HomeMy WebLinkAbout03-038Resolution No. 03-038 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND GRANTING FINAL APPROVAL FOR THE PLAT OF LAUREL HEIGHTS, APPLICATION LUP 03-131 The City Council of the City of Port Townsend, Washington resolves as follows: WHEREAS, Laurel Heights, LLC has petitioned the City for final approval of their full subdivision known as the Plat of Laurel Heights (LUP03-131). The subject property is located north of Discovery Road, along the north and south sides of 21st Street; and WHEREAS, the original preliminary plat application was submitted on February 18, 2003 (LUP03-022) and requested approval for 14-new residential lots. Twelve (12) of the lots were sized to allow fourplex development, one lot was sized for duplex development, and a final lot was sized for a detached single-family residence. Overall, a total of 51 low-income housing uriits are to be constructed through the use of Low-Income Housing Tax Credits secured from the Washington State Housing Finance Commission; and, WHEREAS, the preliminary plat of Laurel Heights was granted approval, subject to certain conditions, by the City's Hearing Examiner on August 4, 2003. This decision was appealed to the City Council, who upheld the Examiner's decision and supplemented it with a series of additional conditions contained in Resolution 03-029 dated September 29, 2003; and, WHEREAS, the Public Works Director has accepted an appropriate financial security for all roadway and utility improvements required for the plat and that said security is a sufficient amount to cover all infrastructure improvements as set forth in the decisions of the Hearing Examiner and City Council; and, WHEREAS, the Building and Community Development Director has found that appropriate financial security has been provided for landscaping and that the various Covenants and Maintenance Agreements required by the Hearing Examiner and City Council decisions have been generally established. Given the above, final approval of the Plat of Laurel Heights is consistent with Chapters 18.16 of the PTMC; and, WHEREAS, the City Council has reviewed the proposal and concurs with the Building and Community Development Director's determination; 1 Resolution 03-038 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Port Townsend, that the Final Plat of Laurel Heights is hereby APPROVED, and hereby directs staff to facilitate recording of the final plat with the County Auditor, subject to all required Covenant and Maintenance Agreemem details being resolved to the satisfaction of City staff prior to recording. ADOPTED by the City Council of the City of Port Townsend at a regular meeting thereof, held this fifteenth day of December, 2003.
