THIS GRANT OF EASEMENT is made this 7 day of July, 1999, by THE POINTE
CORPORATION, a Washington corporation ("Grantor") for the benefit of THE CITY OF PORT
TOWNSEND, a Washington municipal corporation, and its assigns ("Grantee"), as follows:
Grantor hereby grants and conveys to Grantee the perpetual right in the nature of
an easement over, upon, across, under and through the Northerly five (5) feet in
width of the real property of Grantor identified by Jefferson County Assessor's tax
parcel number 936300705 and more specifically described as the East thirty (30)
feet of Lot 7 and all of Lot 8 in Block 7 of Broadway Addition to the City of Port
Townsend, as per plat recorded in Volume 1 of Plats, page 112, records of Jefferson
County, Washington, for the construction, installation, use, maintenance, repair, and
replacement of a sewer line and maintenance hole, including a temporary right of
use and access over and upon adjacent land of Grantor for construction purposes,
such temporary right being limited to the duration of Grantee's construction activities.
Grantee shall restore Grantor's property to its condition immediately prior to the
exercise of any rights granted hereby.
