be revised to meet the standard. Methods to reduce impervious surface may include reducing the building

Pursuant to Subsection 19.05.040(E)( I )(h), the applicant shall:

and the 15 -foot setback from the wetland buffer. Install construction fencing along the approved wetland buffer
edge.
ii. Install erosion control measures in accordance with approved building permit plans.
iii. Schedule a preconstruction meeting at the development site. The meeting is to be attended by the applicant (or
applicant's agent) and city planning staff, to review specific project details and methods of construction. Field
markings and erosion control measures shall be verified by staff.

1. Construction shall be completed in strict conformance to the site plan dated May 6. 2009 (Exhibit *), conditions
of this permit and of any other city approvals obtained for the project (e.g., building permit, street development
permit).
2. The DSD Director may approve minor modifications to the approved plans provided they conform to the analysis
and conclusions provided herein. If the plan is significantly modified and/or contingency plans are required, the
revised plans shall require an Addendum to the Critical Areas permit which shall be distributed to parties of record.
3. To minimize the impact to the buffers habitat functions, exterior lighting shall be of low wattage. shielded and
directed to prevent illumination of the wetland buffer. Metal halide lights shall be prohibited. If motion sensors are
used, they shall be set so as not to activate due to movement within the wetland buffer.

10. The applicant or his/her designee shall be responsible for maintenance of the site, including maintenance of field

management practices shall be implemented as necessary to control runoff/sedimentation from the site.
11. The approved 100 -foot buffer shall not be disturbed. No construction activity may take place in the buffer. All
construction debris shall be properly disposed of in such a manner that it cannot enter into the wetland/approved
wetland buffer or cause water quality degradation.
12. Pursuant to the Engineering Design Standards, the applicant shall stabilize soils upon completion of
construction activities.
50. Per the CAO permit conditions 13-14: PRIOR TO ISSUANCE OF OCCUPANCY PERMIT/FINAL INSPECTION
13. The applicant shall install permanent fencing and signage along the buffer edge. The fence shall be unobtrusive
with an open design, such as split -rail fencing (i.e., no solid fencing which would inhibit water or wildlife
movement). Signs shall be provided by the city and installed by the applicant.
14. An occupancy permit/final inspection shall only be granted upon a finding by the DSD Director that the buffer
has not been disturbed.- temporary fencing and erosion control devices have been removed and permanent fencing
and signage has been erected.

4. The law requires complete disclosure of all
work that has been done on your home, if you
resell. You may be required to do work over
again that has been done without permits, or
inspections. Non -disclosure can lead to civil
action being taken against you.
5. You may be placing yourself and your family in
a life-threatening situation, especially when hir-
ing unlicensed people to install plumbing, elec-
trical wiring, heating systems or wood stoves.
6. Suppliers can place a lien on your home for
non-payment of materials by your contractor.
7. Unpaid workers can place a lien on your
property.
8. When problems arise, your only recourse is a
lengthy and costly civil action — if there are
any assets of value to attach, and if you can
find the contractor.
Contractors are required to carry at least
$20,000 in property damage insurance coverage
and $100,000 in bodily injury or death insurance.
You are encouraged to verify the contractor's
insurance coverage with his or her agent, as the
department's records may not reflect current
coverage.

While the property itself is not mapped as an Environmentally Sensitive Area (ESA) according to the
City's ESA map, property to the west across Rosecrans Street is mapped as the North Deering Wetland.
File records are available in the DSD office.
Because wetlands change over time, and the wetland rating system used by the Department of Ecology
has changed since the wetland was delineated in 1999, prior to developments of lots 3 and 4 a "Level 1
Wetland Assessment " is required. This is a letter prepared by a wetland expert that assesses the
wetland edge and indicates if future development would be in a wetland buffer. If so, further study
including wetland delineation would be required and depending on the findings, a critical area permit may

SUMMARY OF APPLICATION AND DECISION
Date: June 24, 2009
Application: Jacqueline Jackson requests approval of a Critical Areas permit to
construct a single-family residence and associated infrastructure in
proximity to a Category II wetland. A wetland delineation has been
prepared by Vaughn Everitt of Wiltermood Associates, Inc. documenting
a Category II wetland located off-site with a 100 -foot buffer that crosses
the southwesterly corner of the Jackson property (May 2009). According
to the wetland report the proposed residence will be located beyond the
100 -foot buffer and will maintain a 15 -foot setback from the buffer edge.
The applicant has requested a waiver from the requirement to develop
Rosecrans Street and to loop water lines in order to avoid wetland buffer
impacts.

After respectful consideration of the above referenced application, the Port Townsend Director
of Development Services hereby adopts the following Findings, Conclusions and Decision.
Findings of Fact
Project Description.
On May 12, 2009, the property owner, Jacqueline Jackson, submitted application for a
Critical Area Permit to construct a single-family residence on a parcel partially
encumbered by a buffer of a Category II wetland. Ms. Jackson has also submitted

application for a building permit (BLD09-041), street development permit (SDP09-007),
and a waiver from the street and utility standards (WVR09-003).
2. The subject property is located at 3002 Rosecrans Street, legally described as Lots 3 and
4, Block 7 of the Monogram Addition to the City of Port Townsend; Assessor's Parcel
Number 972600702. The site is bordered by undeveloped Rosecrans Street on the west
and undeveloped 30th Street on the south (Exhibit A. Vicinity Map).
Lots 3 and 4 are 10,000 square feet in size. Residential development at this density
within a wetland and/or it buffer is considered a high intensity land use requiring a 100 -
foot buffer from a Category II wetland (Section 19.05.110 Port Townsend Municipal
Code (PTMC).
4. Consistent with the requirements of Section 19.05.030 PTMC, a critical area permit is
required. Each request for Critical Areas permit is considered a Type II application,
Administrative with notice, under Port Townsend Municipal Code (PTMC, Chapter
20.01).
Special Study: Wiltermood Associates, Inc. prepared a wetland report dated July 29,
2008 indentifying the presence of the North Deering Wetland within roughly 100 -feet of
the Jackson property. The original report did not include a scaled graphic depicting the
wetland buffer as it relates to the proposed development. City staff requested an
addendum to the report. The addendum, dated May 6, 2009, indicates that the 100 -foot
buffer encumbers the southwesterly property corner including the intersection of
Rosecrans and 30th Streets. The proposed building footprint would retain a minimum 15 -
foot setback from the 100 -foot buffer. Buffer fencing is recommended to protect the
functions and values of the wetland.
6. NOA & Comment Letters: Notice of application was issued on May 26, 2009 pursuant
to Chapter 20.01 of the Port Townsend Municipal Code. No comments were received.
7. Applicable Critical Areas Policies and Standards: The Performance Standards for
Development and other applicable standards from the Critical Areas Ordinance are listed
below in bold text. The plain text that follows is the explanation of how the proposed
project is consistent with those standards.
Section 19.05.060 Performance Standards for Development: (These standards are general
development practices to minimize problems related to water quality, stormwater and erosion
control, and the. placement and construction of development in the city's critical areas).
Al. Avoiding Impacts to Critical Areas. To minimize impacts to the wetland, the applicant
proposes to maintain the required 100 -foot buffer and minimum 15 -foot setback. To avoid
wetland buffer impacts, the applicant has requested a waiver from the street and utility standards
(WVR09-003), specifically the requirement to develop Rosecrans Street and to loop utilities in

30`h and Rosecrans. The City has granted the request.
D1. Minimum Lot Area 9,900 square feet — Lots 3 and 4 are each 5,000 square feet in size
and thus, meet the minimum lot area.
D2. Construction -Preferred Practices — A driveway access is proposed via undeveloped
Rosecrans Street, the least environmentally sensitive location feasible.
D4. Site Coverage — Impervious Surface Limits for Lots — The site plan proposes roughly
32.5% impervious surface, where the standard allows a maximum of 30%. The site plan
must be revised to meet the standard. Methods to reduce impervious surface may include
reducing the building footprint, reducing the driveway area, or using pervious pavers in
lieu of asphalt/concrete.
D5. Stormwater and Erosion Control. The conceptual stormwater plan (Exhibit F) dated
March 5, 2009, shows infiltration trenches partially within the wetland buffer. The plan
has been conceptually approved by the city's stormwater engineer; however, the
infiltration trenches will need to be relocated beyond the 100 -foot wetland buffer. The
final revised stormwater management plan must comply with the city engineering design
standards manual and the 2005 Department of Ecology Stormwater Management Manual
for Western Washington (SWMM-WW (2005)).
As conditioned, the proposal will incorporate best management practices to control
surface runoff during construction.
D6. Alterations and Disturbance — The site construction plan proposes to maintain a 100 -
foot buffer and 15 -foot setback in accordance with the Critical Areas Ordinance. A
waiver has been requested to avoid extending infrastructure through the wetland buffer.
Section 19.05.110 D. Performance Standards for Development
D1, D3. Activities within Wetlands/Wetland Buffers - The site construction plan proposes to
maintain a 100 -foot buffer and 15 -foot setback in accordance with the Critical Areas
Ordinance.
Section 19.05.110 E. Buffers and Setbacks.
For residential development at greater than 1 dwelling unit per acre, the standard buffer
for a Category II wetland is 100 -feet. Building shall be setback from the edge of the
buffer no less than 15 -feet.

Conclusions
•
The project requires a critical area permit pursuant to Section 19.05.030 PTMC.
2. The proposal is consistent with the Critical Areas performance standards contained in
Chapter 19.05 PTMC; specifically, sections 19.05.060 Performance Standards for
Development and section 19.05.110, Wetlands. A qualified wetland consultant has
demonstrated that the proposal meets the buffers and setbacks set forth in Section
19.05.110E.
Conditions have been applied to ensure consistency with all laws and ordinances of the city
of Port Townsend, including but not limited to the policies and performance standards for
Critical Areas contained in Chapter 19.05 PTMC and Chapter 5, Clearing, Grading and
Erosion Control of the Engineering Design Standards Manual which requires
implementation of BMPs to control erosion and sedimentation.
4. The proposed project would not have a detrimental effect on the public health, safety or
welfare.
Decision
Based on the foregoing Findings and Conclusions, LUP09-033, the Director hereby
APPROVES the requested critical areas permit maintaining a 100 -foot wetland buffer and
minimum 15 -foot setback from the buffer edge subject to compliance with the following
CONDITION:
GENERAL
1. Construction shall be completed in strict conformance to the site plan dated May 6, 2009
(Exhibit *), conditions of this permit and of any other city approvals obtained for the
project (e.g., building permit, street development permit).
The DSD Director may approve minor modifications to the approved plans provided they
conform to the analysis and conclusions provided herein. If the plan is significantly
modified and/or contingency plans are required, the revised plans shall require an
Addendum to the Critical Areas permit which shall be distributed to parties of record.
3. To minimize the impact to the buffers habitat functions, exterior lighting shall be of low
wattage, shielded and directed to prevent illumination of the wetland buffer. Metal halide
lights shall be prohibited. If motion sensors are used, they shall be set so as not to
activate due to movement within the wetland buffer.

PRIOR TO ISSUANCE OF A BUILDING PERMIT
Approval of the critical areas permit is conditioned on a maximum of 30% impervious
surface on Lots 3 and 4, Block 7 of the Monogram Addition. The existing site plan
proposes roughly 32.5% impervious surface. It must be revised to meet the standard.
Methods to reduce impervious surface may include reducing the building footprint,
reducing the driveway area, or using pervious pavers in lieu of asphalt/concrete.
This approval is contingent upon the applicant's submittal and city approval of a
stormwater management plan that complies with the city engineering design standards
manual and the 2005 Department of Ecology Stormwater Management Manual for
Western Washington (SWMM-WW (2005)). Surface water discharge from the site shall
not be greater than historic or predevelopment rates. Infiltration trenches must be
relocated to be outside the 100 -foot wetland buffer. The applicant is encouraged to
incorporate Low Impact Development strategies (e.g., a rain garden).
6. The following legal documents prepared in a form approved by the city attorney and
approved by the director shall be recorded by the applicant with the Jefferson County
auditor (Section 19.05.050(H -I) of the PTMC):
a. Hold Harmless Agreement - This agreement shall hold harmless and
indemnify the city and its employees from and against any liability for
damages to persons or property as the result of construction or other action
undertaken by the applicant on the subject property. The Hold Harmless
agreement shall cross-reference the Notice to Title, which documents the
presence of a critical area.
b. Notice to Title - Pursuant to Section 19.05.050(I) of the Critical Areas
Ordinance, presence of a critical area shall be recorded with the Jefferson
County Auditor as a condition of this permit. This document shall include
language, which notifies all future property owners that future development
proposals affecting the wetland or its buffer are subject to the Critical Areas
Ordinance. Thirty -percent maximum impervious areas/site coverage limits
shall be specified per the ordinance. The notice shall apprise future
homeowners of the sensitivity of the neighboring wetland and wetland buffer
and encourage stewardship by:
i. Maintenance of the required permanent fencing and signage along the
approved buffer edge.
ii. Restricting the use of lighting, motion detectors, fencing, lighting,
pesticides and fertilizers; promoting plantings which are compatible with
the surrounding native vegetation; prohibiting invasive plantings; and
iii. The Notice shall state that the homeowner is responsible for maintaining
stormwater facilities.

PRIOR TO COMMENCING DEVELOPMENT ACTIVITIES
Construction may not begin until the appeal period has expired or, if an appeal is filed,
until all review proceedings are terminated. (19.05.050F(2)).
Pursuant to Subsection 19.05.040(E)(1)(h), the applicant shall:
i. Mark the following on the site to reflect the proposed site construction
plan: the location of the building footprint and the 15 -foot setback from
the wetland buffer. Install construction fencing along the approved
wetland buffer edge.
ii. Install erosion control measures in accordance with approved building
permit plans.
iii. Schedule a preconstruction meeting at the development site. The meeting
is to be attended by the applicant (or applicant's agent) and city staff, to
review specific project details and methods of construction. Field
markings and erosion control measures shall be verified by staff.
DURING CONSTRUCTION
9. All contractors shall prominently post on-site the site -work specifications and conditions
of this permit.
10. The applicant or his/her designee shall be responsible for maintenance of the site,
including maintenance of field markings, fencing and temporary erosion control devices
as indicated on approved plans. Additional best management practices shall be
implemented as necessary to control runoff/sedimentation from the site.
11. The approved 100 -foot buffer shall not be disturbed. No construction activity may take
place in the buffer. All construction debris shall be properly disposed of in such a
manner that it cannot enter into the wetland/approved wetland buffer or cause water
quality degradation.
12. Pursuant to the Engineering Design Standards, the applicant shall stabilize soils upon
completion of construction activities.
PRIOR TO ISSUANCE OF OCCUPANCY PERMIT/FINAL INSPECTION
13. The applicant shall install permanent fencing and signage along the buffer edge. The
fence shall be unobtrusive with an open design, such as split -rail fencing (i.e., no solid
fencing which would inhibit water or wildlife movement). Signs shall be provided by the
city and installed by the applicant.
14. An occupancy permit/final inspection shall only be granted upon a finding by the DSD
Director that the buffer has not been disturbed; temporary fencing and erosion control
devices have been removed and permanent fencing and signage has been erected.

Suspension — Revocation. In addition to enforcement procedures and penalties provided for in
Chapter 1.20 PTMC, the director may suspend or revoke a permit if (s)he finds that the applicant
or permittee has not complied with any or all of the conditions or limitations set forth in
accordance with this chapter, has exceeded the scope of work set forth in the permit, or has failed
to undertake the project in the manner set forth in the approved application.
Expiration. Pursuant to Section 19.05.050B9(2-3) this permit shall be valid until May 6, 2012
(i.e., three years from the date the wetland delineation was verified by Wiltermood Associates,
Inc.) and shall expire at the end of that time if not acted upon. An extension may be requested by
the original permit holder or the successor in title.

Appeals
The final decision of a Type It permit application is made by the DSD director. Per PTMC Section 20.01.210,
Administrative Type II approvals subject to notice may be appealed to the Hearing Examiner in accordance with
PTMC Chapter 1.14. Appeals shall be filed with the director within 14 calendar days after the date of the notice of
the decision of the matter being appealed. The appeal fee of $200.00 is paid at the time of submittal, and an open
record public hearing is then scheduled before the Hearing Examiner. If the Hearing Examiner's decision is
appealed, Judicial Appeal to the Jefferson County superior court must be made within 21 calendar days of the date
the decision becomes final per PTMC 20.01.320.

LAND USE QUESTIONS:
The goal of the land use portion of this permit is to provide basic information regarding your property, to guide you
to the appropriate sections of code you will need to comply with, and to lay out the permit requirements that are
likely applicable. City staff is unable to go to your property to evaluate conditions on your site. You should
carefully evaluate and inventory the physical conditions of your site and the changes you propose. Pay particular
attention to whether there are critical areas such as steep slopes or wetlands, shorelines, drainage issues, historic
resources, etc.
Note: In reading zoning codes always double check definitions as found in Port Townsend
Municipal Code (PTMC) Chapter 17.08. Zoning Maps may be found at http://www.cityofpt.us along
with a link to our Code on the left margin (blue circle).
1. Zoning and Code References:
The property is zoned R -II residential. The intent and purpose of the R -II zone is to accommodate "medium
density single-family dwellings".
Please see PTMC 17.16, which describes the purpose, allowed uses, and bulk and dimensional
requirements.
Per PTMC Table 17.16.030, in the R -II zone the minimum lot size for a single-family residence is 5,000
square feet, and the minimum lot width is 50 feet.
Each lot meets the minimum size and width as each lot in the Monogram Addition is platted to be 50 feet
by 100 feet. However, please see #3 below regarding minimum lot sizes should the property be confirmed
to include a Critical Area.
Maximum lot coverage is 35%. If an accessory dwelling unit were to be proposed in addition to the single-family
residence, up to 40% lot coverage is allowed.
Required setbacks are: Front: 10 feet if parking in front; For a garage: 20 feet if it has vehicle access
facing a street right-of-way, otherwise, normal setbacks apply. Side: 5 feet, or 10 feet if abutting a street
right-of-way; Rear: 10 feet.
The maximum building height allowed is 30 feet. This is the vertical distance measured from the average natural
(pre-existing) grade to the highest point of the coping of a flat roof or the deck line of a mansard roof or the
average height of the highest gable of a pitched or hipped roof (per PTMC 17.08.020).
2. State Environmental Policy Act (SEPA) PTMC 19.04. If the property is developed with buildings less
than 4,000 square feet in size and any landfill or excavation is less than 100 cubic yards, then the project is
exempt from SEPA.
The property does not exceed one acre, and so is exempt from the Clean Water Act, although on-site stormwater
must still be managed.
3. Critical Area Ordinance Permits (CAO) - PTMC 19.05. Please see PTMC 19.05 for a list of regulated
critical areas. Critical Areas include wetlands, steep slopes, seismic or geologic hazard areas, priority
wildlife habitat, sole source aquifers, and flood zones.
It is the responsibility of the property owner to confirm that no critical areas are actually on site
WETLAND:
While the property itself is not mapped as an Environmentally Sensitive Area (ESA) according to the City's ESA
map, property to the west across Rosecrans Street is mapped as the North Deering Wetland. File records are
available in the DSD office.
Because wetlands change over time, and the wetland rating system used by the Department of Ecology has
changed since the wetland was delineated in 1999, prior to development of Lots 3 and 4 a "Level 1 Wetland
Assessment" is required. This is a letter prepared by a wetland expert that assesses the wetland edge and
indicates if future development would be within a wetland buffer. If so, further study including a wetland
delineation would be required and depending on the findings, a critical area permit may be required.
Per PTMC Section 19.05.060.C.1, maximum density in a confirmed critical area would be one dwelling unit per
10,000 square feet of site area.
FLOOD: According to the Flood Insurance Rate Map Panel 7 of 11 dated March 15, 1982, the proposed building
lots are all in "Zone C - areas of minimal flooding".
4. Tree Conservation Plan Requirements - PTMC 19.06. Tree conservation plans are required for certain
development activities as listed in PTMC 19.06.100.
Any proposal to remove trees prior to the issuance of building permits is subject to a tree conservation permit.
However, tree removal associated with an approved project permit (which includes building permits) is exempt
from a tree conservation permit. Please show on future building site plans where trees are located. and which
ones are to be removed.
5. Parking and Landscaping — PTMC 17.72.080 lists the parking requirements for various uses. Each single-
family residence must provide two on-site parking spaces, each a minimum of 9' by 19', and one extra space if an
Accessory Dwelling Unit is proposed. Proposed parking may be outside or within a garage or carport. Please
show parking locations on future building site plans.
6. PTMC Title 18. Shoreline Permits — Port Townsend Shoreline Master Program. This property is not
within 200 feet of a regulated body of water. Therefore, no shoreline permit will be required.
Lots of Record — PTMC 18.18. A Lots of Record process is required as development of this property
includes the extension of water and Rosecrans Street as described in the public works section above. The
current fee is $215.00 for two lots, and the application is available on the City website under "Forms" "Land
Use Forms". The application processing time is typically one to two weeks. It results in issuance of a
Certificate, typically two pages, which must be signed by the owner's in the presence of a notary, and then
recorded with the Jefferson County Auditor's office (those fees are not included in the $215.00).
Should the owners wish separate the two platted lots in order to sell them separately prior to development,
another land use process is "the Letter to the Assessor". The current cost is $50.00, and results in staff
writing a letter to the Jefferson County Assessor regarding land division. However, this letter does not take
the place of the Lots of Record process.
8. Permit Processes — PTMC Title 20. You may find helpful the table at 20.01.040 that will describe the
"Type" of permit and the general requirements for public notice, who makes the decision, where it may be
appealed, etc.
Lots of Record and Letter to the Assessor would be considered "Type I" projects, and do not require public
notice.
Should it be required, a Minor Critical Area permit would be a Type I project and cost $265.00, and a Major
Critical Area permit would be a Type II project (including notice) and cost $775.00.
9. Design Review — PTMC Chapter 17.46. This section does not apply to development in the R -II zone.
