Intermittently operated systems shall have the capability for continuous operation, and have a manual and automatic control such as an automatic control timer. At the final inspection the timer shall be set to operate the whole house fan for at least 8 hours per day. Fan Noise (302.3.3) for whole house fans located 4 feet or less from the interior grille shall have a sone rating of 1.5 or less measured at 0.10 inches water gauge. Remotely mounted fns shall be isolated from the structural elements of the building and attached duct work using insulated flexible duct or other approved material. Owners, purchasers and lessees are hereby notified that all lots are subject to the approved Tree Conservation Plan on file with the City of Port Townsend Development Services Department. Limitations on tree removal, requirements to protect certain trees and/or plant new trees and signing of a tree conservation affidavit as a condition of building or other site development permits may be required_ Interested parties should contact the City of Port Townsend for additional information on tree conservation measures applicable to any lot. 28. For any lot where there is a substantially complete building permit application filed with the City within five(5)years of the recording of this Declaration, all stormwater created by impervious surfaces on individual parcels or lots will be detained, infiltrated, or dispersed on the individual lot or parcel where it is created in accordance with the"2005 Western Washington Stormwater Manual", as adopted by the City of Port Townsend in 2006 (without application of any amendments thereto adopted by the City within the five year timeframe). After the above timeframe, lot development shall comply with the stormwater management regulations of the City in effect at the time a substantially complete application is made. 29. COVENANTS AND DECLARATIONS AFFECTING LOTS 14, PARKVIEW ADDITION SHORT PLAT NO. 1—THESE ARE CONDITIONS OF SHORT PLAT APPROVAL DETERMINED BY THE CITY OF PORT TOWNSEND 30. The referenced Final Stormwater Management Plan prescribes the following minimum maintenance requirements by the owners of Lots 1 through 4 of Parkview Addition Short Plat No. 1, as follows: a. The lot owners adjacent to the surface storm water bioswales/ponds located generally in the 25h Street right of way along the southerly lot line of said lots, shall be required to mow the swales twice a year; the first mowing by May 1 of each year and the second mowing by October 1 of each year. The debris from the mowing operation shall be deposited in a disposal site approved by the City Public Works Director. b. Prior to October 1 of each year and within three days of all significant storms,the swales and ponds as constructed within 25t'Street right of way shall be inspected to determine if debris and/or sediment have been deposited within the storm water facilities. C. All debris shall be removed and any sediment removed to original constructed grade to disposal site approved by the City Public Works Director. d. All swales and ponds shall remain operational and functional in the same manner and degree as originally constructed. Any repair or replacement for any reason shall be the responsibility of the owners of said Lots 1 through 4. C. In the event of any conflict between the Stormwater Plan and terms of this Declaration, the Declaration shall prevail. In the event of correction and enforcement by one owner or less than all owners, then that owner or those owners have the right of contribution over and against the other owners of said Lots I through 4,except, there is no right of contribution by one whose acts or omissions (including acts or omissions of their guests, tenants, representatives or invitees)gave rise to the obligation_ E. The City shall have the right at all times to enter the described easement area for the purpose of inspections and maintaining the property, including but not limited to inspecting, maintaining, improving, repairing, constructing, reconstructing, locating, and relocating any utility lines or curb, gutter or sidewalk improvements. The City shall provide notice of 24 hours for all scheduled work except in the case of emergency. b. Any costs associated with inspection, maintenance, improvement,repair, construction, reconstructing, and improvements upon the property undertaken by the City shall be borne by the City. C. Structures and/or permanent storage within the above-described easement, or any use of or within the easement that interferes in the City's judgment with the City's use of the easement, are prohibited. d. In connection with any inspection, maintenance, improvement,repair, or construction or reconstruction, the City shall restore the property(easement and any immediately adjacent area)to rough grading conditions,but is not responsible for any restoration or repair of landscaping, vegetation or any improvements within the easement. e. Any damage to the easement or improvements in the easement caused by a lot owner or their guests,tenants, representatives or invitees shall be repaired at the sole cost and expense of said owner. F. VIOLATIONS&REMEDIES 33. Zoning Code Violation— Applies Only to City Enforcement of Paragraphs under Sections C, D, and E above. A violation of the terms of Paragraphs under Sections C, D, and E of this Declaration is a violation of the zoning code of the City of Port Townsend, and the City may take code enforcement for a violation or threatened violation of this Declaration in the same manner and with all the rights available to the City under its zoning code. 34. Enforcement Rights—Applies to City for City Enforcement of Paragraphs under Sections C, D, and E above, and to Owner(s) for Enforcement of Paragraphs under Sections B &C above. City's and/or Owner(s) remedies at law for any violation of the terms of this Declaration are inadequate and City and/or Owner(s)shall be entitled, including specific performance of the terms of this Declaration,without the necessity of proving either actual damages or the inadequacy of otherwise available legal remedies. City's remedies described in this Section shall be cumulative and shalt be in addition to all remedies now or hereafter existing at law or in equity. Specifically, nothing herein affects in any way the authority of the City to enforce City codes and regulations. The prevailing party in any judicial proceedings initiated to enforce the terms of this Declaration, shall be entitled to reasonable expenses, including attorney's fees, as determined by the Court. 36.
