Dear Members of the City Council:
On August 17m we received notification to stop work on the construction of a fence at
1523 Madison Strest for Mr. Jack Sebben This fence was being constructed as a
replacement and continuation of the existing fence liner at 1523 Madison and the
neighboring propsrty, 1505 Madison
The notification to stop work was issued due to the factthat the existing fence line is
roughly 5 feet into the City right of way. The fence line is 12 feet frorn the edge of
Madison Street and as it turns the corner is 14 feet from the edge of Foster Street thus
creating no interference with sightlines, no rafffic safety hazard and still allowing ampie
space for on street parking-
Previously, Port Townsend Ordinance No. 2578 allowed homeowners to sign a Street
Use Agreement and give the City notice to title. lf and when the City chose to use the
ROW for any improvements the homeowner would remove the obstacle at their own
expense. lt was a simple and basic agreement allowing the property owner to use the
ROW at their own risk, an agreement that Mr. Sebben would be more than happy to sign.
Unfortunately this option is no longer available and no new policy to deal with such
issues has been ptfr into place- We understand that the Street Use Agreement will not be
addressed by the City Council until afterJanuary 2008, and as this leaves Mr. Sebben
without clear options, we respectfully ask that you address the Street Use Agreement at
your earliest convenience.

Re: Unpermitted Fence Construction in the Right of Way
Dear Mr. Sebben:
Today the City of Port Townsend's Development Services Department (DSD) was made aware that you are iir the
process of constructing a fence at 1523 Madison Street. The fence clearly appears to be under construction within
the Ciry right of way (ROW). Any work in the right of way requires advance wriften Cify approval and permit. No
such approval or permit has been given for your construction. Nor would such permission likely be given for this
construction.
A stop work order will not be issued today as the City Manager, and Directors of the Development Services and
Public Works, are out of the office and unavailable to address this issue today. In lieu of a stop work order, as
Assistant Director, I strongly urge you to cease work. If you proceed to construct in the ROW, you do so at your
own risk and expense, as the City in all likelihood will require that the fence be removed.
The DSD Department will let you know specific requirements next week.

gable riof ie located on the eouth elevation. An encloeed entry porch on the east
iacade has doubl.e paneled door6, paneled frieze, and heavy brackete eupporting a
pedimented gable. -The exterior of the house ia covered with drop sidingi and uindovs
are oue-ov€r-one light, tall, and narrowr double-hung sash. The uide plain nindow
surrounde have narron ehelf hedde and decorative aprona. A two-etoryr hip-roofed
rear addition and a eide sunporch were added to the house about 1905. The'handsome
millwork of the interior is origlnal and typical of the period. The two front
parlors are eeparated by fsui-pane1 pocket door6, and eacb has its own entry .door
accessible from tbe encloeed front porch.
