HomeMy WebLinkAbout01-030Resolution No. 01-030 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND APPROVING AND AUTHORIZING THE SUBMITTAL OF A COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) SECTION 108 LOAN APPLICATION TO THE WASHINGTON STATE OFFICE OF TRADE & ECONOMIC DEVELOPMENT IN SUPPORT OF THE NORTHWEST MARITIME CENTER PROJECT. WHEREAS, the City Council of Port Townsend considers it in the public interest to acquire, cleanup and redevelop the Thomas Oil property for public benefit; and WHEREAS, the Economic Development Element of the City's Comprehensive Plan encourages the development of the Northwest Maritime Center (NWMC), and WHEREAS, the City Council passed resolution No. 2000-036 supporting the application to HUD for a Brownfields Economic Development Initiative (BEDI) grant and associated CDBG Section 108 loan to acquire, cleanup and redevelop the Thomas oil property; and WHEREAS, the NWMC is a qualified 501(c)(3) corporation (corporation #2-489-302-6; unified business identification #301-537-165) dedicated to the beneficial public purpose of the acquisition and cleanup ofa brownfield property on Port Townsend's shoreline (the "Thomas Oil" property); and WHEREAS, the City supports the NWMC because its success would demonstrate what can be achieved when local governments and community organizations work together on economic development initiatives; and WHEREAS, CDBG Section 108 Loan funds are available to support economic development projects for which funds will eliminate specific conditions of spot blight or physical decay detrimental to public health and safety; and WHEREAS, the Northwest Maritime Center project represents a commitment of private resources toward the revitalization of the City's National Landmark Historic District and cleanup of a brownfield property, as well as expanding the City's tax base and employment opportunities; and WHEREAS, it is necessary that certain conditions be met as part of the application requirements; and in addition to the eligibility requirements, the City and Northwest Maritime Center will be required to comply with all applicable CDBG regulations, as well as all applicable State of Washington requirements. These include among others: The Real Property Acquisition Policies Act, and Local Procurement Rules; and WHEREAS, the City of Port Townsend shall agree to comply with all applicable federal and state regulations in the event that this application is selected for funding, including federal and state regulations in regard to the environmental impact of the project; and Page 1 Resolution 01-030 WHEREAS, the City of Port Townsend will provide opportunities for citizen participation comparable to the state's requirements, and has complied with all applicable public meeting requirements; and WHEREAS, the City of Port Townsend would be the recipient of CDBG Section 108 loan funds to pass on to the NWMC to be used to refinance the acquisition of the Thomas Oil property; and WHEREAS, the CDBG loan funds will not be used for public improvements. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Port Townsend, that the City Manager is hereby authorized to sign and submit a CDBG Section 108 Loan Guarantee Program application to the State of Washington on behalf of the Northwest Maritime Center in the amount of approximately ONE MILLION DOLLARS ($1,000,000) to assist in the acquisition of the Thomas Oil property; and BE IT FURTHER RESOLVED that the City Manager is hereby authorized to provide such additional information as may be necessary to secure approval of this loan application; and BE IT FURTHER RESOLVED that the CDBG grievance procedure provided in Exhibit "A" is hereby authorized; and BE IT FURTHER RESOLVED that the City Manager is authorized to enter into an agreement with the State of Washington for the Northwest Maritime Center CDBG Section 108 Loan Guarantee Program upon review and approval of the loan documents by the City of Port Townsend City Council and City Attomey. The City also designates the City Manager as the authorized Chief Administrative Official and authorized representative to act in all official matters in connection with this application and the City of Port Townsend's participation in the Washington State CDBG Section 108 Loan Guarantee Program. Watts, City Attorney Page 2 Resolution 01-030 Exhibit "A" COMMUNITY DEVELOPMENT BLOCK GRANT GRIEVANCE PROCEDURE Submit complaints in writing to David Timmons, City Manager or his/her designated official representative for resolution. A record of the complaints and action taken will be maintained. A decision by the City Manager or his/her designated official representative will be rendered within 15 working days. If the complaint cannot be resolved to your satisfaction by the City Manager or his/her representative, the complaint will be heard by the Port Townsend City Council and discussed at an open public meeting of the elected body. A written decision will be made within 30 working days. The decision of the governing body is final. A record of action taken on each complaint will be maintained as part of the records or minutes at each level of the grievance process. Procedure to Answer Complaints. In the event that a citizen has a complaint regarding the CDBG application or program, the City of Port Townsend has implemented the following review network. A. Notice of Complaint. The City Manager will investigate the complaint and provide a written response to the person who complained within fifteen days of the day the complaint was received. A copy of the complaint and the response will be given to the Port Townsend City Council. Appeal of Complaint Resolution. If any party is aggrieved by the resolution of the complaint, the party may, within thirty days of the date the response is mailed, request a public hearing on the complaint before the Port Townsend City Council. The City Council will hold a hearing within thirty days of an appeal. Within thirty days of the hearing the City Council shall decide on the final resolution of the complaint.
