GENERAL CONDITIONS
1. Contractors working on this project are required to have a Labor & Industries contractor's registration
number and a City business license. Failure to provide proof of this documentation prior to work may
result in job shut down while this is accomplished.
Temporary erosion and sediment control ('I ESC) measures shall be installed on-site and inspected prior
to beginning construction; call 385-2294, press 3. Measures shall include installation of silt fencing and
graveled construction entrance (see attached details). Adjacent rights-of-way shall be kept free of dirt
debris. Soils exposed during construction shall be temporarily stabilized with mulching, plastic sheeting,
etc. Soils shall be permanently stabilized with seeding, plantings, sodding, etc. once construction is
complete. Applicant is responsible for protection of adjacent properties.
3. All elements of engineering including nailing, holdowns, sheathing, and alternate braced wall panels
(ABWP) require inspection prior to cover.
4. Owner or owner's agent shall review and oversee correction of any and all deficiencies noted by required
inspections.

7. Final Inspections are required prior to occupancy; A Certificate of Occupancy is required for a non-
residential project.
8. All building permits expire if no progress has been made within six months, or if no inspections are done
by the Building Department within one year. Call for at least one inspection per year to keep your
building permit active.

Port Townsend Municipal Code pertinent to the above project and that the applicant is responsible for constructing
in conformance with these codes; the applicant understands that the permit, if issued, expires in six months unless
work is started; that the permit, after construction has started, will expire after one year if an inspection is not
made to show significant progress on the structure; the applicant agrees to abide by the ordinances, codes,

Complete Application
Port Townsend Municipal Code, Section 16.04.140, Vested Rights - Substantially Complete Building Permit
Application: Application for all land use and development permits required under ordinances of the city shall be
considered under the zoning and other land use control ordinances in effect on the date a fully complete building
permit application, meeting the requirements identified in this section, is filed with the Building and Community
Development Department. Until a complete building permit application is filed, all applications for land use and
development permits shall be reviewed subject to any zoning or other land use control ordinances which become
effective prior to the date of issuance of a final decision by the city on the application.
An application for a building permit shall be considered complete when an application meeting all of the
requirements of Section 106.3 of the Uniform Building Code, 1994 Edition, is submitted which is consistent with
all then applicable ordinances and laws. In addition, to be considered complete, such an application must be
accompanied by complete applications for any subsidiary land use or development permits needed, such as a
complete shoreline management permit application and/or complete applications for other discretionary permits
required under the ordinances of Port Townsend. An application for a partial permit under Section 106.4.1 of the
Uniform Building Code, 1994 Edition, shall not be considered complete unless it meets all requirements stated
above and contains plans for the complete structural frame of the building and the architectural plans for the
structure.

Dear Guy and Kim,
The above subject permit is presently being plan reviewed for a building permit. In order to
continue this process additional information is requested.
Please reply to the following comments with a response letter indicating how the issue was
resolved with the specific location the revision may be found. Resubmit two sets of revised plans
with the response letter to this office. If additional information is required you will be contacted.
1. Show on plans project address; tax parcel number; name, address and phone number for the
person responsible for project coordination; seismic zone; parking requirements (required vs.
provided parking spaces with calcs) per the PTMC.
2. Indicate on the plans compliance with the following codes: 1997 Uniform Building Code,
1997 Uniform Mechanical Code, 1997 Uniform Fire Code, 1997 Uniform Plumbing Code,
1997 Washington State Energy Code, 1998 Washington State Ventilation and Indoor Air
Quality Code, WAC 51.40 Washington State Barrier Free Facilities & Design (Chapter 11,
1997 UBC), and 1993 Water Conservation Standards.
3. Square footage to be shown for each occupancy (M and F-1) by each floor and total for the
building. Each room or space to be labeled with a use and square footage of that space.
Note: UBC Sec. 309.2.2 requires storage areas in connection with wholesale or retail sales to
be separated from public areas by a 1 Hr. fire-resistant occupancy separation unless the
storage area does not exceed 1000 SF. Plans should verify less than 1000 SF of storage.
4. Provide an occupant load for each occupancy along with calcs.
5. Does locator map show how the addition/alteration affects the entire building?
6. Spec main exit for proper hardware, locking device, sign, etc.
7. Are there any new fixtures, mechanical or plumbing, added? Is the new LPG fireplace direct
vent or B vent exhausted. If the latter, detail terminus. Will there be LPG piping?

9. There is no "attic space" or "loft," but rather Floor -1 and Floor -2.
10. Identify Floor -1 floor plan on plan set. Provide a Floor -2 floor plan.
11. Show stair details per UBC: rise, run, length of handrail extension, 100 lbs. live load
(calculate stair stringers as beam or joist system on the horizontal), etc.
12. Calculate UBC loads for "manufacturing storage" at 75 lbs./SF for light storage areas or 125
lbs./SF for heavy storage areas.
13. Note on plans that BCI factory approved floor plan will be provided prior to Framing
Inspection.
14. On section plan note all materials of construction including GWB, insulation, etc.; all vertical
dimensions; and all assemblies, rated and non -rated.
15. Show changes in existing vs. proposed alteration, e.g., walls to be removed or new elements
added.
16. Nonresidential Energy Code, on the component performance page, ENV -UA, verify calcs of
wall and floor SF of conditioned SF are both 420 SF.
17. Indicate how up to 20% of the project is being expended to eliminate barriers in the path of
travel or state that the structure fully complies with UBC Ch. 11.

Kim and Guy Sands are proposing to install and operate a microbrewery under the name
Townsend Bay Brewing Company in the Port Townsend Boat Haven. They have requested
permission to discharge the wastewater from their microbrewery to the City's sewer
system. This letter contains my analysis and recommendations.
I have reviewed the file, met with Guy and Kim, consulted the Port Townsend Municipal
Code (PTMC) and met with Bob Wheeler on the subject project. The file includes the
following transmittals and information:
• Letter from Guy Sands to Colette dated August 2, 1996, describing proposed operation
and Best Management Practices (BMPs).
• Letter from Guv Sands to Norm Schenck dated September 13,1996.

Based on my review of the proposal and the experiences of other cities in the comparison
table, I recommend that the discharge of wastewater from the proposed microbrewery be
allowed subject to the following conditions:
1. Production shall be limited to 10 barrels a week, unless approval is given for increased
production. Increased production rates may be approved once actual discharge
quantities are better defined and if it is determined that the discharge from the
microbrewery does not have a negative impact on the wastewater treatment facility and
does not consume needed capacity in the treatment facility.
2. The design and operational practices shall be as described in the letters dated August 2,
1996, to Colette, and September 13, 1996, to Norm Schenck, including specifically:

• The spent grains, yeast, dregs, etc., from the fermentations and the returned kegs
shall be removed and not discharged to the sewer system.
• A clean -in-place circulating system shall be installed
• A holding tank shall be used to collect rinses and adjust pH prior to discharge.
Prior to commencing operation, an operations plan should be submitted to the City
describing in more detail the Best Management Practices (BMPs) to be followed.
It is my understanding that the applicant intends to connect to the existing water service
Line and sewer service lines entering the existing building. Because the microbrewery may
have high strength discharges and in order to better monitor and potentially assess a high
strength surcharge, the City will require that Townsend Bay Brewing Company install a
manifold meter to measure water use separately to their business. The fees and charges for
installation of the manifold meter are covered under Chapter 3 of the PTMC. There will,
however, be only one base meter charge and water use charge for the building per Chapter
13.12 PTMC. It is recommended that the City. request confirmation from the building
owner that they approve of the connection to their water and sewer service lines and that
they understand the premises supplied by the main service shall be ultimately responsible
for all charges. (PTMC 13.12.150)
Bob Wheeler and I have discussed whether system development charges under PTMC 13.26
would be assessed in this case. It was our conclusion that since they will be using the
building's existing water tap and sewer connection that this would not be considered a new
connection or customer and that SDC's would not be imposed.
The applicant should note the requirements of PTMC 13.06.050 and PTMC 13.08.325 which
define substances prohibited in the system, including wastewater with pH lower than 5.5 or
higher than 8.5, or any substance that interferes with the treatment process.
Unless another method is proposed by the applicant, wastewater discharge volumes and
therefore billing rates will be based on the amount of water used through the manifold
meter. Based on the discharge from some breweries, it is possible that this discharge could
fall under the high-strength waste assessment rates of PTMC 13.06 and would be
considered SIC (Standard Industry Code) #4 which presently has a surcharge of $0.88 per
1000 gallons, $0.98 per pound of BOD, plus $0.62 per pound of TSS. (These rates are subject
to periodic change.) I suggest that the city require the applicant to sample the equalized
wastewater in the holding tank for BOD and TSS on two separate occasions once the
brewery starts to operate in order to determine the wastewater characteristics, and that
samples be required semi-annually after that unless waived by the City. The applicant may
perform additional samples as they see necessary to optimize their process. These samples
will be analyzed at the'applicant's expense and must be performed by a Department of
Ecology certified laboratory. The determination of whether the SIC #4 surcharges would be
imposed will depend on the results of the sampling. It appears that, with the BMPs that
Townsend Bay Brewing Company is proposing, the high strength surcharges may not be an
issue. The City also has the right to visit the premises at any time in order to take any
samples necessary to confirm compliance with this letter and the PTMC or to assure that the
system is being operated according to the operations plan and that inappropriate wastes are
not being discharged to the system (PTMC 13.08.325).

not address any other permits or approvals that may be required for the project. In general,
it appears that the applicant has proposed a system that considers the need to prevent the

A. The applicant shall notify the City and the Department of Ecology of any
substantial growth (i.e., 10 fold) or changes in the micro -brewery. The
applicant is responsible for attaining any additional permits which may be
required for the increased discharge and shall comply with any
mitigation/conditions imposed.
B. The applicant shall sample the equalized wastewater in the holding tank for
BOD and TSS on two separate occasions once the brewery starts to
operate in order to determine the wastewater characteristics; additionally,
samples shall be required semi-annually unless waived by the City. These
samples will be analyzed at the applicant's expense and must be performed

Guy and Kim Sands
After respectful consideration of the above -referenced application, the Director- of Building and
Community Development makes the following findings, conclusions, and decision.
Findings f Fact
The applicants, Guy and Kim Sands, propose to install and operate a micro -brewery
within an existing building in the M -I (Industrial) zoning District. (Exhibit A, Conditional
Use Permit Application).
2. Section 17.16.010 Port Townsend Municipal Code (PTMC) requires a conditional use
permit (CUP) to manufacture alcoholic beverages in the M -I zoning district.
The subject property is located at 330-C 10th Street, Port of Port Townsend Boat Haven
Industrial park and is legally described as Section 11, T 30N, R1 V WM. (Exhibit B,
Vicinity Map).
4„ Surrounding uses include marine -related industrial, light manufacturing and repair.
5. The existing building, which houses the Dive Shop, has a floor area of 3,000 square feet,
of which the proposed micro -brewery will use 760 square feet.
6. The applicant estimates that three vehicular trips per day will be generated by the
proposed project. Three parking spaces are proposed, including one van -accessible
parking space (Exhibit C, Site Plan). The proposed parking plan meets the requirements
of Chapter 17.30 PTMC.
T Proposed hours of operation are from 8:00 a.m. to 6:00 p.m.
Bulk, dimension and general requirements are set forth in Chapter 17.20 PTMC. The
existing building meets the intent of the code.

9w The applicants propose to discharge wastewater from the micro -brewery to the City's
wastewater collection and treatment system. Due to the relatively high biochemical
oxygen demand (BOD) and total suspended solids (TSS) levels produced by micro -
brewery operations, the City Public Works Director raised concerns that the discharge
may interfere with the treatment process. The Department of Ecology and CH2MHill,
consulting engineers, were consulted to determine the need for pretreatment (Exhibits D
and E). Based upon the information received, the Director of Public Works determined
that discharge from the brewery could be approved subject to the conditions
recommended by CH2MHill (Exhibit F, Letter from Bob Wheeler, Director of Public
Works, November S, 1996).
10. Notice of application was published in the local newspaper, mailed to property -owners
within 300 feet of the proposal site, and posted by the applicant at the proposal site. No
comments were received.
11. The Port of Port Townsend, owner of the property, takes no exception to the location of
Townsend Bay Brewing Company within the Port Townsend Boat Haven. (Exhibit G,
Port of Port Townsend letter).
Conclusions
The proposed conditional use has been processed as a Type II permit as set forth in
Section 20.01.040 PTMC.
2. Under the conditions prescribed below, the proposal will not endanger the public health or
safety and will not tend to generate nuisance conditions such as noise, dust, glare and
vibration. Public health impacts associated with interference with the city's wastewater
treatment system would be avoided with implementation of the conditions prescribed
below.
The proposed use meets all the required conditions and specifications set forth in the M -I
zoning district.
4. Under the conditions prescribed below, the proposed use would not be injurious or
detrimental to the adjoining or abutting property. Traffic impacts would be minimal and
adequate off-street parking would be provided.
The location and character of the use is in harmony with the area in which it is located and
in general conformity with the comprehensive plan. The proposed micro -brewery would
be compatible with surrounding industrial uses.

Based on the foregoing Findings and Conclusions, application for Conditional use Permit
#LUP96-00073 is hereby APPROVED subject to compliance with the following
CONDITIONS:

effects resulting from a conditional use, additional conditions may be imposed on the
permit or the permit may be rescinded.
If an occupancy permit is not obtained for the subject property within one year from the
director's decision, the conditional use permit shall be canceled and automatically become
null and void.

building shall require a revised conditional use permit.
8. The proposed use shall comply with these Findings of Fact, Conclusions and Conditions.

1. In cases in which a use is not mentioned specifically, the Unit Power Allowance shall be determined by the building official. This
determination shall be based upon the most comparable use specified in the table. See Section 1512 for exempt areas.
2. The watts per square foot may be increased, by two percent per foot of ceiling height above twenty feet, unless specifically directed
otherwise by subsequent footnotes.
3. Watts per square foot of room may be increased by two percent per foot of ceiling height above twelve feet.
4. For all other spaces, such as seating and common areas, use the Unit Light Power Allowance for assembly.
5. Watts per square foot of room may be increased by two percent per foot of ceiling height above nine feet.

7. In cases in which a lighting plan is submitted for only a portion of a floor, a Unit Lighting Power Allowance of 1.35 may be used for
usable office floor area and 0.80 watts per square foot shall be used for the common areas, which may include elevator space, lobby area
and rest rooms. Common areas, as herein defined do not include mall concourses.
8. For the fire engine room, the Unit Lighting Power Allowance is 1.0 watts per square foot.
9. For indoor sport tournament courts with adjacent spectator seating, the Unit Lighting Power Allowance for the court area is 2.6 watts per

10. For both Retail A and Retail B, light for free-standing display, building showcase illumination and display window illumination installed
within two feet of the window are exempt.
Retail A allows a Unit Lighting Power Allowance of 1.0 watts per square foot. Ceiling mounted adjustable tungsten halogen and HID
merchandise display illuminaries are exempt.
Retail B allows a Unit Lighting Power Allowance of 1.5 watts per square foot, including all ceiling mounted merchandise display
luminaries.
11. Provided that a floor plan, indicating rack location and height, is submitted, the square footage for a warehouse may be defined, for
computing the interior Unit Lighting Power Allowance, as the floor area not covered by racks plus the vertical face area (access side only)
of the racks. The height allowance defined in footnote 2 applies only to the floor area not covered by racks.
