DURING CONSTRUCTION 10. If earth disturbance occurs in drier months, water shall be applied as a dust suppressant_ I L All construction contracts shall specify that all diesel, gasoline and air-powered equipment must be in good operating condition, including but not limited to, approved air emission reduction equipment_ All construction equipment shall be required to have mufflers and vehicle idling shall be minimized. 12. Hours of construction within city rights-of-way shall be limited to between 7 a-m. and 6 p.m_ Monday through Friday, and prohibited on weekends and national holidays_ Under special circumstances, and if requested in advance, the DSD Director may grant exceptions to these construction hour limits. Future construction of individual homes is not subject to the above time limitations. 13_ Consistent with the City's Engineering Design Standards, standard construction practices shall be employed to minimize the risk of environmental health hazards including explosion and the release of hazardous materials. In addition, standard construction and traffic control measures shall be employed to minimize the risk of accidents. 14. To mitigate potential impacts to archeological resources that may be discovered during clearing, grading, site excavation, or other construction activities at the site, work should be stopped immediately ifsuch materials are discovered and the State Historic Preservation Officer contacted immediately. Work should not resume until approval is obtained from the Development Services Department. BUILDING: 15. As building permits for each lot are sought, individual affidavits in accordance with the Tree Conservation Ordinance are required to demonstrate the required tree unit credits are being retained and/or planted_ All other plantings, including those within city right-of-way or common open spaces, must be installed or bonded for prior to final acceptance of the street improvements. 16 SEPA MDNS Plat of Wade Vaughn LUP07-013 stonnwater facilities_ The stormwater system design must also consider provisions for foundation drains_ c. To mitigate potential impacts to transportation, the applicant shall construct street improvements as shown on their submitted site plans or as modified during the Street and Utility Development review process. In general, the street standard to be installed is identified in the EDS as T-8 with the exception of the alley between Blocks 3 & 4, Columbia Park Addition. This alley may be constructed to gravel Fire Department standards, so long as road maintenance provisions via a Home Owners Association are established to ensure the gravel roadway is privately maintained. This may require establishment of a road maintenance fund in an amount acceptable to the City's DSD and Public Works Directors. As an interim measure, the applicant may provide assurance for costs associated with the future construction of required street and frontage improvements. The assurance must be irrevocable until extinguished by mutual agreement of the City and the applicant and shall ntn with the ]and. The assurance shall be in a fonn acceptable to the City Attorney. 7. Prior to clearing and/or grading for installation of all required improvements, the applicant shall submit detailed temporary erosion and sedimentation control (TESC)plan(s) that utilize Best Management Practices to ensure potential adverse impacts to earth are addressed. Said plan(s) shall indicate areas where cut and fill work will take place, shall show the locations of trees to be removed and/or retained, and shall indicate a specific location where any fill leaving the site will be taken. If left over fill or other overburden material will be left on any of the resulting lots the City may require Notice of this situation to recorded so potential purchasers are made aware. Engineering staff in the Development Services and Public Works Departments must review the TESC plan(s) for compliance with the City's Engineering Design Standards and the applicant must adhere to the approved TESC plan during construction. Temporary erosion and sediment control measures shall be installed as specified by the approved plans before beginning clearing and grading activities and shall be maintained until the Public Works Department deems them unnecessary. 8. The number and location of all street lighting installed shall be minimized, as shown and ultimately determined during the subsequent Street and Utility Development pen-nit process. The most likely location for street lighting is at intersections (Le. Eddy& Discovery; but others may be necessary). Such lighting shall conform to the City's EDS, including use of high pressure sodium vapor lighting and lighting shields to control "light pollution." All street light installation including wiring, conduit, and power coruiections shall be located underground_ 9. To mitigate potential impacts to the environment due to the failure of required infrastructure improvements during the first 2 years of their use, the applicant shall propose a scheme that guarantees assurance in a form that is acceptable to the City. This means posting of a IS SEPA NIDNS Plat of Wade Vaughn LU-P07-013 diseased buffer plantings shall be replanted at the applicant or Home Owner Association's expense under the supervision of a wetlands consultant, and for each amnual instance of observed buffer replanting failure, monitoring shall continue for an additional year. 4. Prior to issuance of a Street and Utility Development permit for the project, the applicant shall submit to DSD for review and approval a final Tree Conservation & Street Landscaping plan. During and after street landscaping installation, modifications to the approved final plan can be processed administratively by the DSD Department. A scheme to provide temporary irrigation and long term water to the trees shall be prepared for the review and approval by DSD. The applicant shall provide a 3-year guarantee for all street tree plantings. Trees that die or become diseased within the guarantee period shall be replaced and shall initiate a subsequent 3-year period starting on the date of replacement. 5. All exterior building mounted lights shall be hooded or shielded, flat lenses and pointed downward. The use of mercury vapor or halogen lighting on the exterior of any structure is prohibited- Revisions to the exterior lighting on any resulting dwelling may be required if the DSD Director determines that installed lighting fails to meet the above performance standards. These lighting restrictions shall be placed into the Restrictive Covenant and/or CC&R's to ensure notice is provided to potential purchasers. TRANSPORTATION, STORMWATER AND UTILITY RELATED MITIGATIONS b. To mitigate transportation impacts to the City's streets and to ensure compliance with City Engineering Design Standards and City codes related to site layout, frontage requirements, and utility service, the following plans must be prepared and submitted with a completed application for a Street and Utility Development Permit for work proposed in City rights-of- way. a_ Engineered plans for water service and sewer service for the project including provisions for any necessary fire flow improvements and/or hydrant(s). The Fire Department must establish fire flow requirements for the project_ It is the applicant's responsibility to meet those requirements if the existing system is inadequate. The applicant is required to reserve a 20-foot wide utility and non-motorized easement along the north line of proposed Lot 13 and to extend the high zone water line to the Eddy Street right-of-way_ -= b. A final engineered stormwater drainage plan with supporting calculations that incorporate Low Impact Development (LID) techniques and complying with the Department of Ecology's Stormwater Management Manual and the City's Engineering Design Standards for treatment, detention and conveyance_ These plans must be submitted to Development Services for review and approval prior to commencement of any work in the rights-of-way- The stormwater plan must also consider runoff from individual buildings and these impervious areas must be included in the sizing of the 14 to 40 SEPA MDNS Plat of Wade Vaughn LUP07-013 easement across the northeastern most lot (shown as Lot 13). The easement will be shown on the face of the final plat alteration. The resulting Lot 13 will need to be sized wider than the R- I1 zone minimum to ensure it remains buildable once the easement is established. Unless extended by other parties prior to final plat alteration approval, the applicant shall be responsible for extending the high zone main line to the Eddy Street right-of-way lying east of the subject property. REQUIRED MITIGATION MEASURES FOR Preliminary Plat Alteration of Wade Vaughn FILE NO. 07-013 June 20, 2007 The environmental review indicates a probability of significant adverse environmental impacts from the proposal, which can be mitigated. The following measures are intended to mitigate adverse environmental impacts disclosed during SEPA review_ If these recommendations are agreed upon by the proponent, issuance of a Mitigated Determination of Non-Significance (MDNS) is appropriate. All required improvements as set forth below and any additional requirements established as part of the Preliminary Plat Alteration approval must be installed or bonded for prior to final approval. 1_ Prior to scheduling the open-record public hearing, the applicant shall utilize a qualified wetlands consultant and licensed surveyor to determine whether the gravel roadway planned for 16th Street will encroach into wetland and/or wetland buffer. If any encroachment would occur, the applicant shall have a wetland consultant prepare a mitigation plan for wetland buffer reduction and landscaping. 2.
