Chapter 12 Minimum Safety Requirements for Cooking Equipment
12.1 Cooking Equipment.
12.1.1 Cooking equipment shall be approved based on one of the following criteria:
(1) Listings by a testing laboratory
(2) Test data acceptable to the authority having jurisdiction
12.1.2 Installation.
12.1.2.1 All listed appliances shall be installed in accordance with the terms of their listings and the
manufacturer's instructions.
12._1..2.2' Cooking appliances requiring protection shall not be moved, modified, or rearranged without
prior re-evaluation of the fire -extinguishing system by the system installer or servicing agent, unless
otherwise allowed by the design of the fire -extinguishing system.
12.1.2.3 The fire -extinguishing system shall not require re-evaluation where the cooking appliances are
moved to perform maintenance and cleaning provided the appliances are returned to approved design
location prior to cooking operations, and any disconnected fire -extinguishing system nozzles attached
to the appliances are reconnected in accordance with the manufacturer's listed design manual.
12.1.2.3.1 An approved method shall be provided that will ensure that the appliance is returned to an
approved design location.
12.1.2.4 All deep -fat fryers shall be installed with at least a 406 mm (16 in.) space between the fryer
and surface flames from adjacent cooking equipment.
12.1.2.E Where a steel or tempered glass baffle plate is installed at a minimum 203 mm (8 in.) in
height between the fryer and surface flames of the adjacent appliance, the requirement for a 406 mm
(16 in.) space shall not apply.
12.1.2.5.1 If the fryer and the surface flames are at different horizontal planes, the minimum height of
203 mm (8 in.) shall be measured from the higher of the two.
12.2 Operating Controls.
Deep -fat fryers shall be equipped with a separate high -limit control in addition to the adjustable
operating control (thermostat) to shut off fuel or energy when the fat temperature reaches 246'C (475°
F) at 25.4 mm (1 in.) below the surface.

The ANSUL AUTOMAN Regulated Mechanical Release
Assembly (3.0 gallon - Part No. 79290 or 1.5 gallon - Part
No. 79291) contains the regulated release mechanism , agent
tank, expellant gas hose for agent tank hookup and enclosure
knockouts to facilitate installing actuation piping; expellant
Piping; detection system; and additional equipment. This regu-
lated release assernbly is used in single, double, and multiple -
tank systems and must be mounted to a rigid surface- The
release mechanism can be used to interconnect botH-,,the actu-
ation and expellant gas lines as required per system design. The
regulator is designed to allow a constant flow of gasi into the
tank at 100 psi (690 kPa) when the system is actuat d.

In single, double, and multiple
lant gas hose connects the agent tank to the bottonY outlet of
the regulator. In double and multiple -tank system configurations,
the back outlet of the regulator is used as an expellant gas feed
for one additional tank -enclosure or tank -bracket hookup. The
enclosure contains the required knockouts to facilitate this con-
nection. If a pressure switch is to be attached to the regulator,
additional fittings are required.
The tank is mounted within the enclosurd. The tank contains
an adaptor/tube assembly with a burst disc union. The burst disc
helps prevent siphoning of the agent up the pipe due to signifi-
cant temperature fluctuations in the. area where the tank is
located. The tank is mild steel and, under normal conditions,
requires hydrostatic testing every twelve years.
The agent tank is shipped uncharged and must be filled with
1.53 gallons (5.8 L) or 3.06 gallons (11.6 L) of only ANSULEX
I_ow PH Liquid Fire Suppressant during installation.
The detection and additional equipment required per system
design are connected to the release mechanism. The enclosure
contains knockouts to facilitate detection and additional hookups.
The system can be actuated automatically or manually. Auto-
matic actuation Occurs when a fusible link within the detection
Systesystern separates in a fire condition. Manual actuation of the
m occurs when personnel pull on the remote manual pull

The OEM Release/Bracket Assembly, Part No. 79493, contains
the same regulated release mechanism as the standard ANSUL
AUTOMAN Regulated Release Assembly. This release/bracket
assembly can be installed in the fire cabinet horizontally or ver-
tically. II contains all the necessary mounting and conduit holes
needed to fully Install the assembly. The agent tank is installed
separately and need not be bracketed once it is piped and filled.

GAS CARTRIDGES
In Single -Tank System arrangements, the 1.5 gallon regulated
release assembly requires an LT -20-R nitrogen cartridge (Part
No. 7032) or a 101-10 carbon dioxide cartridge (Part No. 15850)
and the 3.0 gallon regulated release assembly requires an
LT -30-R nitrogen cartridge (Part No. 5373) or a 101-20 carbon
dioxide cartridge (Part No. 17492) to properly expel the contents
of a single tank.
In Double -Tank System arrangements (two 3.0 gallon tanks or
one 3.0 gallon tank and one 1.5 gallon` tank), the regulated
release assembly requires a "double -tank" nitrogen cartridge
(Part No. 73022) or a 101-30 carbon dioxide cartridge (Part No.
15851) to properly expel the contents of two tanks simul-
taneously.
In Double -Tank System arrangements (two 1.5 gallon tanks), the
regulated release assembly requires a LT -30-R nitrogen cartridge
(Part No. 5373) or a 101-20 carbon dioxide cartridge (Part No.
17492) to properly expel the contents of two tanks simul-
taneously.
P. In manifolded system arrangements (two 3.0 gallon tanks), if
using
enclosure, the regulated release requires a "double tank"
nitrogen cartridge, (Part No. 73022). If using a 3.0 gallon regu-
lated actuator and a 3.0 gallon lank enclosure, the regulated

depending on the size of tanks, number of tanks, and arrange.

STAINLESS STEEL CABLE
The 1/16 in. stainless steel cable is run from the terminal
detector, through conduit; all series detectors and pulley elbows,
and into the regulated release mechanism trip lever. When any
fusible link separates, the tension on the cable is relaxed, and
the trip lever actuates the regulated release mechanism. The
cable can also be used for mechanical gas valves and remote
manual pull stations. The cable is available in 50 ft. (15 m) (Part
No. 15821) and 500 ft. (152.4 m) (Part No. 79653) lengths.
REMOTE MANUAL PULL STATION
The remote manual pull station (Part No. 4835, Part No. 54011.
or Part No. 415255) is required for manual actuation of the regu-
lated release assembly. The remote manual pull station should
be mounted at a point of egress and positioned at a height deter-
mined by the authority having jurisdiction.

The electrical gas valves are designed to shut off the flow of
either natural or LP gas to the appliances upon actuation of the
regulated release assembly. The valves are available in sizes
of 3/4 in., 1 in., 1 1/2 in., 2 in., and.3 in._ The valve is held open
by an energized solenoid and upon system actuation, the switch
contacts in the regulated release assembly open, thus de -
energizing the circuit to the gas valve solenoid, causing the valve
to close. Valves are available in 120 VAC and are UL Listed,

DETECTORS
The detector consists of three basic components: the bracket,
linkage, and fusible link. (Fusible links are not included and must
be ordered separately.) The bracket holds the entire assembly
to the mounting surface. The linkage is used to support the
fusible link. The fusible link is designed to separate at a specific
temperature and release the wire rope, thereby actuating the
regulated release mechanism.
There are three styles of detectors available: the clip -on style,
the hinged style, and ;he scissor style.
The clip -on style allows the wire rope to be strung completely
through the detection system conduit and brackets first and (tie
detector linkage assemblies are then clipped on later.
The hinged style detector requires the wire rope to be strung
to the detector bracket, and then "threaded" through the linkage
assembly before continuing to the next detector bracket.
The scissor style allows the wire rope to be strung completely
through the detection system conduit and brackets first and the
detector linkage assemblies are then clipped on later.
Each style of detector consists of two types of assemblies:
The Terminal Detector (Part No. 56838, 15375, or 417368) .
includes a test link and is placed last in a series of detectors.
This detector is sometimes referred to as the end -of -line detector
and is thus named because it is at the point at which the wire
rope "terminates," or is anchored at the detector bracket. Only
one terminal detector is required per detection system.
The Series Detector (Part No. 56837, 15373, or 417369) is
any detector located in-line between the regulated release
assembly and the terminal detector.
When using Part No. 56837 and 56838 style detectors, a total
of 12 detectors can be in one detection system: 11 series
detectors, Part No. 56837 and 1 terminal detector, Part No.
56838.
When using Part No. 15373 and 15375 style detectors, a total
of 5 detectors can be in one detection system: 4 series detectors,
Part No. 15373 and 1 terminal detector, Part No. 15375.
When using Part No. 417368 and 417369 style detectors, a total
of 15 detectors can be in one detection system: 14series
detectors, Part No. 417369 and 1 terminal detector, Part No.
417368.

METAL BLOW -OFF CAP
Two types of metal blow -off caps are available as options to the
standard rubber caps. The metal cap can be used in unusually
high heat conditions, generally over 400° F (204- C) The metal
blow -off cap is attached to the nozzle by means of a stainless
steel wire which prevents it from falling into the appliance durin

The conduit offset assembly, Part No. 79825, is used to change
direction of the wire rope on detection, mechanical gas valve,
and remote pull station lines. The conduit offset assembly can
only be used in the area where the conduit attaches to the regu-
lated release assembly. When using the conduit offset assembly,
the maximum number of pulley elbows is still allowed.

Chain Broiler Protection
The R-102 system uses two 1N Nozzles (Part No. 419335) for
chain broiler protection. The nozzle tip is stamped 1N, indicating
that this is a one -flow nozzle and must be counted as one flow
number (total of two flow numbers for each chain broiler being pro-
tected).
Two 1N nozzles are always needed for chain broiler protection
when the hazard area to be protected does not meet the
"Overhead Broiler Protection" requirements. The maximum inter-
nal size of the broiler is 43 x 31 in. (109 cm x 79 cm). The nozzles
must be positioned at each end of the enclosed cooking chamber
1 to 3 in. (2.5 to 7,5 cm) above the surface of the chain and a max-
imum distance of 4 in. (10 cm) away from the broiler opening. The
nozzles may be mounted at either corner as long as they are at
opposite ends of the chain broiler and positioned to discharge
► diagonally across the top of the chain. See Figures 45 and 46.

Overhead Chain Broiler Protection
The R-102 system uses two 1W Nozzles (Part No. 419336) for
overhead chain broiler protection. The nozzle tip is stamped with
1W, indicating that this is a one -flow nozzle and must be counted
as one flow number.
Overhead protection is only available for chain broilers with
exhaust opening dimensions that are not less than 60% of the
internal broiler length and not less than 60% of the internal broiler
width, to a minimum size of 12 in. x 12 in. (30.5 x 30.5 cm). Internal
broiler size can not be larger than 32 in. x 34 in. (81 x 86 cm).
When overhead protection is used, the nozzles must be centered
above the exhaust opening within 4 to 8 in. (10 to 20 cm) of each
other and they must be located 10 to 26 in. (25 to 66 cm) above
► the top of the broiler surface. See Figure 47.

Plenum Protection

VERTICAL PROTECTION - GENERAL
. One 1W nozzle or 1 100 nozzle will protect 4 linear feet (1.2 m) of
plenum. The maximum distance from the end of the hood to the
first and last nozzle must be no more than 2 ft. (-6 m). After the first
nozzle, any additional nozzles must be positioned at a maximum
of 4 ft. (1.2 m) apart down the entire length of the plenum. The
. plenum width must not exceed 4 ft. (1.2 m). (The IW or 1100 noz-
zle can be used on single or V -bank filter arrangements.) See

General Piping Requirements
1. All R-102 system piping is straight line. Therefore, the need for critical lengths and balancing is minimized.
2. Two 45' elbows count as one 90° elbow.
3. Each branch line includes the tee or elbow leading to it, and all fittings within the branch line itself.
4. The minimum piping length of Schedule 40, 3/8 in. pipe from the tank outlet to any nozzle protecting a range, fryer, or wok must be

5. Pipe lengths are measured from center of fitting to center of fitting.
6. All distribution piping must be Schedule 40 black iron, chromeplated, or stainless steel. Do not use hot dipped galvanized pipe on
the distribution piping.
7. All threaded connections located in and above the protected area must be sealed with pipe tape.Tape should be applied to male
threads only. Make certain tape does not extend over the end of the thread, as this could cause possible blockage of the agent
distribution.

This consulting fire code inspector is in receipt of the set of revised plans for the above -referenced
proposal from your office.
The original plan submittals did not include plans and specifications for the commercial kitchen hood and
exhaust and [roof] termination, and excluded the hood wall/ceiling protection, and spacing specifications.
Also, the submittal did not include make-up air calculations
The revised proposal was reviewed with the International Fire Code [I.F.C.] and International Mechanical
Code [I.M.C.], 2006 Editions, and NFPA 96, 2008 Edition.
The following constitutes this plans examiner's findings and determinations based upon the plans of
record submitted.
1. The hood system is to be listed to Underwriter's Lab Specification 300.
2. The specifications for wall and ceiling protection meet NFPA 96, Section 4.2.3.2.
3. The location of make-up air, and the make-up air -to -exhaust fan ratio is found to be 95% and meets
I.M.C. Section 508.1 requirements, and NFPA 96, Figure 7.8.3 setback requirements.
4. The make-up air input location in the kitchen meets the I.M.C. Section 508.1 "Exception 2"
requirements for make-up air temperature.
5. Duct protection at the wall penetration shall meet or exceed the requirements of NFPA 96, Sections
4.5 and 7.2.
6. The exhaust duct termination meets the NFPA 96, Section 7.8.3 requirements.
7. The existing window adjacent to the exhaust fan termination shall not be operable, in order to meet
NFPA 96, Figure 7.8.3 setback provisions from openings.
Any other applicable or relevant sections of said Code not covered herein shall nonetheless apply to this
proposal.

It is the recommendation of this consulting Fire Code Inspector that the proposed permit be granted
subject to the aforesaid requirements of the International Fire Code, International Mechanical Code, and

This consulting fire code inspector is in receipt of the set of plans for the above -referenced proposal from
your office.
The proposal was reviewed with the International Fire Code [I.F.C.]„ International Mechanical Code,
2006 Editions, ANSI Z2].69/CSA 6.16 for gas piping, and NFPA 96 et al. The following constitutes this
plans examiner's findings and determinations based upon the plans of record submitted.
Formal plans for the automatic suppression system for the commercial kitchen hood, including hood
design, and make-up air, and hood exhaust, were not included, and are a required submittal prior to any
permit approval.
Findings & Determinations:
1. The proposal is a remodel of an existing Group B business occupancy to a Group A-3 restaurant
occupancy. This proposal contains a provision for Type I commercial kitchen appliances. I.F.C. Section
904.11 requires that an approved fire suppression system (i.e. sprinklers) shall be provided for the
protection of commercial -type food heat -processing equipment.
2. Plan submittals did not include plans and specifications for the commercial kitchen hood and exhaust
and [roof] termination, and excluded the hood wall/ceiling protection, and spacing specifications. Also,
the submittal did not include make-up air calculations. The preceding items are to be submittals provided
prior tonal permit approval.
NFPA 96 and I.F.C. Section 609 and 904.11 require that an approved fire suppression system (i.e.
sprinklers) be provided for the protection of commercial -type food heat -processing equipment. The
deferred plan submittals are subject to the following stipulations from Code:
a. Said system shall be designed and installed to Underwriter's Lab Specification 300 including
NFPA 96 and related specifications for wall, ceiling and duct protection, exhaust hood, make-up
air, and roof termination standards. International Mechanical Code 2006 Edition shall apply.
b. Sprinkler protection shall also be provided for the enclosed plenum space within the hood above
the filters and exhaust ducts serving Type I hoods.
c. LPG gas supply lines to the commercial cooking appliances shall be commercial grade flexible
gas connectors which comply with ANSI Z2].69/CSA 6.16 or are NSF certified.

for the installation of commercial kitchen hoods and appliances, including wall/ceiling protection,
spacing, exhaust shaft construction, grease removal devices, ducting, and vent termination above
the roof.
e. A "K -Class" wet chemical fire extinguisher is required for the kitchen facility. Should the class
fire extinguisher not contain a "B" class rating. An additional 40-B:C dry -chemical type fire
extinguisher shall be provided within the kitchen area for electrical -based fire protection.
f. Any provision of an automatic dishwashing machine[s] that produce steam shall be provided an
approved exhaust hood consistent with Code.
3. Addressing for the proposal shall be consistent with City of Port Townsend Municipal Code standard
for size, and be in a position as to be plainly visible and legible from the street or road fronting the
property. Said numbers shall contrast with their background [I.F.C. Section 505].
4. Key box access to or within the subject structure for emergency services delivery is required to be
installed at the main entry and at the northeast entry location, to contain key(s) to gain necessary access to
the structure in its entirety [I.F.C. 506]. The proponent shall contact the administrative office of East
Jefferson Fire & Rescue at [360]385-2626 to obtain the proper key -box application forms; and,
5. Access to building openings is consistent with the I.F.C. Section 504 which requires an approved
access walkway leading from fire apparatus access road(s) to exterior openings that are required by the
Fire Code or Building Code, and;
6. An automatic fire suppression system (sprinklers) is not required for the public areas under I.F.C.
Section 903.
7. An automatic fire detection alarm system is not required for this occupancy under IFC Section
907.2.1 of said Code.
8. Fire extinguisher sizing and placement shall meet or exceed IFC Section 906 and NFPA Standard 10,
which normally requires a 2-A:10-B:C minimum rated fire extinguisher at the exit(s) and a Class K fire
extinguisher and 40 -B -C dry -chemical fire extinguisher in the commercial kitchen area[s].
9. Any fire damper installation shall be inspected and tested in the presence of the building inspector
prior to compartment/area isolation and closure, and;
10. The installation of an L,PG fuel container and piping system is subject to IFC Chapter 38, and
NFPA 53.
15. During demolition and/or construction, the proposal is subject to general precautions against fire
provisions of Chapter 14of the I.F.C. and related sections, and;
Any other applicable or relevant sections of said Code not covered herein shall nonetheless apply to this
proposal.

It is the recommendation of this consulting Fire Code Inspector that the proposed permit be withheld
subject to the aforesaid requirements of the International Fire Code International Mechanical Code, and

PROPOSAL DESCRIPTION
Gary and Nancy Tocatlian, owners of T's Restaurant Inc., propose development of an upland
deck (approximately 30' x 40') and several associated site improvements to an existing historic
building located within jurisdiction of the City's Shoreline Master Program (SMP). The land
also contains a confirmed Critical Area (Seismic Hazard). The property is located on the
southeastern bank of the Point Hudson Marina within the Port Townsend National Historic
Landmark District. A majority of the proposed improvements would be located adjacent to the
building at 141 Hudson Street (the Single Attendant Quarters). The proposed centralized
garbage/recycling enclosure would be located west of the Port of Port Townsend Administrative
offices at 375 Hudson Street. The site is located in the SW '/ of Section 1, Township 30N,
Range 1 West in vacated portions of Plat of the Original Townsite of the City of Port Townsend.
The Jefferson County Assessor's Parcel number for the property is 001-013-001.

FINDINGS OF FACT, CONCLUSIONS AND DECISION OF THE
DEVELOPMENT SERVICES DIRECTOR
After respectful consideration of the above -referenced Minor Shoreline Substantial Development
and Critical Area Permit Compliance application and supporting documents, the Shoreline
Administrator and Development Services Director make the following findings of fact,
conclusions and decision.
FINDINGS OF FACT
Project Description & Background
1. The applicant, together with the owner, proposes construction that meets the definition of
Minor Substantial Development under the City's Shoreline Master Program (SMP). Said
construction would occur entirely on upland portions of property owned by the Port of Port
Townsend at Point Hudson Marina. Point Hudson contains approximately 32 acres of
uplands and tidelands dotted with numerous buildings, most of which date from the 1930's
and 1940's (Exhibit A - Aerial of Project Area). Due to the presence of seismic hazard soils
that underlie the site; the project must also comply with the standards set forth in the City's
Critical Areas Ordinance (PTMC 19.05). The SMP request is consolidated with the Critical
Area review in this decision. (Exhibit B — Minor Shoreline Substantial Development
application (DARPA) and site plan of Proposed Improvements to the Single Attendant
Quarters).
2. The subject proposal chiefly involves rehabilitation of one 2.997 square foot building
(historically known as the Single Attendant's Quarters) into a restaurant with both indoor and
outdoor seating. The exterior building and other site modifications include.
• Construction of an exterior deck, approximately 1.500 square feet in size. on the
south side of the building;
• The addition of seven (7) additional parking spaces on the south side of the
proposed deck:
• Construction of new sidewalk along the east side of the building together with a
handicapped accessible entry ramp and parking space:
• Construction of a fenced exterior kitchen/service entry on the north side of the
building: and;
• Construction of enclosed garbage and recycling facility at the Port's
Administrative Offices to consolidate these needs for the joint use of all Pt.
Hudson tenants (Exhibit C — Elevations ofGarbage/Recycling Enclosure).
3. Each Minor Shoreline Substantial Development request is considered a Type lI application
under Port Townsend Municipal Code (PTMC, Chapter 20.01). DSD staff processes and
reviews each Type 11 shoreline request and prepares a recommendation for consideration by
the City's Shoreline Administrator, who renders a final decision. Appeals of the Shoreline
Administrators decision are heard by the City's Hearing Examiner.

4. The following additional permits/approvals are required: City of Port Townsend: Historic
Design Review, Building Permit, and Sign Permit.
Shoreline Master Program and Zoning
S. The project site lies within the Point Hudson Marina District environmental designation
(Point Hudson District) of the City's Shoreline Master Program (SMP). It also lies within a
sub district of the Point Hudson District referred to in the SMP as Point Hudson East.
6. The purpose of the overall Point Hudson District is to provide a variety of water -oriented and
other limited uses appropriate to a traditional small scale marina; together with marine trades,
artisan and general public use. This SMP designation promotes adaptive reuse of the existing
buildings at Point Hudson and a mix of water -dependant and water -related uses that are
compatible with the district's historic character. It also encourages historic preservation of
the Point Hudson buildings; emphasizes increased public access to the shoreline and
fostering ecological restoration of the eastern point. A mix of water -oriented uses with other
limited activities that promote adaptive reuse are accommodated at Point Hudson so long as
they are compatible with the historic, marine -related character of the area.
7. In the Point Hudson East Sub district, water -oriented uses and a limited number of non -water
oriented uses (the latter includes a number of visitor serving uses) that are compatible with
the historic character of the buildings have successfully evolved in this sub district. Limited
new development and adaptive reuse of existing buildings is allowed within the Point
Hudson East Sub district to encourage public access and open space and to facilitate the
revitalization and rehabilitation of existing buildings.
8. Pursuant to PTMC Title l 7.22, the underlying zoning for all of Point Hudson is M-11 (B) —
Point Hudson Marina. The M -1I (B) zone accommodates a variety of marine -related uses,
but at smaller scale appropriate to Point Hudson. The district promotes mixed use projects
which incorporate water -oriented uses, consistent with the historic, marine -related character
of the area. Within certain eligible buildings, including the Single Attendant Quarters, a
limited range of non -water -oriented uses are allowed as a means to promote adaptive reuse of
the original Point Hudson Station buildings. The site also lies within the Port Townsend
Historic Overlay District, which encompasses a National Historic Landmark recognized by
the U.S. National Park Service.
Public Notice. SEPA and Critical Area review
8. Initial public notice of the project was provided pursuant to Chapter 20.01 PTMC, including
a 30 -day Notice of Application comment period. Said Notice was published in the local
newspaper, mailed to neighbors within 300 feet of the site, and posted at the site on March
11. 2009 (Exhibit D — Notice of Application). The comment period ended April 10, 2009 and
no written comments were received.
9. The project was found to be categorically exempt from review under the State Environmental
Policy Act (SEPA) as minor new construction.

10. According to the City's critical areas maps, the site is within a mapped seismic hazard area.
Pursuant to RCW36.70A.480:
As of the date the department of ecology approves a local government's shoreline master
program adopted under- applicable shoreline guidelines, the protection of critical areas
as defined by RCW 36.760A.030 (5) within shorelines of the state shall be accomplished
only through the local government's shoreline master program and shall not be subject
to the procedural and substantive requirements of this chapter, except as provided in
subsection (6) of this section.
The city's Shoreline Master Program, prepared in accordance with the applicable shoreline
guidelines, was approved by the department of ecology on February 14, 2007. Pursuant to
Section 6.1 of the SMP, the development is subject to provisions of the Port Townsend
Critical Areas Ordinance (Ord. 2929). Analysis of the project's compliance with the critical
areas standards has been included herein. A separate critical areas permit is not required.
The DSD Director finds that the performance standards for development within a seismic
hazard critical area will be met by the project through application of the building code.
Shoreline Master Program Policies and Performance Standards
11. 'The following sections of the Port Townsend Shoreline Master Program (SMP) were
reviewed as part of the requested use:

12. Project consistency with the above SMP sections. including all applicable management
principals; policies and development regulations, are provided in the Findings below. The
reviewed principals, policies and development regulations are listed in italics, with a DSD
analysis following in regular text
13. Shoreline areas designated Point Hudson Marina District:
"encompasses Port and private properties that are occupied by the Point Hudson
marina and associated uses including marine trades, maritime educational use,
visitor -serving commercial, recreational and moorage. (SMP Chapter 5.13)
14. The applicable Management Principals; Policies and Development Regulations of related to
Point Hudson are as follows:
Management Principles: Development and rehabilitation of existing buildings
should be based on the folloiving principles,

1. Allow incremental, evolutionary changes to existing buildings and shoreline
uses, starting with current use patterns.
Policies
Policy 5.13.4 Limit the size and total square footage of restaurants in order to protect
Point Hudson's small-scale character and emphasize marine -trades as the priority
uses in this district.
Policy 5.13.11 Public view corridors in Point Hudson identified in Appendix B should
be protected and enhanced through appropriate design (e.g., modulation of
building heights and massing).
Policy 5.13.12 Keep on-site parking small scale and consistent with the provisions of
PTMC Chapter 17.72 for property within the National Register Historic Overlay
District and ADA requirements. Locate parking to efficiently serve multiple uses.
Provide convenient pedestrian access from more distant parking areas. Nelt- or
enlarged parking areas should be located outside of shoreline jurisdiction. Parking
,for festivals and events should be discouraged in the unimproved shoreline areas of
Point Hudson. Encourage transportation, parking, and pedestrian systenrs to be
coordinated with a comprehensive downtola,n system of parking and transit services.
Policy 5.13.13 Retain the small-scale character of Point Hudson.
Policy 5.13.14 Recognize Point Hudson is a unique site within the Pacific Northwest
and is the marine gateway into downtown Port Townsend for many transient visitors
arriving by boat, and provides access to dolt%ntown for a variety of tenants, visitors
and residents.
Police 5.13.15 Work in collaboration tt:ith the Port of Port Townsend to help keep
Point Hudson financially self supporting.
Policy 5.13.17 Continue to coordinate long-term planning with the historic
commercial downtown, particularly in the areas of parking, pedestrian circulation,
visitor access (transient moorage), and achieving a broad spectrum of hater -oriented
uses, activities, and attractions.
Development Regulations
DR -5.13.2 Except as otherwise provided, the total area of all restaurants shall be
limited to 11, 000 gross square feet in the Point Hudson District. Any single
restaurant shall be limited to a maximum of 3,500 gross square feet (excluding
decks).
DR -5.13.9 New development/redevelopment shall be compatible with the scale, bulk,
materials and design of the Point Hudson Station Buildings.
DR -5.13.10 New development, including construction and establishment of uses,
shall make provisions for public access consistent with this Master Program.

DR -5.13.13 New development shall strive to maintain/enhance key public views
including the vied- eashvard from the end of Water Street, views across and along the
boat basin, and eastward fi-om Jefferson Street.
DR -5.13.14 Neiv development shall provide and/or enhance public access
commensurate'. ivith constitutional and statutory limitations and the degree of intensity
and/or impact of the project. Possible pedestrian access amenities include the
development of a pedestrian walkway around the boat basin, improved pedestrian
connections between buildings and the boat basin, pedestrian connections to adjacent
properties and the "water►valk" trail. See Port Comprehensive Scheme of Harbor
Improvements Update, 2003, and the preferred Alternative Ill (pages III SS -57.)
DR -5.13.15 Retain historic character of existing buildings. The Secretary of the
Interior's Guidelines for Rehabilitation of Historic Structures shall be used.for
modifications proposed to buildings that exceed 50 years in age or otherwise qualify
for historic status. Additional design guidelines are contained in PTMC 17.30.140
Historic overlav district — Design Standards and 17.30.150 Water front sub district —
Additional design standards.
DR -5.13.16 No structure shall be erected, or altered, itn any area defined in this
section to a height in excess of the limits established in the Special Height Overlay
District as codified in Chapter 17.28 PTMC (Appendix Q. The height limit shall not
apply to cupolas, water tanks, flagpoles, transmission lines, and radio and television
towers and other similar structures.
DR -5.13.20 Specific landscape plans shall seek to provide an attractive vegetative
relief and screening while avoiding unnecessary blockage of views and solar access.
DR -5.13.21 Limitations on Use — All marnufactttring/industrial/connmercial uses must
comply with the Noise, Light and Glare, Fire & Safety Hazards, Interferences or
17.22.020 P7MC.
DSD Analysis: Significant portions of the proposal epitomize the stated SMP goal of
rehabilitation of existing buildings at Point Hudson through "incremental; evolutionary
changes." Public view corridors as identified in Appendix B of the SMP are not impacted
by the proposed deck, the front entry improvements, kitchen service area enclosure, or
garbage/recycling enclosure. The new concrete sidewalk on the east side of the building
enhances public access at Point Hudson. Height limits referenced in the SMP are also met
by the proposal.
The addition of this 2,997 square foot restaurant will not exceed the overall SMP cap on
restaurant square footage (11,000 square feet) or the size limits for an individual restaurant
(3,500 square feet, excluding decks). Compliance with these size limits helps to maintain
the small-scale character of Point Hudson. The new water -enjoyment use of the building is
compatible with Point Hudson's unique position as the "marine gatewayinto downtown
Pori Townsend. It also aids the Port of Port Townsend in keeping Point Hudson financially

self-supporting. The proposed exterior changes, including the garbage/recycling enclosure,
have undergone Historic District Design Review to ensure appropriate materials, colors,
lighting and signage are used (Exhibit E — HPC Certificates of Review).
One area where the project is not consistent with the Policies and Development Regulations
of Point Hudson involves the additional parking proposed. Seven (7) new parking spaces on
the south side of the new deck would be established, with one (1) new ADA accessible
space proposed on the east facade near the front entrance. SMP Policy 5.13.12 directs
projects to "keep on-site parking small in scale" and locate them "efficiently to serve
multiple uses." New or enlarged parking areas are to be located outside of shoreline
jurisdiction. While existing parking at Point Hudson is not assigned, there are
approximately 20 existing spaces lying immediately east of the building and along the
marina basin. Another row of 8-10 spaces lie east of the building on the other side of
Hudson Street. This parking along the east side of Hudson Street continues northward to
near its intersection with Jackson Street. Consistent with SMP Policy 5.13.17, parking at
Point Hudson needs to be addressed in a coordinated, long-term fashion that includes
measures that address the remainder of historic downtown. Other than the proposed ADA
parking space proposed near the east entrance, the proposed parking should not be approved
at this time. Subject to certain conditions, the project is consistent with the above
Management Principals, Policies and Development Regulations.
15. Environmental Protection under the SMP sets forth:
"... policies and regulations that protect the shoreline environment
as well as the critical areas, found within the shoreline jurisdiction.
These policies and regulations apply to all uses, developments and
activities that may occur ia-ithin the shoreline jurisdiction regardless
of the Shoreline Master Program environment designation. They are
to be implemented in conjunction with the specific use and activity
policies and regulations found in this Master- Program. " (SMP Chapter 6.1)
16. Chapter 6 first presents General Environmental Policies and Regulations including analysis
of impacts, mitigation, bonding, and monitoring. Second, policies and regulations protecting
the broad elements that comprise the shoreline environment (e.g., earth, air, and water) are
provided. Finally, policies and regulations for the specific type of "critical area" are
presented, which at this site are limited to geologically hazardous areas (seismic soils).
17. The SMP overall Management Policies and Development Regulations of Chapter 6
applicable to the proposal include:
Management Policies
Policy 6.3.1 Protect the environment through implementation of this Master -
Program in concert with the City's Critical Areas Ordinance and through the use of
the AMRRC mitigation sequence (Avoid, Minimize, Rectify, Reduce,
Compensate)(WAC 173-26-201(e)).

Policy 6.3.2 Minimize the adverse impacts ofshoreline developments and activities
on the natural environment during all phases of development (e.g., design,
construction, operation, and management).
Policy 6.3.3 Assure, at a minimum, that development and use within the shoreline's
jurisdiction result in no net loss of ecological functions necessaty to sustain shoreline
natural resources. Development activities shall protect existing ecological functions
and ecosystem wide processes.
Development Regulations
General
DR -6.3.1 All shoreline development and activity shall be located, designed,
constructed, and managed in a manner that avoids, minimizes and/or mitigates
adverse impacts to the environment. The preferred mitigation sequence (avoid,
minimize, rectify, reduce, or compensate for the environmental impact) shall.follow
that listed in WAC 173-26-0201((2)(e), see also definition of "Mitigation, " listed in
this Master Program).
DR -6.3.2 In approving shoreline developments, the City of Port 1 oia-nsend shall
ensure that shoreline development, use, and/or activities will result in no net loss of
ecological functions necessary to sustain shoreline resources. including loss that may
result fr-onr the curnulalive impacts of similar developments over time to the extent
consistent with constitutional and statutory• limitations on the regulation of private
property. To this end, the City may require modifications to the site plan and/or
adjust or prescribe project dimensions, intensity of use, and screening as deemed
appropriate. If impacts cannot be avoided through design moth f cations, the City
shall require mitigation commensurate with the project's adverse impacts.
DSD Analysis: Parking at Point Hudson is not tied to a centralized stormwater system.
The proposed seven additional parking spaces should not be installed at this time. The
remaining areas being developed as part of the project involve previously altered upland
areas adjacent to and in between existing buildings that contain lawn. Conditions that
ensure Best Management Practices (BMP's) are utilized during construction are
necessary and can be imposed through both the shoreline permit and building permit.
The overall shoreline environment will suffer no adverse impact as a result of the
proposed project. No additional environmental mitigation or bonding is necessary or
required.
18. Geologically hazardous areas are areas susceptible to severe erosion: slide activity, or
other geologic events. In the Port Townsend shoreline, high marine bluffs are the most
visible type of geologically hazardous area, although seismic, tsunami and erosion
hazards have also been mapped. The subject site contains soils mapped as being
seismically hazardous. The applicable SMP Policies and Development Regulations of
Chapter 8 that relate specifically to geologically hazardous areas include:

Management Policies
Policy 6.8.1 Ensure that new development or the creation of new lots does not cause
any foreseeable risk from geological conditions to people or improvements during the
life of the development.
DSD Analysis: As noted previously (Finding 10, above), assurance that the new
development does not cause any foreseeable risk due to the seismic soils on site will be
met through compliance with the building code.
19. Advertising and Signage is defined in the SMP as follows:
"Outdoor advertising and signs include publicly displayed messages
on signs, billboards, placards, or buildings that direct attention to promotion
of a business, service, or product, or. for public notice, transportation,
or direction.
Outdoor advertising is regulated by the Port Townsend sign code
(e.g., billboards and off -premise signs, except for sandwich boards in
the doi,-ntown Historic district, are prohibited everywhere in the City.
Also prohibited are dashing, roofiop and moving signs). "
(SMP Chapter 8.2)
22. Applicable policies and development regulations related to Advertising and Signage are as
follows:
Policies
Policy 8.2.1 Ensure that signage iviihin the shoreline jurisdiction complies with the
City `s Sign regulations codified in Chapter 17 of the Port Tolvrnsend Municipal Code.
Policy 8.2.2 Ensure that signs are compatible ivith the shoreline environment and
adjacent land and water uses through appropriate design and placement.
Policy 8.2.3 Ai oid degradation of vistas and victiipoints and ensure visual access to
the water from such vistas by appropriately locating signs.
Development Regulations
DR -8.2.1 Outdoor advertising and signs shall be in conformance with the City ofPort
Toivnsend sign regulations codified in Chapter 17 of the Port Townsend Municipal
Code.
DR -8.2.2 Delineated vistas (Appendix B) or viewpoints shall be kept free of
advertisement signs.
DR -8.2.5 Artificial lighting.for signs shall be directed or beamed away from the
water, public streets, or adjacent premises so as to not cause glare reflection that may
constitute a traffic or boating hazard or nuisance.

DR -8.2.6 Flashing and blinking signs are not permitted on the shoreline area_
No sign or part thereofshall consist of banners, posters, streamers, spinners, or other
similar moving devices.
DSD Analysis: Signage proposed by the new development consists of two wall mounted
signs (on the south and west facades) and one monument sign (located west of the building
near the main entrance). The design and location of the proposed signs have been reviewed
and approved through the City's Historic Overlay Design Review process (PTMC 17.30),
which included conditions to ensure sign lighting is shielded and pointing downward. They
also comply with size and location requirements of the City's overall sign regulations
(PTMC 17.76). None of the proposed signs would interfere with viewpoints identified by
the SMP in Appendix B and no portion of the signs contain flashing, blinking or moving
parts (including banners; posters, streamers or spinners). Subject to conditions; the project
is consistent with the above Policies and Development Regulations.
20. Commercial Development is defined in the SMP as follows:
"... those uses and facilities that are involved in wholesale or retail trade or business
activities. Examples include but are not limited to hotels, motels, grocery stores,
restaurants, shops, offices, and indoor recreation facilities....
(SMP Chapter 8.6)
21. Applicable policies and development regulations related to Commercial Development are as
follows:
Policies
Policy 8.6.1 Gil -e priority to those commercial developments that are dependent on
shoreline locations or that allow, a substantial number of people to actively or
passively enjoy the shoreline.
Policy 8.6.3 Design commercial uses in a manner- that provides physical and visual
access to the water.
Development Regulations
DR -8.6.2 Commercial development shall be subject to the design review provisions of
the Port Townsend Zoning code (Title 17 PTMC).
DR -8.6.3 All commercial development/redevelopment requiring a Substantial
Development or Conditional Use Permit within shoreline jurisdiction shall provide
for public visual and physical access to the shoreline in accordance with Chapter 7,
Public Access, taking into consideration constitutional and statutory• limitations. Such
provisions could be the preservation of shoreline views, the establishment ofpublic
access easements across and to the shoreline, enhancement of an adjacent street -end
or park or other consideration commensurate with the degree of impact caused by the
development.

DSD Analysis: The proposed deck improvements will provide restaurant patrons with an
attractive outdoor eating environment unlike any other at Point Hudson. Physical access to
the waters around Point Hudson will be unchanged while visual access for patrons will be
enhanced. Design Review for the deck and the other proposed improvements was performed
and approved through recommendations of the City's Historic Preservation Committee
(HPC). The property owner, Port of Port Townsend, has provided significant public access
improvements in the vicinity of the current proposal. No additional public access is
warranted.
23. Parking, as described in the SMP, includes:
"..the use of land for storage of motor vehicles, motorized equipment,
or accessory units, such as trailers. Land used for this purpose is
leveled, cleared, and often covered with an impermeable surface.
Parking includes areas.for scenic vista parking. " (SMP Chapter 8.11)
24. The applicable Policies and Development Regulations of Section 8.11 are as follows:
Policies:
Policy 8.11.1 Minimize parking in shoreline areas.
Policy 8.11.2 Design and place parking facilities as far as practicable fr-onr the
water's edge.
Policy 8.11.3 Ensure that parking facilities are adequate to serve the level of demand
anticipated by the associated use.
Policy 8.11.4 Minimize impacts from parking facilities in shoreline areas including
those related to stornnvater r tnroff, hater- quality, visual qualities, public access, and
vegetation and habitat maintenance, through appropriate location and design
Development Regulations
Parking for specific land use activities within the City of Port Townsend is subject to
the requirements and standards set forth in the Port TMrnsend Zoning Code, in
addition to the regulations of this section.
DR -8.11.1 Parking in shoreline areas must directly serve an approved shoreline use.
DR -8.11.3 Parking facilities lwaterward of the ordinary high water mark are
prohibited, provided that they may be allowed on over -water structures through the
conditional use process when they are a component of a publicly operated ferry
terminal.
DR -8.11.4 Parking shall comply with the follotiving design standards as applicable
(e.g., items a, b, e and f ivould not apply to over -water ferry terminal parking):
a. Parking shall be located on the landward side of the development unless
contained within a permitted structure.

b. Where there is no existing structure, parking shall extend no closer to the
shoreline than a permitted structure.
c. The design and construction of parking facilities shall assure that surface
water runoff will not pollute adjacent waters or cause soil or beach erosion. Oil
separators and retention ponds are considered positive measures towards
compliance with this standard. Alternatives to conventional storm water
treatment, such as use of pervious materials, shall be considered in order to
minimize impacts due to runoff and the need for storm water treatment_
DSD Analysis: As noted in the analysis done for Point Hudson Policies, the additional
parking proposed for this development is not consistent with the SMP at this time. No fewer
than twenty (20) parking spaces exist immediately adjacent to the building with another eight
to ten (8-10) spaces located within 30 feet of the main restaurant entrance. No on-site
stormwater system for treatment for parking area runoff exists at Point Hudson and no
localized means of addressing the proposed parking expansion has been proposed. Overall
parking at Point Hudson needs to be addressed in a coordinated, long-term fashion and
include measures that involve the remainder of historic downtown. To assist in a coordinated
effort, the underlying property owner (the Port) must sign and record a No Protest Agreement
to the formation of a Parking and Business Improvement District (PBID). Other than the
proposed ADA parking space proposed near the east entrance, the proposed parking cannot
be approved at this time. A condition that provides parking for two bicycles (one inverted
"U" shaped rack) shall be included in the decision. The design and location for the rack shall
be reviewed and approved by DSD prior to installation. Installation of the bicycle rack shall
occur, or be bonded for, prior to occupancy.
CONCLUSIONS
1. A Shoreline Substantial Development permit is required under the Shoreline Management
Act (SMA) whenever substantial development is undertaken in an area covered by the Act.
RCW 90.58. l 40(2). In general, the Act covers water areas and the strip of land, which is 200
feet inland from the ordinary high water mark. RCW 90.58.030(2) (d) (f).
2. The proposal meets the definition of a Minor Shoreline Substantial Development under the
Port Townsend Shoreline Master Program (SMP) and is thus processed as a Type 11 permit,
(i.e., Administrative with notice, appealable by any aggrieved party to the hearing examiner).
The improvements requested by the applicant meet the definition of water -enjoyment
commercial Development under the Port Townsend Shoreline Master Program. The use is
listed as a permitted activity in the SMP's Point Hudson East sub -district.
3. The principal means for implementing the broad policies of the SMA is through local
Shoreline Master Programs. The Port Townsend Shoreline Master Program (SMP) has been
approved by the State Department of Ecology to this end. See RCW 90.58.050, 090, 100. A
Substantial Development Permit may not be issued unless the proposal is consistent with the
approved Master Program and with the SMA's policies. RCW 90.58.140(2).

4. Subject to certain conditions that relate to the proposed additional parking, the development
is consistent with the goals, policies and standards of the Port Townsend Shoreline Master
Program, implementing the Shoreline Management Act (RCW 90.58). Subject to certain
conditions, the proposal is consistent with policies of the Point Hudson district shoreline
designations of the Port Townsend. Water -enjoyment uses are identified as permitted uses in
adopted City Plans, including the SMP.
The proposal is consistent with WAC 173-27-140 (2) regarding height of structures within
shorelines of the state_ The proposal would not block the view of any residences.
6. Subject to adherence to the conditions contained herein, the proposal will result in no net loss
of ecological functions necessary to sustain shoreline resources.
7. The project is exempt from review under the State Environmental Policy Act (SEPA). In
regards to critical areas, the performance standards for development within a seismic hazard
critical area will be met by the project through application of the building code.
S. The development is not detrimental to the public health, safety and welfare. The proposal
will provide ADA access to a previously inaccessible historic building.
9. The proposal is consistent with the goals and policies of the City's Comprehensive Plan and
meets the requirements and intent of the city's development code including those that relate
to protection of critical areas.
DECISION
Based on the foregoing Findings of Facts and Conclusions, the Development Services Director
/Shoreline Administrator hereby GRANTS the requested Minor Shoreline Substantial
Development Permit and Critical Area Compliance (LUP09-01 1), subject to the following
conditions:
GENERAL
1. Construction shall be completed in strict conformance to the plans contained within the
submitted plans, except where modified by this decision (see 2 below). Conditions of
any other city approvals obtained for the project (Historic District Design Review, sign
pennit, building pen -nit) must also be complied with during construction and continue
once the restaurant use is in operation.
The proposed parking area south of the exterior deck is not approved with this
application. This condition does not preclude establishment of parking at this location, or
other locations within Point Hudson, in the future so long as stormwater management is
provided in compliance with applicable regulations. Parking for a minimum of two
bicycles (one inverted "U" shaped rack) shall be provided. The rack design and location
shall be reviewed and approved by DSD prior to installation. Installation of the bicycle
rack shall occur, or be bonded for, prior to occupancy.

3. Noise generated from the project, particularly the restaurant deck, shall be subject to the
limitations set forth in the City's noise regulations at PTMC 9.08.
PRIOR TO COMMENCING DEVELOPMENT ACTIVITIES
4. Erosion control measures shall be installed by the applicant in accordance with approved
building permit plans and inspected by Development Services Department (DSD) prior to
clearing and grading.
DURING CONSTRUCTION
The applicant or his/her designee shall be responsible for maintenance of the site,
including maintenance of fencing and temporary erosion control devices as indicated on
approved plans. Additional best management practices shall be implemented as
necessary to control runoff/sedimentation from the site. All construction debris shall be
properly disposed of on land in such a manner that it cannot enter into the waterway or
cause water quality degradation to state waters.
PRIOR TO ISSUANCE OF OCCUPANCY PERMIT
6. The attached No Protest Agreement to the formation of a Parking and Business
Improvement District shall be signed by the underlying property owner (Port of Port
Townsend) recorded by the applicant or owner with the Jefferson County Auditor:
7. Occupancy permit(s) shall only be granted upon a finding by the DSD Director that the
approved improvements have been installed in conformance with this permit and all other
City approved pen -nits (including but not limited to Historic District Design Review).
PERMIT REVSIONS
8. If substantive changes to the design, terms, or conditions of this approved permit are
sought; the applicant must submit a request for permit revision for review consistent with
SMP Chapter 10.18. Changes are "substantive" if they materially alter the project in a
manner that relates to its conformance to the terms and conditions of this permit, this
SMP; or the Shoreline Management Act. Changes, which the Administrator determines
are not substantive, do not require approval of a revision. Revisions may also warrant
other City approved permits (including but not limited to Historic District Design
Review).
DURATION OF PERMITS
9. Pursuant to SMP chapter 10. 17, the construction authorized under this permit is valid for
a period of five (5) years from the date of issuance. Construction, or substantial progress
toward completion, must begin with two (2) years after the date of issuance.
10. The City may, at its discretion, with prior notice to parties of record and the Department
of Ecology, extend the two-year time period for the demonstration of substantial progress
for a reasonable time, up to one year, based on factors including the inability to
expeditiously obtain other governmental permits which are required prior to the
commencement of construction.

l I . If construction has not been completed within five (5) years of approval by the City of
Port Townsend, the City will review the Permit and, upon showing of good cause, either
extend the Permit for one additional year, or terminate the Permit. Prior to the City
authorizing any Permit extensions, it shall notify any parties of record and the
Pepartmo of Ecology. Note: Only one single extension is permitted.

APPEALS
Local appeals of decisions by the Shoreline Administrator shall be filed pursuant to the
procedures and timelines of PTMC 20.01.290 - .3 10. An applicant or other party of record who
may be aggrieved by the administrative decision may appeal the decision to the hearing
examiner, provided that a written appeal in conformance with Chapter l .l4 PTNIC is filed within
14 calendar days after the notice of the decision. The date on which a decision is deemed issued
is 3 days after the City mails a written decision. The appeal period for this permit concludes at 5
p.m., May 13, 2009. Construction undertaken by this permit is done at the applicant's own risk
until the expiration of the appeals deadline.

THIS MEMORANDUM OF AGREEMENT (NO PROTEST REAL PROPERTY
COVENANT AGREEMENT) is made and executed as of this,,,4 day of

RECITALS
In association with development on Grantors property of a new exterior deck for
commercial (restaurant) seating together with other exterior improvements within the non -
residentially zoned portions of the City's National Register Historic Overlay District,
Grantors have elected to exercise their right pursuant to Port Townsend Municipal Code
(PTMC) Chapter 17.72.020.13 to be exempt from full compliance with the off-street
parking requirements of said Chapter.

2. In consideration of the City granting a development permit, the Grantors desire to
voluntarily enter into this Agreement with the City not to protest the formation of a
Parking and Business Improvement District (PBID) for funding municipal parking
facilities as described in this Agreement, and further agree to join in any proposed petition
for the PBID for the purposes specifically set forth below. Grantors agree that the public
improvements to be made in connection with any PBID will specifically benefit the
Grantors' property.
3. RCW 35.87.A authorizes cities and counties to form Parking and Business Improvement
Areas as an aid to general economic development and neighborhood revitalization. RCW
35.87.A.220 further authorizes the purposes and functions of the chapter to be
accomplished by any other method otherwise provided by law, including the use of Local
Improvement Districts (LID) as set forth in RCW 35.43. RCW 35.43.180, describes
Grantors rights to protest formation of an LID; and RCW 35.43.182 provides for waiver
of protest and limits on enforceability of such waivers. The Grantors acknowledge and
warrant that Grantors have had the opportunity to review these laws and this Agreement
with independent legal counsel of Grantors' choice.
NOW, THEREFORE, in consideration of the mutual covenants and benefits set forth in
this Agreement, the City and Grantors agree as follow:
AGREEMENT
Location of Grantors property. Port of Port Townsend held lands at Point Hudson
Marina, also knows as Tax 21 (Point Hudson) according to the Assessor's records of
Jefferson County, being a portion of the Port Townsend Original Townsite.
2. Improvements to be financed. The improvements that may be financed by the PBID
(hereinafter public improvements) include:
Municipal parking facilities, pursuant to Chapter 35.87A.RCW, including any of the
following:
(a) The acquisition, construction or maintenance of parking facilities for the
benefit of the area;
(b) Decoration of any public place in the area;
(c) Sponsorship or promotion of public events which are to take place on or in
public places in the area;
(d) Furnishing of music in any public place in the area;

Area. The area in which the Grantors property is located and for which a PBID may be
proposed or formed (hereinafter improved area) is described as follows:
Those non -residentially zoned portions of the City of Port Townsend encompassing the
area nominated to the National Register of Historic Places on April 19, 1976, and those
portions of the C -III, Historic Commercial zoning district lying outside the area
nominated to the National Register of Historic Places, the boundaries of which are more
particularly described as:
Beginning at Port Townsend Bay in a northwesterly direction co -linear
with Harrison Street and continuing to Water Street, then southwest along
Water Street to Van Buren Street, then northwest along Van Buren Street
to its intersection with the edge of the bluff, then following the bluff
toward the southwest to the vacated Scott Street right-of-way, along that
vacated right-of-way to its intersection with Jefferson Street, southwest
along Jefferson one-half block then 90 degrees to the northwest along a line
parallel to Scott Street continuing to Lawrence Street, northeast along
Lawrence to Walker Street, northwest along Walker to Blaine Street,
northeast along Blaine to Van Buren Street, southeast along Van Buren to
Garfield Street, northeast along Garfield to Harrison Street, northwest
along Harrison to Chestnut Street, north along Chestnut to F Street, east
along F to Oak Street, north along Oak to Taft Street, along Taft to a point
midblock between Adams and Quincy Street, then 90 degrees to the
northwest along a line parallel to Quincy then 90 degrees to the northeast
taking in the property at the west corner of Quincy and Taft Streets,
retuning along Quincy to Taft and continuing along Taft Street northeast to
Admiralty Inlet.
The benefit district or zone may be the entire area or a portion of the area.
4. Obligation to join petition. In accordance with PTMC Chapter 17.72, as now or later
amended, and RCW 35.43.180 and 35.43.182, the Grantors hereby obligate themselves,
Grantors heirs, personal representatives, successors and assigns to join in any valid
petition for the formation of a PBID for municipal parking improvements which may be

proposed to be established within or for the area.
5. Waiver of right to protest. In accordance with PTMC Chapter 17.72 and
RCW 35.43.180 and 35.43.182, the Grantors for themselves, Grantors heirs, personal
representatives, successors and assigns agree not to protest the establishment of such
PBID for the municipal parking improvements for the area and serving the Grantors
property, whether proposed by petition or by resolution of the City Council of Port
Townsend, or by both such petition and resolution; Provided However: Nothing in this
Agreement waives the Grantor's or successor interest's rights to object to the property
owner's individual assessment (including the determination of special benefits allocable to
the property), or to appeal to the superior court the decision of the city council affirming
the final assessment roll.
6. Advice of counsel. The parties acknowledge that this Agreement is intended to waive
Grantors rights to protest formation of a PBID as set forth in RCW 35.43.180, pursuant
to and in compliance with RCW 35.43.182. The parties warrant and represent to each
other that they have had representation by legal counsel and/or have had the opportunity
to be represented by legal counsel during the negotiation of this Agreement.
7. Power of Attorney to execute petition. Grantors agree that if Grantors, Grantors' heirs,
personal representatives, successors or assigns refuse to join in a proposed petition for
such LID after five (5) calendar days written notice from the City, the Public Works
Director shall have the right, power and authority to sign the petition for and on behalf of
the Grantors, Grantors' heirs, personal representatives, successors and assigns as it
pertains to the property, and Grantors hereby designate and appoint the City's Public
Works Director as their attorney-in-fact for such purposes and with such powers and
authority. The power shall be deemed to be coupled with an interest and therefore
irrevocable throughout the term of this Agreement.
Representatives - Notices. For purposes of administration of this Agreement, the
representative of the City and the Grantors are set forth below. Any notice shall be
delivered personally or may be mailed by certified mail, return receipt requested to the
other party. In the case of notice by mail, notice shall be deemed given on the date of
postmark of the return receipt.

9. Binding effect. This Agreement shall be binding upon the Grantors, Grantors' heirs,
personal representatives, successors and assigns.
10. Covenant to run with the land. The obligations and agreement contained in this
Agreement are acknowledged and declared to be covenants running with the above-
described land and shall be binding upon the Grantors, Grantors' heirs, personal
representatives, successors and assigns.
11. Attorney fees. In the event of any action brought to enforce the terms of this Agreement,
the prevailing party shall be entitled to recover its reasonable attorney fees, costs and
disbursements awarded by the court.
12. Recordation. Upon execution by all signatories of this Agreement, the City's
Development Services Department shall record at Grantor's expense this Agreement with
the Jefferson County Auditor's Office. A completed stamped recorded copy shall be
forwarded to the Grantors.
13. Entire Agreement. This written Agreement contains the entire agreement of the parties,
and there is no other written or oral representation or agreement between the parties,
except as contained in this Agreement. Any modification of this Agreement shall be in

Occupancy (TCO):
a) Relocate propane tank as directed with bollards (painted white);
b) Have LPG tested (including supply lines to fire pit on the deck;
c) Cover exterior light box over deck entry (or install approved light fixture);
d) Paint International ADA symbol, per code sheet provided, on ADA parking
space surface near east entry.
II. Other items (not life safety) that can be bonded for completion prior to
issuance of TCO. Estimates agreed to by applicant and DSD staff (John):
