Thank you for your letter of February 11, 2008.
The following is from paragraph 3 of your letter and represents my revised proposal and should be attached to my
application BLD08-027.
Revised proposal:
• Portions of the structure within the sight triangle will be open over 30 inches in height and,
• Present posts not meeting the sight triangle requirement will be reduced in height to 30 inches and,
Parts of the structure not within the vision triangle will remain at least 50% open for any parts over 4
feet in height and will not exceed a maximum height of eight feet
I will ask Mr. Rowe to schedule the above post height revisions as soon as possible.

Dear Mr. Yarberry,
The following 'took place leading to the pergola's frame work constructed on our property. Let:
me assure you that I do not want to ever create a public safety problem and no deviation from
what was stipulated by Port Townsend building inspector Mr. hick Taylor will occur.
When Mr. Taylor first inspected the pergola post concrete forms for placements he also
reviewed the pergola diagrams and dimensions with both myself and Jerry Rowe, a local
contractor with 30 years experience building here. hero Rowe is helping me with the pergola.
Because of a neighbor's ongoing complaints to your department regarding our home
construction, we reviewed all aspects of the pergola project with hick Taylor to avoid any
future problems. ter. Bowe was present as a qualified professional so no misunderstandings
would occur. Perhaps a bit paranoid on my part but you know the history of the neighbors
complaints and i just wanted to be sure to cover the bases so to speak. We reviewed pictures,
diagrams and dimensions and qtr. Taylor gave us his ok construct the pergola. Poor. Taylor told us
that since it is a detached pergola/arbor and not a fence, and since„ the pergola was within the
correct design, dimensions and placement that a separate building permit is not required.
A few weeks later, after inspecting a home next door, Mr. Taylor dropped by to check on
things and told me of his desire that we not have any future complaint problems. During this
visit the pergola was again discussed. lair. Taylor again said no problems existed with the
design, dimensions or placement.
When ter. Taylor preformed and approved the final house inspection, the pergola was
discussed, and he again stated that it was ok to proceed and not to deviate from the same
pictures, diagram and d'imens'ions we had reviewed and discussed together throughout the
inspection process.
The following was approved by Niro Taylor during and after discussions and diagram reviews
with Mr. Rowe Ex mem
®3 The structure is a pergola/arbor less than 10 feet and is detached with latticework to
support vines and does not require a building permit and is not a fence and,
® Foundations footings are properly constructed and in the appropr'ia'te pos'i'tions and,
Lattice would be greater than 50% open where ever placed and,
No material causing less than 50% open would be used and,
4- Lattice placed within the "sight triangle" will not exceed 30 inches tall and,
® AR lattice not within the `site triangle" will not exceed 6 feet tall and,
The area above the top of the lattice will remain open to 8 feet except supporting
pasts and,
® Along the boundaries of the "site triangle, except for the pergola/arbor support posts
no visual obstruction between 30 inches and 8 feet in vertical direction will exist, and
The support posts did not cause any visual obstruction or public safety hazard as placed

Dear Mr. Addis:
Thank you for submitting the building permit application. I have reviewed the code carefully and
discussed the situation with other staff members prior to making my decision.
The structure, be it fence, arbor or pergola, needs to comply with the provisions of PTMC chapter 17.68.
I have enclosed a copy for your reference. Section 17.68.030 B speaks directly to "Fences, walls, arbors,
hedges and other partially or totally sight -obscuring installation(s)." The structure that has been built falls
within this category as it is partially sight obscuring and if vegetation is allowed to grow on the structure
the obstruction would increase. Section 17.68.030 B(3) prohibits any partially or totally sight -obscuring
installation to exceed four feet in height within any required setback area abutting a public street right-of-
way.

avoiding any obstructions that would limit vision.
The portions of the structure within the sight distance triangle must be open over 30 inches in height. The
installation of posts to support future vegetation does not meet the requirement and this area would need
to be reduced in height to 30 inches. The parts of the structure that are not within the vision triangle must
remain at least 50% open for any parts over four feet in height and cannot exceed the maximum height of
eight feet. The proposal will need to be revised to satisfy the above before the permit can be approved.

This letter constitutes an administrative interpretation of the Port Townsend Municipal Code (PTMC) aid may be
appealed in accordance with the provisions of PTMC section 20.01.310. An appeal must be filed with the director
within 14 days of the date of this decision. Appeals must be made on the appeal form available from Development
