In consideration of the City granting a Street and Utility Development permit under PTMC Titles 12 and 13 and waiving the requirement to bring the infrastructure deficiencies identified under paragraph 2, above, up to full standards at the time of development per PTMC 12.04.140 (N) and EDS Chapter 6, Section 6.c, the Grantors desire to voluntarily enter into this Agreement with the City not to protest the formation of a Local Improvement District (LID) or Utilities Local Improvement District (ULID) to construct the regional gravity sewer improvements per city standards as described in this Agreement, and further agree to join in any proposed petition for such LID or ULID for the purposes specifically set forth below. Waiver of right to protest. In accordance with PTMC Titles 12 and 13 and RCW 35.43.180 and 35.43.182, the Grantors for themselves, Grantors' heirs, personal representatives, successors and assigns agree not to protest the establishment of such LID or ULID for the public improvements for the.area and serving the Grantors' property, whether proposed by petition or by resolution of the City Council of Port Townsend, or by both such petition and resolution. Pursuant to RCW 35.43.182, this waiver shall not constitute a waiver of any right of the Grantors, Grantors' heirs, personal representatives, successors or assigns, to object to the Grantors' individual assessment (including the determination of special benefits allocable to the property), or to appeal to the Superior Court the decision of the City Council affirming the final assessment role. 6. Advice of counsel. The parties acknowledge that this Agreement is intended to waive Grantors' rights to protest formation of an LID or ULID as set forth in RCW 35.43.180, pursuant to and in compliance with RCW 35.43.182. The parties warrant and represent to each other that they have had representation by legal counsel and/or have had the opportunity to be represented by legal counsel during the negotiation of this Agreement. 7. Power of Attorney, to execute petition. Grantors agree that if Grantors, Grantors' heirs, personal representatives, successors or assigns refuse to join in a proposed petition for such LID or ULID after five (5) calendar days written notice from the City, the Public Works Director shall have the right, power and authority to sign the petition for and on behalf of the Grantors, Grantors' heirs, personal representatives, successors and assigns as it pertains to the property, and Grantors hereby designate and appoint the City's Public Works Director as their attorney-in-fact for such purposes and with such powers and authority. The power shall be deemed to be coupled with an interest and therefore irrevocable throughout the term of this Agreement. 8. Representatives - Notices. For purposes of administration of this Agreement, the representative of the City and the Grantors are set forth below. Any notice shall be delivered personally or may be mailed by certified mail, return receipt requested to the other party. These are a response to having the service bays heated rather than semi-heated. Included are three copies of the revised sheets, revised energy code compliance forms, and a memorandum outlining the revisions. All the drawing sheets contain an original signature. The second roll is three copies of a new sheet M1 outlining the HVAC systems, again all with original signature. Included are three copies of the energy code compliance forms and a mechanical permit application. The application needs the WA contractor license number and City business license number for Pacific Environmental Services. Although sheet 1.01 has the location of the propane tank indicated, there are some more details about the propane system I do not have. Tom Carroll will be able to obtain these details. I calculated a total fee due of $225.50. You might clarify when this is to be paid.
