RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND GRANTING FINAL PLANNED UNIT DEVELOPMENT
AND BINDING SITE PLAN APPROVAL FOR PHASE I OF THE
TREEHOUSE CONDOMINIUM DEVELOPMENT,
APPLICATION LUP02-108
WHEREAS, Madrona Village, LLC has petitioned the City for final
approval of a Planned Unit DevelOpment (PUD) and Binding Site Plan (BSP)
covering Phase I of their residential condominium development known as
Treehouse (LUP02-108). Treehouse is located west of Fort Worden cemetery,
along W Street and Ebony Street; and
WHEREAS, the original preliminary PUD and BSP applications were
submitted on or about December 3, 2001 (LUP01-117) and involve construction
of 30 residential condominium units across 7 new lots to be created over 5
phases. The new lot configUration is achieved via the replatting of 22-existing
lots encompassing approximately 4.3-acres of the Pettygrove's 2nd Addition to
the City of Port Townsend; and
WHEREAS, Phase I of the Treehouse PUD involves the creation of 2
new lots, Lots 1 & 6. Lot 1 is 22,310 square feet in size and will be developed
with a maximum of 7 detached condominium units. Lot 6 is 10,000 square feet
in size and is the site of a future community building for use by Treehouse
residents. Lot 6 also contains an engineered stormwater pond designed and
constructed to serve the entire Treehouse development upon build-out; and
WHEREAS, the Treehouse PUD and BSP were granted preliminary
approval, subject to certain conditions, by the City's Hearing Examiner on
March 29, 2002. This March 29 decision was modified by the Examiner on
April 17, 2002, after review of a timely request for reconsideration jointly filed
by the applicant and BCD; and
WHEREAS, the Public Works Director has found the final PUD and
BSP request to be in compliance with the infrastructure improvements required
in the Hearing Examiner's decision; and
WHEREAS, the Building and Community Development (BCD) Director
has found that, with the exception of some required landscaping and replanting,
the final PUD and BSP request is in conformance with the Hearing Examiner's
preliminary PUD decision, complies with applicable environmental mitigation
measures, and includes appropriate measures for recording to title a Planned

Unit Development Agreement (PUDA) signed by both the applicant and the
City. So long as an appropriate financial security is established for the
remaining landscaping required, final PUD and BSP approval for Phase I of
Treehouse is consistent with Chapters 17.32, 18,16 and 18.24 of the PTMC;
and,
WHEREAS, the City Council has reviewed the proposal and concurs
with the Building and Community Development Director's determination;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the
City of Port Townsend, as follows:
APPROVAL is granted for Phase I of the Treehouse PUD.
Staff be directed to facilitate recording of the final Binding Site Plan with
the County Auditor.
The City Manager is authorized to sign the required PUDA on behalf of
the City once the final draft has been reviewed and approved by the City
Attorney in consultation with the Directors of Public Works and
Building and Community Development.
ADOPTED by the City Council of the City of Port Townsend at a
regular meeting thereof, held this sixth day of January, 2003.
