accessory structure to a primary residence owned by the DeLeo's on Parcel B.
Since there is no primary residence on Lot 2, that lot must be attached to Lots 5
and 6 in order to comply with zoning regulations which require accessory
structures-to be on the same parcel as the primary residence.
However, in the future, Lot 2 may be transferred or conveyed separately from the
remainder of Parcel A(Lots 5 and 6), in one of the following ways:
1. By demolishing the accessory structure; or
2. By moving the accessory structure onto a parcel with a primary residence or
other location in conformance with zoning regulations; or
3. By undergoing Lots of Record Certification prior to the sale or transfer of Lot
2. At such time, the proposed buyer of the property would be required to sign
a statement declaring that the use of the lot would be brought into compliance
with zoning regulations within two years of the sale date by removal of the
structure or converting it to a residential use, or by construction of a primary
residence on the lot subject to all zoning regulations, including lot coverage, in
place at the time of proposed construction. The applicant may request an
extension of the time period from the BCD Director at the time of Lots of
Record Certification, if the two-year period can be shown to be a hardship..
