Findings, Conclusions and Decision of the Director

After respectful consideration of the above referenced application, the Port Townsend Director
of Development Services hereby adopts the following Findings, Conclusions and Decision.
Findinss of Fact
1. On April 30,2007 Richard Berg submitted a variance application in order to build a
larger front porch onto the residence at 830 Lincoln Street. The property is located in the
R-II zoning district. The proposed porch posts would extend one foot into the R-II zone
minimum 1O-foot front setback. A minor variance is required to permit expansion of an
existing building no more than 10 percent beyond the bulk and setback requirements in
Port Townsend Municipal Code (PTMC) 17.16.030. The porch roof eave would extend
another one foot into the 1O-foot front setback; this would meet PTMC 17.16.030, which
allows roof eaves beyond the building line a maximum of two feet.
2. The property is described as follows: Lots I and 3 and the south 10 feet of Lot 5 in Block
I I of Plummer's Addition to the City of Port Townsend, as per plat recorded in Volume
I of Plats, page 34, records of Jefferson County Washington, Assessor's parcel number
988-801-101. The residence is located on Lot I at the northeast corner of Lincoln and
Taylor Streets.
3. The property is not mapped as containing critical areas as defined in Title 19.05 of the
Port Townsend Municipal Code.
4. A Statutory Warranty Deed, Auditor's File Number 519090, provides evidence that
Richard Berg and Kristin Berg own the above property.
5. May 16,2007 the city provided public notice for the proposed variance through a legal
advertisement in the Jefferson County Leader newspaper and a public notice signboard
placed by the owners on the property. PTMC 20.01.180 provides optional additional
public notice, including a mailing to neighboring property owners. Staff determined that
the variance request was minor enough to not warrant additional notice. No comments
were received.
6. Chapter 17 .86 of the Port Townsend Municipal Code (Variances) specifies the criteria for
approval or approval with modif,rcations an application for a variance from the provisions
of the Title 17 (Zoning). The purpose of the variance process is to provide a mechanism

whereby the city may grant relief from the provisions of Title 17 when it meets the
criteria listed in the following conclusions.

l. The variance will not constitute a grant of special privilege inconsistent with the
limitation upon uses of other properties in the vicinity and zoning district in which the
subject property is located. The Uptown area, one of the oldest sections of town,
contains many residences that do not meet current setbacks. The city's Arc Reader
program map indicates most residences on Taylor Street in the block directly west of the
property do not meet the l0-foot front yard setback.
2. The variance is necessary because of special circumstances relating to the size, shape,
topography,location or surroundings of the subject property, to provide it with use rights
and privileges permitted to other properties in the vicinity and in the zoning district in
which the subject property is located. 830 Lincoln Street is located approximately the
same distance from the Lincoln Street property line as are residences in the next block
east of the property (Block 10). A casual observer could easily conclude that the lawn in
front of 830 Lincoln Street is located on the subject property and not in the public right-
of-way.
3. The granting of the variance will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zoning district in which the
subject property is located. The new porch will add to the appearance of the residence,
and not appear out-of-place or too close to the public right-of-way.
4. The special circumstances of the subject property make the strict enforcement of the
provisions of this title an unnecessary hardship to the property owner. Without the
variance, the residence would contend with a porch too small to shield the residents from
the elements when entering and exiting the house.
5. The special circumstances of the subject property are not the result of the actions of the
applicant. The current owners bought the house, constructed in 1943, in 2006, The
house and porch were built before current zoning and setbacks were established.
6. The variance is the minimum necessary to fulfill the purpose and the need of the
applicant. The existing porch is too small to provide adequate shelter, and the proposed
porch is modest.
7. The variance is consistent with the purposes and intent of this Title. One of the purposes
of Title 17 (Zoning) is to "encourage infill and redevelopment of developed portions of
the city in a manner consistent with the prevailing scale and character of the community"
(17.04.020.C). This porch proposal would enhance the look of the house, and be an
attractive upgrade to the neighborhood.
8. The variance is consistent with the goals and policies of the Port Townsend
Comprehensive Plan. One of the Comprehensive Plan "Land Use Goals and Policies" is
to "maintain or improve the character and livability of established neighborhoods". The

approval of this variance will improve the character and livability for this house in the
established Uptown neighborhood.
Decision
Based on the foregoing Findings and Conclusions, application for Variance LUP07-050 is
hereby APPROVED subject to compliance with the following CONDITIONS:
I. The applicant is to submit a complete building permit application for the porch addition
for approval by the Development Services Department. After the building permit is
issued, the porch must be built to the current International Residential Code building
standards, and pass a final building inspection.
