what you intend to build, where it will be located on your lot, and how it will be constructed.

a stand-alone project. A detached, habitable structure such as an Accessory Dwelling Unit
regardless of size must also meet these requirements.

Note: the whole house fan shall be readily accessible and controlled by a}Lhovr clock timer
with the capability of continuous operation, manual and automatic control. At the time of final
inspection, the automatic control timer shall be set to operate the whole house fan for at least 8
hours aday, and have a sone rating at 1.5 or less measured at 0.10 inches water gauge.
Spot Ventilation:
Source specific exhaust ventilation is required in each kitchen, bathroom, water closet, laundry
room, indoor swimming pool, spa and other rooms where excess water vapor or cooking odor is
produced. Bathrooms, laundries or similar rooms require fans with a minimum 50 cfm ntingat
0.25 inches water gauge; kitchens shall have a fan with a minimum 100 cfrn rating at0.25 inches
water gauge.
Outdoor Air Inlets:
Outdoor air shall be distributed to each habitable room by means such as individual inlets,
separate duct systems, or a forced-air system. Habitable rooms include all bedrooms, living and
dining rooms but not kitchens, bathrooms or utility rooms. Where outdoor air supplies are
separated from exhaust points by doors, undercutting doors a minimum of %inch above the
surface of the finish floor covering, distribution ducts, installation or grilles, transoms or similar
means where permitted by the Unifbrm Building Code. When the system provides ventilation
through a dedicated opening, such as a window or through-wall vent, these openings must:
o Have controlled and secure openings
r Be sleeved or otherwise designed so as not to compromise the thermal properties of the wall or
window in which they are placed.
o Provide not less than 4 square inches of net free area of opening for each habitable space.

Dear Mr. McFadin
I visited the property in September 2005 to qualitatively evaluate the slope stability of subject
property. The purpose of the site visit was to assess the geologic stability of the site including the
criteria set forth in City of Port Townsend's Environmentally Sensitive Areas (ESA) Ordinance,
PTMC 19.05. Based on my inspection of the property and vicinity, and a review of readily
available geologic information on the site, it is my opinion that the subject property is not a
geologically hazardous area. Furthermore, development of the site will not increase the risk of
instability on other sites in the area.
GENERAL GEOLOGY
Northwestern Washington has been occupied by continental glaciers at least four times during
the Pleistocene Epoch (l .6 million to 10,000 years ago). During these glacial and accompanying
interglacial periods, the underlying bedrock was deeply eroded. The Surficial Geologic Map of
the Port Townsend 30- by 60-Minute Quadrangle, Puget Sound Region, Washington (Pessl,
Dethier, Booth and Minard, 1989) indicates that the subject property is underlain by glacial till.
Site observations on the subject property including hand dug test pits and auger holes, and
observations of slopes in the vicinity of the subject property are consistent with the above-
described mapping. The site is underlain by compact silty sand with some gravel from the surface
to a depth of at least 4 feet that I interpret to be coarse grained slightly weathered glacial till.
SPECIFIC SITE OBSERVATIONS
The subject property consists of a plainer slope with a maximum steepness of 34 percent. The
average slope on the site is approximately 20%:o. The slope is presently covered with a mix of
trees and thick brush. The property is located on a northeast-facing slope. The top of the slope is
located southwest of the subject properg and is at an elevation of approximately 200 feet. The
base of the slope is at an elevation of approximately 50 feet. The subject properfy elevation
ranges between approximately 120 feet and 80 feet. Umitilla Street bounds the southwest side of
the property. Soils underlying the site consist of silty sand with a trace to some gravel. No areas
of wet soil or seeps were present on the subject property or within test holes dug and augured to a

depth of 4 feet on the site at the time of my site visit in September 2005 and no plants that
indicate area of seasonal wet areas were observed on the site. No indications of slope instability
are present on the slope or in the vicinity of the subject property.
As per Port Townsend's Code 19.05.100 B I through 6 the following classification criteria were
evaluated to determine if the subject property is located in a geologically hazardous area.
19.05.10081: Any area containing soil or soil complexes desuibed or mappedwithin the United
States Department of Agriculture/Soil Conservation Service Soil Surveyfor Jffirson County as
having a severe to very severe erosion hazard potential.
Soils underlying the site consist of silty sand with gravel and based on test pits and site
observations are not prone to severe erosion potential.
19.05.I0082: Any area with slopes greoter than I 5 percent with impermeable soils (typically silt
and clay) frequently interbedded with granular soils (predominantly sand and gravel); and
springs or ground water seepage from perched water tables or potentially unstable slopes.
The slope on the site is plainer and is approximately 34Yo at its steepest with the overall average
slope on the order of 20%. However, no impermeable soils were noted in the test pits and auger
holes excavated to a depth of 4 feet and no seeps, springs or perched water was noted anywhere
on the slope or within the test holes. No indications of potentially unstable slopes were observed
on the site or adjoining sites on the slope. Trees on the site are straight growing and no areas of
convergent topography are present.
I9.05. I0083: Any area potentially subject to mass movement due to a combination of geologic,
topographic, hydrologic factors, but not limited to those areos mapped or described by the Soil
Conservation Service, Washington State Department of Ecologt, Department of Natural
Resources or U.S. Geologic Service. The classification may be based on performance standards
rather than mapping.
No indications of mass wasting are apparent on the subject property or vicinity. Glacial till is
typically stable due to its compact condition. The lack of perched water zones, relatively gentle
slopes, and lack of convergent topography all indicate that the site and vicinity are stable, The
Slope Stability Map of Northwestern Jefferson County (Gayer, 1976) indicates that the site and
vicinity are steep slopes believed top be stable and the slopes below and above the area are stable
gentle slopes.

The site is nor underlain by potentially liquefiable soils and compact glasial till is not typiss[y
susceptible to earthquake induced mass movement.
CONCLUSION AND RECOMMENDATIONS
The subject propcrfy is not subject to landslidrng or rapid erosion. Development of the site can be
ac"o-piishe-d wittr iypical foundation work. Roof gutters and the down spout system should
either direct water into zur approved storm water system or slrould be dispersed into the ground in
a levet spreaderplaced in such a manncr as to avoid concentating surface watet dischargc.

B. COYENANT
1. Specific Restriction and Covenant. The property described above shall constitute a single
building site, and no lot(s) nor any part thereof shall be transferred or conveyed in any manner
except together as a single building site. This restrictive covenant shall not be removed unless
the present or future Owner receives approval to do so from the City of Port Townsend by means
of a Lot Line Adjustment or other procedure as specified by the City.
2. Covenant Running with the Land. This restrictive covenant restricts the described property
and shall be construed as a covgnant running with the land.
3. Binding upon Successors and Assigns. This restrictive covenant shall bind and restrict the
land, the Owner(s), their heirs, grantees, successors and assigns.
4. Recording. Upon its execution, this Declaration shall be recorded with the Jefferson County
Auditor. All contracts and deeds or other instruments of conveyance relating to the property or
any part thereofshall contain reference to this covenant.
5. Compliance with Code Requirements. This Declaration does not modify any requirements
of the City's regulations affecting the use of land or construction of improvements upon lands.
6. Estoppel. The Owners by this Declaration specifically estop themselves and all oftheir
successors and assigns and all persons presently or hereafter having any interest in the property
from asserting or contending in any manner that this restrictive covenant is not a full and
adequate covenant running with the land and binding upon the property.
7. Severance. Invalidation of this covenant by judgment or court order shall not affect any of the
other covenants that shall remain in full force and effect.
8. Warranty of Authority. The Owner(s) signing below warrant that she is the sole Owner in
fee of the real property described above and are authorized to make this Declaration.
9. Governing Law. This RESTRICTIVE COVENANT shall be governed by state laws.
