HomeMy WebLinkAboutPort Townsend School District - School Resource OfficerCity of Port Townsend Port Townsend School District MEMORANDUM OF AGREEMENT SCHOOL RESOURCE OFFICER PROGRAM THIS MEMORANDUM OF AGREEMENT(MOA) is made and entered into this day of 2018, by and between the CITY OF PORT TOWNSEND, a Washington municipal corporation (the "City"), and the PORT TOWNSEND SCHOOL DISTRICT NO. 50, a Washington municipal corporation ("School District"), for purposes of establishing an on-going Police Department School Resource Officer (SRO) program. The City and School District have mutually agreed that the City will provide law enforcement and related services to the public schools of Port Townsend, Washington through the School Resource Officer (SRO) Program. AGREEMENT 1. School Resource Officer Assigned. The City shall assign one or more fully - commissioned police officers as the School Resource Officer. The City shall notify the District of the names of the assigned officer(s). 2. Administration of this Agreement. The City's Chief of Police or designee, and the District's Superintendent shall administer this MOA on behalf of the City, and provide the described personnel to the School District (general duties outlined in paragraph 3 below). 3. Assignment and Duties of SRO. 3.1. During the regular school year, the SRO shall be assigned to the School District for a minimum of 75% of the District's regular school day. The SRO may be on- or off -campus performing SRO tasks, Regular working hours may be adjusted by agreement of the parties. 32 The SRO may be temporarily reassigned by the Police Chief (or designee) during school holidays and vacations or when necessary to provide adequate police coverage. 3.3. The SRO shall assist in providing school-based security during the regular school day and assist in the promotion of a safe and orderly environment. 3.4. The SRO shall wear the official police equipment, including firearm, while on duty. The SRO may wear civilian. attire or uniform, whichever is appropriate. 3.5, The SRO shall establish and maintain collegial working relationships with the school district administration and staff. 3.6. The SRO shall conduct instructional programs approved by the Police Chief and District Staff and will seek approval before enacting any new school programs. 3.7. Upon request of the principal or faculty member, the SRO may act as a guest speaker on law-related matters. 3.8. The SRO shall become familiar with community agencies aiding students and families, and shall make referrals to such agencies upon request or when necessary. 3.9. The SRO shall assist the principals in developing plans and strategies to prevent and/or minimize dangerous or hazardous situations that may occur on campus or during school sponsored events. 3.10. The SRO shall work with the building administrator to obtain the permission of the Superintendent or designee in the event video recordings gathered by security cameras are reviewed for reasons of health, welfare, or safety of students, staff or community. 111. The SRO shall arrange time for conferences with students, parents, and faculty members to assist them with problems of a law enforcement or crime prevention nature relating to school related incidents or issues, 3,12. The SRO shall investigate crimes or other school -related incidents on campus and in the surrounding neighborhoods, making arrests when appropriate. The SRO shall adhere to the School District policy about any formal criminal investigation activities on School District property. Confidential information obtained pursuant to such investigations shall not be disclosed, except as provided by law, court order or by the criteria set forth in any juvenile justice information sharing agreement. 3.13, The SRO shall not act as a school disciplinarian. 3.14. The SRO shall not be assigned lunchroom duties, hall monitoring, or other student monitoring duties. In any area presenting a public safety risk or a high risk of criminal activity, the SRO may assist school personnel, 3.15. The SRO shall maintain an activity log, to include a description of all SRO activities such as meetings, conferences, extra -curricular events, arrests, investigations, and other activities. The SRO shall provide a monthly report based on the activity log to the police supervisor and Superintendent. 3.16. The SRO shall perform other duties as mutually agreed upon by the Superintendent and the Police Chief. 4. Removal, The District Superintendent may request to the City, in writing, that the SRO be removed from the program. Within tcn business days the Superintendent and the Chief of Police or his/her designee, to discuss the request. If the problem cannot be resolved to the satisfaction of both the Superintendent and the Chief of Police, or their designees, then the SRO will be removed from the program and the City will assign a replacement SRO. 5. Financing for the School Resource Officer Program, The District will pay up to $5000.00 per year. The parties agree to work together to identify and apply for grants for this program for professional development and support of the SRO. 6. The School Resource Officer shall remain an employee of the Port Townsend Police Department and shall not be considered an employee of the School District. The School District and the Police Chief acknowledge that the SRO shall remain responsive to the chain of command of the Port Townsend Police Department. 7. Both the School District and the City shall purchase and maintain in full force and effect during the term of this agreement a general comprehensive liability insurance policy with coverage in an amount of not less than one million dollars ($1,000,000) for any acts or omissions that occur or claims that are made during the term of the agreement. Each party will defend, indemnify, and hold harmless the other party, its officers, employees, and agents from all costs, claims, judgments or awards of damages, including attorney fees, arising out of any act or omission of the indemnifying party or its officers, agents, or employees in the performance of this agreement. 9. The establishment of this program and the execution of the MOA creates no third -party rights. 10. Each party may terminate this MOU by sending a written "Notice of Intent to Terminate" to the other party in writing 30 -days in advance of a termination date. 12. The City will take receipt of and disperse all funds related to any Grant for this position. They will also be responsible for programmatic reporting, financial reporting, information sharing, general grant management issues and responsibilities. The basis for programmatic reporting is described in Attachment "A." 13. This agreement expresses the entire agreement of the parties and may only be modified in writing. MWEGMYOMMKOM M010 David G. To form a strong partnership between the City and the District; 2. To cultivate and continually enhance communication between officers, school staff and students and; 3. To create opportunities to provide interactive law-enforcement related education. These objectives will be accomplished by: 1. Working together on school emergency response policies and procedures; 2. Participating actively in school extra -curricular events including varsity and junior varsity spoiling events, student council and social events; 3. Guest instructing in a variety of classes including health, career and current world problems, driver's education as well as playing a fundamental role in the development of a community- based drug education program. EVAIXA110N OF THE PROGRAM: 1. The parties will have a jointly -developed and -implemented emergency response policy in place, and District personnel will have participated in drills and training exercises a minimum of once per year. 2. The parties will meet at least twice per year to outline goals for the coming year and to evaluate the progress towards meeting the established goals. 3. The Port Townsend Police Department will assist in the development and establishment of a community-based youth drug and alcohol education program.
