The fence clearly appears to be under construction within the Ciry right of way (ROW). Any work in the right of way requires advance wriften Cify approval and permit. No such approval or permit has been given for your construction. Nor would such permission likely be given for this construction. A stop work order will not be issued today as the City Manager, and Directors of the Development Services and Public Works, are out of the office and unavailable to address this issue today. In lieu of a stop work order, as Assistant Director, I strongly urge you to cease work. If you proceed to construct in the ROW, you do so at your own risk and expense, as the City in all likelihood will require that the fence be removed.
