Cc: Charles Tandy,Fire Chief, East Jefferson Fire & Rescue I am in receipt of the set of plans for the above-referenced proposal from your office, have reviewed the proposal with the International Fire Code [I.F.C.], 2006 Edition and Washington State Amendments, and applicable N.F.P.A. 13 code sections. The following constitutes this plan examiner's findings and determinations based upon the plans of record submitted. It is understood that required automatic sprinkler system detail plans and specifications are deferred submittals. Findings & Determinations: 1. The proposal was reviewed as a one-story porte-cochere addition to a Group I-2 Occupancy with Type V-I hour construction classification; and, 2. The redesigned road access for this proposal is found to be consistent with Section 503 and Appendix D fire apparatus access road design standards. 3. The dimensions and height of the Porte-Cochere are found to be consistent with Ordinance 2947 for emergency vehicle navigation. 4. An automatic fire suppression system (sprinklers) is required for the Porte-Cochere under NFPA 13, Section 8.15.7, as the proposed Type V-1 hour construction is not considered "Limited-Combustible Material"under NFPA 13, Section 3.3.1 1 a. The automatic fire sprinkler system shall be designed, installed, and certified by a licensed technician (W.A.C. 212-80) or registered professional engineer using the design provisions of NFPA 13 and related sections, and; b. The attached application checklist for automatic fire sprinkler systems shall be used as a guide for detailed plan submittal to the City of Port Townsend Building Department; and, c. A complete set of as-built drawings of the system shall be filed for record with this department, and on-site in a formal plans box adjacent to the F.A.C.P., submitted on a 24 x 36 inch maximum format, and; d. Improvements included replacing the existing propane emergency generator with a larger diesel emergency generator. Plans approved through MEC09-027 were resubmitted with the new generator approximately ten feet closer to Kah Tai Lagoon. Improvements would be located within 200-feet of Kah Tai Lagoon, and within a seismic hazard area mapped on the west (lagoon) side of the building. After respectful consideration of the above referenced application, the Port Townsend Director of Development Services hereby adopts the following Findings, Conclusions and Decision. Kah Tai Care Center—LUP09-055R-I Page 2 of 5 FINDINGS OF FACT Project Description 1) On September 22, 2009 Don Kirkman, architect for the Kah Tai Medical Investors' project, submitted a revised site plan for alternate placement of the emergency generator on the south side of Kah Tai Care Center(Exhibit A—Site Plan). Approval is sought to relocate the new supplemental emergency generator further away from the building due to fire code and building code issues. On October 1, 2009, Consulting Fire Code Inspector Tom Aumock submitted a report with findings and determinations for this change (Exhibit B -Fire Code Report). Reasons for relocating the generator to the proposed location include locating it a minimum of eight feet from building vents (proximity of fueled equipment exhaust discharge), retaining an unobstructed patient's egress window (8-foot high sound wall around generator would reduce egress space), and keeping the straight route of a new ADA sidewalk. Recent photos taken by Staff(Exhibit C - Photos) indicate the proposed location for the new generator west and north of the existing generator (the white "box" structure). 2) Pursuant to Section 10.4.1 of the SMP, the original application was processed as a Type 11 Minor Shoreline Substantial Development Permit. Type II Shoreline permits are subject to review and approval by the City's shoreline administrator and public notice is required (PTMC, Chapter 20.01). One public comment letter from neighbor Margaret Lee was received during the initial comment period. As a party of record, a copy of this decision will be mailed to her. The decision may be appealed to the city's Hearing Examiner pursuant to Chapters 1.14 and 20.01 of the Port Townsend Municipal Code (PTMC). 3) City staff contacted Jeffree Stewart of the Department of Ecology for his comments regarding the relocation of the generator. He stated he did not object to the relocation of the generator as it is still being located as close to the building as allowed by code. Chris Byrne of the Department of Fish and Wildlife was consulted for possible adverse effects to wildlife, but he did not return a-mails or phone calls. According to Project Manager Butch Jensen, the emergency generator would be tested once a month for five minutes and then only used for emergencies. He stated that the noise level is equivalent to that of a diesel motor. 4) DSD received an e-mail dated September 27, 2009 from Margaret Lee describing her concerns regarding the construction area between the care center and the lagoon (Exhibit D—Code Enforcement Report COD09-106). Code Enforcement Officer Rick Taylor visited the site on September 30, 2009. He reported that the stockpiled material was to be removed and that the site did not appear to be over graded or Kah Tai Care Center—L UP09-055R-1 Page 3 of 5 cleared (Exhibit E —COD09-106 Findings). Project Manager Butch Jensen received a copy of Ms. Lee's e-mail. CONCLUSIONS Based on the findings of fact entered above, the following conclusions are entered: 1) The proposed relocation of the generator is consistent with the 2006 Edition of the International Fire Code and International Building Code Chapter 11 (sidewalk requirements for accessibility). 2) As conditioned below, the proposed project would not have a detrimental effect on the public interest. 3) Per the Shoreline Master Program (SMP) Chapter 6 Environmental Protection and the Port Townsend Municipal Code Critical Areas Chapter 19.05.060 Performance Standards, disturbed areas around shorelines and critical areas are to be protected and restored. Areas of previously undisturbed natural vegetation that have been damaged by human activity must be replaced with compatible species. In addition, pesticides and fertilizers are not to be used within the shoreline jurisdiction. DECISION Based on the findings of fact and conclusions of law entered above, the decision of the Shoreline Administrator on the request by Kah Tai Medical Investors, LLC to relocate the generator from the location shown in Shoreline Substantial Development Permit File No. LUP09-055, is as follows: The application is CONDITIONALLY APPROVED, subject to the following stipulations: General 1) Construction shall be completed in strict conformance to the submitted plans for BLD09-093, BLD09-136. MIP09-082 and MEC09-027. 2) Construction and emergency generator acceptance testing shall be conducted in accordance with the requirements of the Washington State Department of Health. During Construction 3) To minimize potential impacts to water quality/habitat, project activities shall be conducted in accordance with Best Management Practices contained in the Department of Ecology Stormwater Management Manual for Puget Sound. All construction debris shall be properly disposed of on land in such a manner that it cannot enter into the waterway or cause water quality degradation to state waters. Kah Tai Care Center—LUP09-055R-I Page 4 of 5 Prior to Final Building Inspection 4) The applicants shall conform to PTMC Section 17.44.180, and ensure that all exterior lighting meets these standards. 5) Per 19.05.060, all disturbed areas between the care center and the lagoon shall be restored to a comparable pre-construction condition and re vegetated, i.e. reseeded with grass. Pesticides and fertilizers are not to be used within the shoreline environment. Expiration 5) Construction or substantial progress toward construction shall be undertaken in accordance with approved plans within six months of the date of approval of the Minor Shorelines Substantial Development Permit. The director may allow for one six-month extension provided the applicant has shown a good faith effort to comply. Pursuant to WAC 173-27-090, a project for which a Minor Substantial Development Permit has been granted pursuant to the Shoreline Management Act must be completed within five years and a one-year extension may be considered. Jurisdiction for the project involves the Washington State Department of Health, the Washington State Fire Marshal for this Group I Occupancy, NFPA 110 - 2010 Edition, and the International Fire Code - 2006 Edition. The question from the contractor was relative to the site plan for the proposed generator, fuel tank, and sound wall. Field investigation noted at least two large vents on the facility's west exterior wall, and a formal egress window for one of the facilities rooms, and a required A.D.A. sidewalk [I.B.0 Chapter 1 Isidewalk]that serves an egress door for the facility. Findings&Determinations: 1. The proposal was reviewed as Group I-2 Occupancy with Type V-1 hour construction classification. 2. Any relocation of the proposed project site plan would interfere with the normal operations of a. The noted building vents—proximity of fueled equipment exhaust discharge b. The noted egress windows—generator area sound wall reduction of egress space c. The noted A.D.A. sidewalk—require re-routing of sidewalk 3. The attached plot plan for the location of the generator meets the setback requirements of Code, will not interfere with: a, The IBC Chapter 11 sidewalk requirements for accessible buildings and facilities, b. The IBC egress requirements for unobstructed egress windows. c. Not require a re-design of the A.D.A. sidewalk that would extend the travel distance with the addition two additional turns. d. Meet the setback requirements of applicable codes from the existing building exterior. It is the recommendation of the consulting Fire Code Inspector that the proposed [attached] plot plan for the emergency generator outdoor facility be approved. The Washington State Deputy Fire. Marshal concurs with this determination. Any other applicable or relevant sections of said Code not covered herein shall nonetheless apply to this proposal. Dear-Mr. Septer, The Conditional Approval by the City of this project and the Findings, Conclusions and Final Decision are based on the information provided in this document, however, I believe that upon examination of the site and what is actually taking place there, you will determine that the improvements to the shoreline-side concrete patio and sidewalk require further scrutiny. Though you state in your findings that, "These improvements do not require a building permit as sidewalks and walkways not more than 30 inches above adjacent grade are exempt per the 2006 International Building Code section 105.12.6, nor do they require public works permits as they are located on private property", these improvements involve more than a "sidewalk"or"walkway"and though they may be on private property, they are adjacent to a Critical Area. Examination of the site will reveal that the area torn up behind the building is large. One could say it has been "cleared and graded". What is more, the material removed from that area made up of concrete, sand and dirt, blackened soil and hard material apparently made up of asphalt or some other oil-based substance, has been "stockpiled"on the south end of the property, relatively close to the water, with no covering or barrier of any kind between it and Kah Tai Lagoon. (Fortunately,we have not had appreciable rain recently.) This material is.not"self contained"and is a potential"danger to private/public property". It could impact a critical area and it's buffer. It is in violation of the laws and ordinances of the City of Port Townsend, including Chapter 5, Clearing and Grading and Erosion Control. It seems inconceivable that a Shoreline Exemption LUP09-035 was necessary and issued for"normal maintenance and repair"on the west side of the building while this more consequential undertaking, described as a"diminutive improvement, did not. No permit was necessary. Might we also be concerned about what oversight will be given when the time comes to replace the propane generator and fuel tank on the shoreline side of the building? In addition to the previous observations,please consider the last sentence of Findings of Facts(13): "A critical areas permit will not be required (PTMC 19:05040C(2))provided that the construction shall be conducted in a manner consistent with best management practices(BMP's)." Facility planning must include, in addition to space and operational needs,provisions for infection control and safety of the facility's occupants during any renovation or new construction. The facility's infection control practitioner (ICP) and safety and security personnel (S&SP) should be involved with facility planning, design, construction, and commissioning of any new or renovated area. Per the Functional Program during the window replacement portion of Phase One work will occur between 8:00am and 5:00pm, and: 1) Residents will be removed from their rooms when window replacement is being done in that room. Residents will be moved to an unoccupied room or to an activity area. It is estimated that residents will be out of their room for only on hour. 2) Corridor door of the scheduled room will be kept closed to reduce noise and keep dust confined to that room. 3) Housekeeping and maintenance staff will be detailing each room before residents are returned. Per the Functional Programs during the kitchen equipment, siding, sidewalk/patio, and roof replacement portions and installation of the back-up generator of Phase One, work will occur between 8:00am and 6:00pm, and: 1) Kah Tai's Social Services department will be monitoring the residents twice a day on a daily basis. Findings of Fact 1. On May 28, 2009 Jeff Randall submitted a variance application in order to build a single- story two car garage with attached office bedroom on his property at 1142 Adams Street. The property is located in the R-11 zoning district. The proposed garage would extend two feet into the R-II zone minimum 10-foot side setback. A minor variance may permit up to a 20% reduction of one setback in the residential zoning districts from the setback requirements in Port Townsend Municipal Code (PTMC) 17.16.030. 2. The property is described as follows: Lot 11. Block 22 of Plummer's Addition to the City of Port Townsend, as per plat recorded in Volume 1 of Plats, page 34 records of Jefferson County Washington, Assessor's parcel number 988-802-208. 3. The property is not mapped as containing critical areas as defined in Title 19.05 of the Port Townsend Municipal Code. 4. Jeff and Shelly Randall own the property. 5. No prior variance applications have been submitted for the subject property 6. On June 17, 2009 the city provided public notice for the proposed variance through a legal advertisement in the Jefferson County Leader newspaper, a public notice signboard placed by the owners on the property, and a mailing to neighboring property owners. Staff determined that the variance request was minor enough as not to warrant additional notice. No comments were received in response to publication or posting of the notice. 7. Chapter 17.86 of the Port Townsend Municipal Code (Variances) specifies the criteria for approval or approval with modifications of an application for a variance from the provisions of the Title 17 (Zoning). The purpose of the variance process is to provide a mechanism whereby the city may grant relief from the provisions of Title 17 when it meets the criteria listed at PTMC 17.86.050. These criteria are included below in italic with corresponding analysis and conclusions following. Page 1 of 3 Randall Variance LUP09-039 Conclusions 1_ (PTMC 17.86.050 A) The variance will not constitute a grant of special privilege inconsistent i+ith the limitation upon uses of other properties in the vicinity and zoning district in which the subject property is located. A number of properties in close proximity to Randall property contain structures that do not meet current setback requirements. (See Exhibit A.) 2. (PTMC 17.86.050 B) The variance is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property, to provide it with use rights and privileges permitted to other properties in the vicinity and in the zoning district in which the subject property is located. Due to the shape and slope of the lot, no other location or orientation on the property is suitable for the garage and bedroom/office. Driveway locations were limited by the existing Qwest telephone box which prevents the facing of the garage entrance toward Adams Street. Due to the slope of the lot, the garage would not be accessible from Roosevelt Street so the driveway must be located on Adams Street. From Adams Street, drivers will turn onto the driveway and then turn approximately 90 degrees to enter into the garage. When exiting the garage drivers will need to back up and use a 3-point turn to exit onto Adams Street. The exiting maneuver would be very difficult without the variance and drivers may inadvertently back into the corner of the existing house. (See Exhibit B.) 3. (PTMC 17.86.050 C) The granting of the variance will not be materially detrimental to the public welfare or injhrious to the property or improvements in the vicinity and zoning district in which the subject property is located. Since the Adams Street right-of-way is wide and the paved road surface is narrow, the new garage structure will be 39 feet from the edge of the Adams Street pavement. Because of the large distance between the pavement edge and the proposed garage, the garage will not hinder or be a detriment to public access to the right-of-%vay. Since many other properties in the area also contain structures that do not meet current setback requirements the new garage will not appear out of place. 4. (PTMC 17.86.050 D) The special circumstances of the subject property make the strict enforcement of the provisions of this title an unnecessary hardship to the property oivner. Because of the shape and slope of the lot. the location of the existing house, and the location of a Qwest telephone box, the proposed location of the garage and driveway is the only location on the property that makes sense. Without the variance, vehicle maneuvers for exiting the garage would be extremely difficult. The variance will allow more space for vehicle access and will reduce the chance that someone Will back into the existing house. 5. (PTMC 17.86.050 E) The special circumstances of the subject property are not the result of the actions of the applicant. No actions of the applicant affected the shape or slope of the lot or the location of the Qwest telephone box, which are the main reasons the garage cannot be located or oriented in any other way. 6. (PTMC 17.86.050 F) The variance is the minimum necessary to fidfill the purpose and the creed of the applicant. The garage is the minimum size necessary to accommodate the owners' vehicles. Without the variance, vehicle maneuvers for exiting the driveway Pate 2 of 3 Randall Variance LUP09-039 would be unnecessarily difficult and a smaller reduction in the setback would not provide a significant improvement in accessibility of the garage. 7. (PTMC 17.86.050 G) The variance is consistent with the purposes and intent of this Title. One of the purposes of Title 17 (Zoning) is to "encourage infill and redevelopment of developed portions of the city in a manner consistent with the prevailing scale and character of the community" (I 7.04.020.C). The area contains other similar structures to the proposed garage and the area is already landscape. The garage and bedrooin/office structure will fit into the neighborhood character and the variance will not cause it to seem out of place. 8. (PTMC 17.86.050 H) The variance is consistent with the goals and policies of the Port Townsend Comprehensive Plan. One of the Comprehensive Plan "Land Use Goals and Policies" is to "encourage well designed infill development through development bonuses and by allowing innovative lot development." This project is consistent with this intent and will allow use of the property in a safe and reasonable manner. Decision Based on the foregoing Findings and Conclusions, application for Variance LUP09-039 is hereby APPROVED subject to compliance with the following CONDITIONS: 1. The applicant is to submit a complete building permit application for the garage and \ bedroom/office for approval by the Development Services Department. After the building pen-nit is issued; the garage and bedroom/office must be built to the current International Residential Code building standards, and pass a final building inspection.
