RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
TOWNSEND GRANTING FINAL PLANNED UNIT DEVELOPMENT (PUD)
AND BINDING SITE PLAN (BSP) APPROVAL FOR NEIGHBORHOOD OF
UMATILLA HILL PLANNED UNIT DEVELOPMENT, APPLICATION
LUP 03-030
WHEREAS, Kimball Landis, LLC has petitioned t_he City for final approval of
a full subdivision and Planned Unit Development (PUD) residential development
known as Neighborhood of Umatilla Hill (LUP01-121). The project consists of 15
single family residences on individual lots and one condominium parcel which has been
reserved for up to 10 condominium cottages and associated structures including a
common house, storage building, and tool shed. Umatilla Hill is located one block
north of Hastings Avenue, to the east of Holcomb Street; and
WHEREAS, the project involves creation of 15 single family lots and one
condominium parcel for a total of 16 new lots being created. The new lot
configuration is achieved via the replatting of 14 existing lots encompassing
approximately 3.2 acres. Ten of the existing lots are currently described as Lots 1-10,
Block 19, Hastings 3ra Addition to the City of Port Townsend; the remaining four
existing lots are described as Lots 1-4, Norma's Short Plat; and
WHEREAS, this subdivision approval vacates Norma's short plat in its
entirety, the southern 18 feet of 30~ Street right-of-way abutting Block 19, Hastings 3rd
Addition and the platted alley in .said block; and
WHEREAS, a final Binding Site Plan (BSP) must be submitted to and approved
by the City prior to issuance of building permits for the condominium parcel; and
WHEREAS, the original preliminary PUD and BSP applications were
submitted on or about February 14, 2002 (LUP01-121) and a SEPA Mitigated
Determination of Non-Significance (MDNS) was issued with conditions on
April 3, 2002, for which no appeal was filed; and
WHEREAS, the Umatilla Hill PUD and BSP were granted preliminary
approval, subject to certain conditions, by the City's Hearing Examiner on
May 4, 2002; and
WHEREAS, the Public Works Director has found the final PUD request to be
in compliance with the infrastructure improvements required in the Hearing Examiner's
decision; and

WHEREAS, infrastructure for the development includes a stormwater pond
located in the 30~h Street right-of-way. Prior to recording the final plat with the
County, the applicants and City will sign a stormwater agreement by which the City
maintains the stormwater pond in return for funds in an amount approved by the Public
Works Department for 20 year maintenance of the facility; and
WHEREAS, the Building and Community Development (BCD) Director has
found that, with the exception of items specified on a punch list prepared by Public
Works for which the applicant has provided sufficient escrow funds to cover
installation, the final PUD request is in conformance with the Hearing Examiner's
preliminary PUD decision, complies with applicable environmental mitigation
measures, and includes appropriate measures for recording to title a Planned Unit
Development Agreement (PUDA) signed by both the applicant and the City. So long
as an appropriate financial security is established for the remaining items required,
final PUD approval for Umatilla Hill is consistent with Chapters 17.32, 18.16 and
18.24 of the Port Townsend Municipal Code; and
WHEREAS, the City Council has reviewed the proposal and concurs with the
Building and Community Development Director's determination;
NOW, THEREFORE, BE IT RESOLVED, the City Council hereby
APPROVES the subdivision and PUD of Umatilla Hill and hereby directs staff to
facilitate recording of the final plat with the County Auditor. Furthermore, the City
Manager is hereby authorized to sign the required PUDA on behalf of the City once the
final draft has been reviewed and approved by the City Attorney in consultation with
the Directors of Public Works and Building and Community Development.
ADOPTED by the City Council of the City of Port Townsend at a regular
meeting thereof, held this second day of April, 2003.
