It was my understanding that the permit was valid for one year.
I see now that that was a mistake, Our project is still underway and we need to

THIS RESCISSION OF NOTICE TO TITLE is made and entered into this day of
2011, by the City of Port Townsend, hereinafter referred to as "the City," and
Federal Home Loan Mtg. Corp., hereinafter referred to as "Owners", the legal and equitable
owners of the real property described herein.
A. RECITALS
1. Legal Description: This Rescission of Notice to Title shall remove a previously recorded
Notice, recorded under AFN 537337, Records of Jefferson County, on the real property ("the
property") legally described as follows:
Hussey's Addition, Block 6, Lots 10 (Southl/2) and 11 (all)
Assessor's Parcel #: 961-200-606
2. Improvements The subject property was previously permitted to be developed with a single-
family dwelling and an attached Accessory Dwelling Unit (ADU) under building permit BLD08-
058. In 2008, a Notice to Title was recorded as a condition of building permit approval for the
ADU (Jefferson County Auditor's File No. 537337). Per the terms of the recorded Notice,
current and future owners were advised that the property owner must reside on the subject
property, in either the principal residence or the ADU, in order to rent or lease the other unit.

3. Conversion of Structure to a Single Room Addition. The original permit was never finaled.
The property is now Bank owned. Fees were paid to re -activate the permit. The space is now in
the process of being finaled as a single room addition, and not as an ADU.
NOW, THEREFORE, as the benefits derived by the Notice to Title are no longer
needed, the City authorizes and the Owner agrees to, the rescission and removal of the Notice to
Title recorded under Auditor's File Number 537337, records of Jefferson County, and the same
shall be of no further effect. The filing of this document with the Jefferson County Auditor,
including any fees for such, shall be the responsibility of the owner. The original version of this
document shall be returned to the City with a copy provided by the City to the owner.

GARAGE CONVERSION PROJECT: 2633 Sherman St. Port Townsend
This project is a fairly simple garage conversion. It divides the existing garage
in half (see pages 1 & 2) The right half will remain as is, with a garage
door+opener, side door, and window. This is also where the electrical panel is
located. The garage is presently insulated, sheetrocked, and "fire -taped".
The left half will become converted living space, basically an attached ADU,
with a 3/4 bath, kitchenette, and private entrance doors on the north (see page
3). A hallway will connect the main house to the new garage, and also provide
another means of access to the converted room.
The project involves the following stages:
1. frame floor (see page 4) using reclaimed lumber; insulate; plywood Mg

"Downtown parking district" means those
areas lying within commercial, marine -related
and manufacturing, and public, park and open
space zoning districts from Admiralty Inlet to
Van Buren Street between Port Townsend Bay
and Jefferson Street, excluding the P-I zoned
block bordered by Van Buren, Jefferson, Har-
rison and Washington Streets.
"Drinking establishment" means a business
primarily engaged in the retail sale of alcoholic
beverages for consumption on the premises,
including night clubs, bars, and taverns. It shall
not mean a premises wherein such beverages
are sold in conjunction with the sale of food for
consumption on the premises and the sale of
said beverages comprises less than 20 percent
of the gross receipts (e.g., a lounge operated as
part of a restaurant is considered to be an
accessory to the restaurant).
"Drive-in or drive -through facility" means
an establishment that, by design, physical
facilities, service, or by packaging procedures,
encourages or permits customers to receive
services or obtain goods while remaining in
their motor vehicles.
"Driving range (golf)" means an unconfined
recreational facility (i.e., without netting over-
head or along side the facility) situated on a
plot of land at least 400 yards in length and a
minimum of 300 feet wide. A golf driving
range may be built with overhead netting, as
well as netting (or other confining material)
along the sides and the rear of the facility. In
such cases, the land requirements shall be at
least 100 yards in length and a minimum of 150
feet wide. The purpose of such facility is to
allow golfers an opportunity to practice their
golf shots.
"Duplex" means a single building contain-
ing two attached dwelling units, either side by
side or above one another separated by fire -
resistive common wall or common floor/ceil-
ing assemblies. Over and under duplexes shall
have common floor -ceilings between dwelling
units. For purposes of this title, units in a
duplex are considered single-family dwellings
within R-I and R-II districts; provided, that the
base density requirements of the district are
not exceeded. See also "Triplex," and "Four-
plex."
"Dwelling" means any building or portion
thereof designed or used primarily for residen-
tial occupancy, including single-family dwell-
ings, duplexes, triplexes, fourplexes, and
multifamily dwellings, but not including
hotels or motels.
"Dwelling, multifamily" means a building
containing five or more dwelling units, includ-
ing units that are located one over the other.
"Dwelling, single-family attached, means
a duplex, triplex, or fourplex as defined by this
title.
"Dwelling, single-family detached" means a
dwelling that is entirely surrounded by open
space on the same lot, and which is designed
for and occupied exclusively by one family
and the household employees of that family.
"Dwelling unit" means any building or por-
tion thereof that contains separate living facil-
ities for not more than one family. Separate
living facilities shall constitute provisions for
sleeping, eating, kitchen facilities (including at
least an oven range or cooking device and a
permanently installed sink), and bathroom
facilities. "Dwelling unit" does -not include
motel, tourist court, boardinghouse, or tourist

"Electrical distribution substation" means
an assembly of equipment designed to receive
energy from a high voltage distribution supply
system, to convert it to a form suitable for local
distribution and to distribute the energy to
feeders through switching equipment designed
to protect the service from the effects of faults.
"Emergency repair" means work necessary
to prevent destruction or dilapidation of real
property or appurtenances thereto immediately

NOTICE IS HEREBY GIVEN to the Grantors/Owners of the above -referenced real property,
to potential purchasers and future owners, to agents or representatives, and to any other
concerned person or entity:
1) An Accessory Dwelling Unit (ADU) with the address of 2635 Sherman
Street is proposed as an accessory building to the single-family residence
at 2633 Sherman Street. A portion of die existing garage is to be
converted into the ADU. The ADU will share utilities with the residence.
2) The Port Townsend Municipal Code (PTMC) requires that the property
owner reside on the subject property, in either the principal residence or
ADU in order to rent or lease the other unit. A one-year hardship waiver
may be granted by the City in accordance with PTMC 17.16.020.C.2.
Additionally, neither the principal nor accessory unit shall be used as a
transient accommodation (PTMC 17.16.020.C.3). A transient
accommodation is defined as a use less than 29 days (PTMC 17.08.060).
3) This notice may be removed or modified only with approval by the City.
