HomeMy WebLinkAbout03-022Resolution No. 03-022 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND GRANTING FINAL PLANNED UNIT DEVELOPMENT AND BINDING SITE PLAN APPROVAL FOR PHASE II OF THE TREEHOUSE CONDOMINUM DEVELOPMENT WHEREAS, Madrona Village, LLC has petitioned the City for final approval of a Planned Unit Development (PUD) and Binding Site Plan (BSP) covering Phase II of their residential condominium development known as Treehouse (LUP03-093). Treehouse is located west of Fort Worden cemetery, along W Street and Ebony Street; and WHEREAS, the original preliminary PUD and BSP applications were submitted on or about December 3, 2001 (LUP01-117) and involves construction of 30 residential condominium units across 6 new lots created over 4 phases. The new lot configuration is achieved via the re-platting of 22-existing lots encompassing 4.3-acres of the Pettygrove's 2nd Addition to the City of Port Townsend; and WHEREAS, Phase II of the Treehouse PUD involves the creation of 2 new lots, Lot 2/3 & Lot 4. Lot 2/3 is 38,068 square feet in size and will be developed with a maximum of 9 condominium units. Lot 4 is 15,438 square feet in size and will be developed with a maximum of 5 condominium units; and WHEREAS, the Treehouse PUD and BSP were granted preliminary approval, subject to certain conditions, by the City's Hearing Examiner on March 29, 2002. This March 29 decision was modified by the Examiner on April 17, 2002, after review of a timely request for reconsideration filed jointly by the applicant and BCD; and WHEREAS, the Public Works Director has accepted an appropriate financial security for roadway improvements yet to be completed within Phase II and all other related infrastructure improvements as set forth in the Hearing Examiner's decision have been complied with; and WHEREAS, the Building and Community Development (BCD) Director has found that, with the exception of some required landscaping and replanting, the final PUD and BSP request is in conformance with the Hearing Examiner's preliminary PUD decision, complies with applicable environmental mitigation measures, and includes appropriate measures for recording to title a Planned Unit Development Agreement (PUDA) signed by both the applicant and the City. So long as an appropriate financial security is established for the remaining landscaping, final PUD 1 Resolution 03-022 and BSP approval for Phase II of Treehouse is consistent with Chapters 17.32, 18.16 and 18.24 of the PTMC; and WHEREAS, the City Council has reviewed the proposal and concurs with the Building and Community Development Director's determination; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Port Townsend, as follows: 1. APPROVAL is granted for Phase II of the Treehouse PUD. Staff is directed to facilitate recording of the final Binding Site Plan with the County Auditor. The City Manager is authorized to sign the required PUDA addendum on behalf of the City after it has been reviewed and approved by the Directors of Public Works and Building and Community Development in consultation with the City Attorney.
