2001 Residential Construction Checklist
Complete this form in addition to WSEC forms. Please answer the following questions:
New construction, or addition over 750 square feet
Must meet whole house and spot ventilation requirements, and show full WSEC compliance as
a stand-alone project. A detached, habitable structure such as an Accessory Dwelling Unit
regardless of size must also meet these requirements.

Note: the whole house fan shall be readily accessible and controlled by a24-how clock timer
with the capability of continuous operation, manual and automatic control. At the time of final
inspection, the automatic control timer shall be set to operate the whole house fan for at least 8
hours aday, and have a sone rating at 1.5 or less measured at 0.10 inches water gauge.
exhaust ventilation is required in each kitchen, bathroom, water closet, laundry
room, indoor swimming pool, spa and other rooms where excess water vapor or cooking odor is
produced. Bathrooms, laundries or similar rooms require fans with a minimum 50 cfm rating at
0.25 inches water gauge; kitchens shall have a fan with a minimum 100 cfin rating at0.25 inches
water gauge.
Outdoor Air Inlets:
Outdoor air shall be distributed to each habitable room by means such as individual inlets,
separate duct systems, or a forced-air system. Habitable rooms include all bedrooms, living and
dining rooms but not kitchens, bathrooms or utility rooms. Where outdoor air supplies are
separated from exhaust points by doors, undercutting doors a minimum of %inch above the
surface of the finish floor covering, distribution ducts, installation or grilles, transoms or similar
means where permitted by the Uniform Building Code. When the system provides ventilation
through a dedicated opening, such as a window or through-wall vent, these openings must:r Have controlled and secure openings
r Be sleeved or otherwise designed so as not to compromise the thermal properties of the wall or
window in which they are placed.
o Provide not less than 4 square inches of net free area of opening for each habitable space.

Pursuant to Port Townsend Municipal Code (PTMC) Titles 12 md 13, the Grantors
applied for a Street and Utility Development Permit in order to connect to the existing
street and utilities within the City right-of-way in association with the development of a
single family residence.
The Public Works Director or designee (Director) has approved development of the
property on an existing substandard street that was constructed to less than the current
minimum street standards in the City's Engineering Design Standards (Local Access
Street, Design Detail T-9)..Under the authority of PTMC 12.04.140.J and the Engineering
Design Standards, the Director may grant a waiver from construction of frontage
improvements at the time of development if they can better be constructed in the future
through an area-wide improvement district.
The current Engineering Design Standards for new residential streets require concrete
curb and gutters, paved asphalt roadway and catchbasins and enclosed piping for
stormwater control.
Per PTMC 12.04.140.N in consideration of the City agreeing to waive the requirement to
construct the street to full standards as part of the Street and Utility Development permit,
the Grantors desire to voluntarily enter into this Agreement with the City not to protest
the formation of a Local lmprovement District (LID) or Utilities Local Improvement
District (tlLID) to construct the street, sidewalk and stormwater improvements, and non-
motorized transporiation irnprovements per city standards as described in this Agreemen!
and further agree to join in aoy proposed petition for such LID or ULID for the purposes
specifically set forth below. Grantors agree that the public improvements to be made in
connection with such LID or ULID will specifically benefit the Grantors'property.
Section 35.43.180 RCW, describes Grantors'rights to protest formation of an LID or
ULID; and Section 35.43.182 RCW, provides for waiver of protest and limits on
enforceability of such waivers. The Grantors acknowledge and warrant that Grantors
have had the opportunity to review those laws and this Agreement with independent legal
counsel of Grantors' choice.

NOW, THEREFORE, in consideration of the mutual covenants and benefits set forth in
this Agreement, the City and Grantors agree as follow:
AGREEMENT
Area. The area in which the Grantors'property is located and for which an LID or ULID
may be proposed or formed (hereinafter "improved area") is described as follows:
Pettygrove's I't Addition, including M Street between Rose and Cherry Street, and Port
Townsend Drainage Basin 7 and/or other boundaries as may be determined by the City
to best implement the area-wide improvements.
Improvements to be financed. The improvements to be financed by the LID orIJLID
(hereinafter "public improvements") include the following:
Street, Drainage and Frontage Improvements, including, but not limrted to: concrete
curb and gutter and osphalt poving; sidewalks, pathways or other pedestrionfacilities;
catch basins and drainage pipe; regional systems for stormwater detention and trestment
all installed to adopted City standards at the time the improvements are made.
Obligation to join petition. [n accordance with PTMC Titles 12 and 13 as now or later
amended, and RCW 35.43.180 and 35.43.182, the Grantors hereby obligate themselves,
Grantors" heirs, personal representatives, successors and assigns to join in any valid
petition for the formation of an LID or ULID for the public improvements which may be
proposed to be established within or for the area.
Waiver of right to protest. ln accordance with PTMC Titles 12 and 13 and
RCW 35.43.180 and 35.43.182, the Grantors for themselves, Grantors' heirs, personal
representatives, successors and assigns agree not to protest the establishment of such LID
or ULID for the public improvements for the area and serving the Grantors'property,
whether proposed by petition or by resolution of the City Council of Port Townsend, or
by both such petition and resolution.
Pursuant to RCW 35.43.182, this waiver shall not constitute a waiver of any right of the
Grantors, Grantors' heirs, personal representatives, successors or assigns, to object to the
Grantors'individual assessment (including the determination of special benefits allocable
to the property), or to appeal to the Superior Court the decision of the City Council
affirming the final assessment role.
Power of Attorney to execute petition. Grantors agree that if Grantors, Grantors'heirs,
personal representatives, successors or assigns refuse to join in a proposed petition for
such LID oTULID after five (5) calendar days written notice from the City, the Director
shall have the right, power and authority to sign the petition for and on behalf of the
Grantors, Grantors'heirs, personal representatives, successors and assigns as it pertains to

the property, and Grantors hereby designate and appoint the Director as their attorney-in-
fact for such purposes and with such powers and authority. The power shall be deemed to
be coupled with an interest and therefore irrevocable throughout the term of this
Agreement.
Binding effect. This Agreement shall be binding upon the Grantors, Grantors'heirs,
personal representatives, successors and assigns.
Covenant to run with the land. The obligations and agreement contained in this
Agreement are acknowledged and declared to be covenants running with the above-
described land and shall be binding upon the Grantors, Grantors' heirs, personal
representatives, successors and assigns.
Attorney fees. In the event of any action brought to enforce the terms of this Agreement,
the prevailing party shall be entitled to recover its reasonable attorney fees, costs and
disbursements awarded by the court.
Recordation. Upon execution by all signatories ofthis Agreement, the applicant shall
record this Agreement with the Jefferson County Auditor's Office and return the recorded
original to the City. The City will provide a copy of the recorded Agreement to the
applicant.
Entire Agreement. This written Agreement contains the entire agreement of the parties,
and there is no other written or oral representation or agreement between the parties,
except as contained in this Agreement. Any modification ofthis Agreement shall be in
writing and signed by the Director and by the Grantors, Grantors'heirs, personal
representatives, successors, or assigns.

11.Effective date and term. This Agreement becomes effective upon the signatures of both
parties. The term ofthe Agreement shall be ten (10) years from its effective date.
