RESOLUTION NO. 17-041
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, RELATING TO CHARGING FEES FOR PUBLIC RECORDS
CONSISTENT WITH APPLICABLE STATE LAWS
WHEREAS, the City Council by Resolution 10-015 established that the City
Clerk/Public Records Officer, in consultation with the City Attorney and City Manager, is
authorized to establish fees consistent with and based on applicable laws for various copying and
production charges for public records; and
WHEREAS, in November 2016, Council adopted a legislative agenda (Resolution 16-
050) encouraging the legislature to allow staff to recover staff time in compiling and redacting
public records; provide for greater protection of personally -identifiable information, especially of
public employees; and
WHEREAS, Engrossed House Bill 1595 amends RCW 42.56.070(7), and states that an
agency may establish a statement of costs adopted by an agency only after providing notice and
public hearing; and
WHEREAS, Engrossed House Bill 1595 amends RCW 42.56.120(2)(b) providing that
an agency need not calculate the actual costs it charges for providing public records if it has rules
or regulations declaring the reasons doing so would be unduly burdensome; and
WHEREAS, the City provided notice on August 23, 2017, for a Public Hearing to be
held on September 5, 2017; and
WHEREAS, the diversity of the eight City departments has resulted in the creation and
use of different computer systems, programs and information retaining systems for which
copying, printing or scanning the records is performed by a range of employees with a range of
equipment, including maintenance and supplies, to perform such duties that calculating actual
costs for providing such records would be extremely difficult and unduly burdensome.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend as follows:
1. Effective September 6, 2017, the fee schedule related to public records in
substantially the same form as at Exhibit A is adopted.
2. The fee schedule shall be posted on the City website and a copy shall be maintained
in the Office of the City Clerk and be available for copying and inspection by the
public.
3. Resolution 10-015 is repealed.
