposal. Condition(s): I. The reserve area shown on Exhibit A indicates it would fall into the 20' wide conservation easement reserved along Sims Way as part of the 2009 street vacation proceedings. Please be advised that this written exemption is not authorization to remove trees within the easement now or in the future. In the event the new drainfield being installed fails and additional area is needed, the Legion and/or Scouts will need to address the overlapping nature of the planned reserve area with the conservation easement. The City Council initiated a street vacation process for 2"d, 3`d and Spring Streets lying between Sims Way and Discovery Road by Resolution 08-046 (December 1, 2008), and held a hearing on February 2, 2009. The vacation process was initiated at the request of the Fred Lewis Scout Cabin Association ("Scouts")and the American Legion (Marvin Shields Post 26)("Legion"). B. The Scouts and Legion proposed a street vacation of 2"d, 3`d and Spring Streets lying between Sims Way and Discovery Road, and adjacent to property owned by the Scouts (with reversionary interest held by the Legion), subject to an exchange of benefits. Following discussions with the Scouts and Legion, the exchange of benefits would consist of a 20' easement along Discovery for nonmotorized uses and underground utilities, a 20' conservation easement along Sims Way, and the Scouts and Legion would provide access across their property to a city waterline in the Spring Street right of way and extending north to Discovery. The street vacation would be subject to reservation of an easement for the city waterline in vacated Spring Street right of way. C. The City Council Special Projects Committee met with representatives of the Scouts and Legion on February 5, 2009, and the Committee recommends the street vacation with the exchange of benefits set forth in this ordinance. D. The Scouts and Legion support the street vacation. The street vacation consolidates their property free of rights of way, and allows the Scouts to move forward with the location of a Scout Cabin in the vicinity of vacated 3`d Street. E. The proposed street vacation is not inconsistent with any adopted policies of the City. The vacated rights of way are not needed for current or anticipated transportation. utility, emergency purposes, and the vacation does not affect any sensitive areas. F. Acquiring an easement along Discovery is a significant benefit to the City because it allows more design options for improvements to serve future motorized and nonmotorized needs along this corridor. The current 60' Discovery right of way is not adequate to accommodate a potential design of three lanes(two lanes plus a center lane), sidewalks or pathways, bike lanes, and some separation between the sidewalk and the street. Acquiring an easement along Discovery now as part of an exchange avoids the expense, delays, and uncertainties to the City of acquiring such rights in the future. Potential future acquisition costs to obtain an easement along Discovery could be in the range of thousands of dollars in transaction costs, in addition to the actual cost of the property acquisition. Avoiding these costs,delays, and uncertainties is a significant benefit to the City. H. The conservation easement along Sims is a significant benefit to the City because it partially implements the Sims Way"forest corridor"called for in the Gateway Plan (which Plan was incorporated into the Comprehensive Plan). i I 1. The access across the property to the waterline is a benefit to the City. J. Expanding the scope of the waterline easement north of Spring Street to a full 25' is a benefit to the City. K_ On the other hand, the value of the vacated right of way to the City has a limited benefit to the City. It is unlikely to ever be needed for motorized transportation purposes. Nonmotorized transportation needs can be accommodated on City property to the west or on private property to the east when that property develops. Other right of way uses for the vacated streets (for example, stormwater)are also a lower priority and can likely be met in the expanded easement along Discovery Road or in the adjacent City-owned property to the west. L. The Public Works Director determines that the benefits to the City from the exchange of benefits are equal to or greater than the value of the right of way being vacated. Based on this determination, and for the reasons set forth in this ordinance, the City Council waives requirement for an appraisal. City: • City may use the easement for any non-motorized use(trail,sidewalk,bike path/lane, or any combination of paths/lanes/trails/sidewalks) • City may use the easement for any City under-ground utilities(and may use for stormwater ditches/swales). • City may not use the easement for any motorized purposes. For example,City cannot locate street improvements in the easement. (This does not preclude apron improvements in the easement for Scout d/w.) Non-City Utilities: • Non-city utilities may be located in the easement,so long as the utility is under grounded, and so long as compensation is paid to the Scouts/Legion for use of the easement. The utility is allowed by City approval prior to resolution or payment of compensation(no further Scout/Legion approval required to locate a utility in the easement—to avoid delays in utility location). • If the Scout/Legion and the private utility cannot agree on compensation within 30 days after the private utility notifies the Scouts/Legion that it has acquired all other needed easements or rights for its project ,then the issue of compensation shall be referred to binding arbitration. The parties may agree on a single arbitrator. In the event that they cannot so agree, one arbitrator shall be selected by the Scouts/Legion, and one by the utility and the third shall be selected jointly by the first two arbitrators. An arbitrator shall be a State of Washington state certified general real estate appraiser. If one arbitrator is used,the parties shall share the cost equally. If three arbitrators are used,then each party shall pay for the appraiser they select,and shall share the cost of the third appraiser. The parties agree that a majority decision of the arbitrators shall be binding upon the parties. In the event of any dispute arising concerning arbitration,the rules and procedures of the American Arbitration Association under its Commercial Arbitration Rules shall apply. City: • City may use the easement for any non-motorized use(trail,sidewalk, bike path/lane,or any combination of paths/lanes/trails/sidewalks) • City may use the easement for any City under-ground utilities(and may use for stormwater ditches/swales). • City may not use the easement for any motorized purposes. For example,City cannot locate street improvements in the easement. (This does not preclude apron improvements in the easement for Scout driveway(s).) Easement may be used for street landscaping (for example, landscaping strip); street or non-motorized signage(that is,relating to street traffic, or use of trails,etc in the easement)and safety-related improvements such as bollards, barricades: public amenities(for example, benches, bike racks), public art etc.) No public restroom shall be located in the easement. For any public art located in the easement,the City shall give specific notice to the Scout/Legion and allow them to comment on the proposed art. • Easement may be used for bus pull out,but only in the southerly 300' of the easement. 2. Non-Cif Utilities: • Non-city utilities may be located in the easement,so long as the utility is under grounded, and so long as compensation is paid to the Scouts/Legion for use of the easement. The utility is allowed by City approval prior to resolution or payment of compensation (no further Scout/Legion approval required to locate a utility in the easement—to avoid delays in utility location). • If the Scout/Legion and the private utility cannot agree on compensation within 30 days after the private utility notifies the Scouts/Legion that it has acquired all other needed easements or rights for its project,then the issue of compensation shall be referred to binding arbitration. The parties may agree on a single arbitrator. In the event that they cannot so agree, one arbitrator shall be selected by the Scouts/Legion,and one by the utility and the third shall be selected jointly by the first two arbitrators. An arbitrator shall be a State of Washington state certified general real estate appraiser. If one arbitrator is used,the parties shall share the cost equally. If three arbitrators are used,then each party shall pay for the appraiser they select, and shall share the cost of the third appraiser. The parties agree that a majority decision of the arbitrators shall be binding upon the parties. In the event of any dispute arising concerning arbitration,the rules and procedures of the American Arbitration Association under its Commercial Arbitration Rules shall apply. Time frame for the use of the existing septic system and installation of new system components has changed and is now limited to 3 months. 2. Conditions for use during 3 month period. A. Scout use/occupancy only; no use of building or grounds to other groups or events. B. No use of kitchen facility that involves food preparation or clean up from an event. C. A complete Septic Permit Application must be submitted to and approved by Jefferson Co. Health Dept. prior to approving the Conditional Occupancy Permit. D. All septic design work shall be done by an approved WA. State licensed septic design professional. I believe I have done all that I can do at this point to help find a workable solution for the F.L. Cabin. The building cannot receive an Occupancy Certificate and Final Inspection without first obtaining an approved septic system design and installation approval. I am not familiar with a "Conditional Cerliflcatc of Occupancy" As I stated before, without an acceptable application to bring the system into compliance our office would find it challenging to approve occupancy for this project based on the state of the current sewage disposal system and our prior history with this project. You mentioned an"agency snafu," I disagree with you in that assessment, the city brought this septic system issue to the applicants'attention in 201 1, as did the county. If a snafu is present it would appear to be due to management of the project. The agencies operated as they should in this case. Like JCPH, I don't believe the city wants to final buildings without properly addressing the sewage those buildings generate. Because we are talking about the Boy Scouts of America, we all want to final off this project and are ready to act as soon as possible. 4 JCP1-1 is prepared to expedite a septic permit application once received. Additionally this process can be further accelerated if the septic designer is in contact w/our department prior to application submittal. They will be moving forward to address the septic issue. They do have a problem, they have construction only insurance coverage and cannot convert the policy to property coverage and use liability until they receive a certificate of occupancy. Ralph indicated that they have a couple of items to complete for the permit to be finaled. The County does not want to have the permit finaled until the septic issue is resolved, the City wants to final off the permit once the construction is complete and this whole snafu appears to be one of agency coordination. In order for the Scout Cabin to be utilized during resolution of the septic issue, a Conditional Certificate of Occupancy will need to be issued once the building corrections are complete (perhaps next week) in order for the insurance to be obtained and the facility utilized.
