Tax Parcel 989700506; Lots 3-8 of Tideland District 20-25 Proposal: Pope Marine Building Repair — The applicant proposes maintenance and repair of the existing Pope Marine Building located on City Dock. Repairs would consist of reroofing, painting of the exterior siding, replacing windows as needed, and repairs to the external sprinkler system. All work will be done in accordance with best management practices. Repairs will not require any in water work. Adjacent Waterbody:_Strait of Juan de Fuca —Admiralty Inlet _X—Port Townsend Bay SMP Shoreline Designation: X Aquatic —Natural Conservancy Residential Urban X Historic Waterfront Boat Haven Marine Trades Point Hudson Findings & Conclusions l ._ _ The _ proposal by.. p p the City of Port Townsend to undertake maintenance and repair of the existing Pope Marine building within the shoreline of the City of Port Townsend, is exempt from the requirement of a substantial development permit. Specifically, the proposal constitutes: X Normal Maintenance and Repair _Development not exceeding $5,000 _Single-family home for owner's use Other: 2. Although the Pope Marine Building is an over -water structure, no in -water work is required. Washington Department of Fish and Wildlife has determined that a Hydraulic Project Approval (HPA) is not required. The proposal will not materially interfere with the public use of public lands and waters or the private use of adjacent private lands nor will it result in any material expansion or change in use beyond that previously existing. There is no change in use proposed and no impact to public access_ 4. The proposal is consistent with the policies of the Shorelines Management Act (SMA) and the City's Shorelines Master Program (SMP). The proposal involves repairs to an existing building that provides for public access to the water -front- Provision for public access is consistent with the goals of the Shoreline Management Act. 5. The City of Port Townsend, acting as lead agency has determined that the proposal is categorically exempt from the State Environmental Policy Act (SEPA) under the provisions of WAC 197-1 1-800(3). 6_ All exterior alterations shall comply with the city's historic design guidelines. Decision Based on the foregoing Findings and Conclusions, LUP 08-096 is hereby APPROVED subject to compliance with the following CONDITION: All development shall be in substantial conformance with the narrative and development plans submitted in the application for Shoreline Exemption. There shall be no further expansions to or addition of any structures without prior review for conformance with the Shoreline Master Program and any other applicable laws and ordinances. 2. This exemption does not excuse the proponent from complying with other local, state and federal ordinances, regulations, or statutes applicable to the proposed development_ Work shall be conducted in accordance with Best management practices contained in the Department of Ecology Stormwater Management Manual for Puget Sound. 4, Contractors shall employ measures to ensure consistency with water quality regulations under Chapter 90.48 RCW, Water Pollution Control, and WAC 173-201A, Water Quality Standards for Surface Waters of the State of Washington. 5. During construction, all releases of oils, hydraulic fluids, fuels, other petroleum products, paints, solvents, and other deleterious materials must be contained and removed in a manner that will prevent their discharge to waters and soils of the state_ The cleanup of spills shall take precedence over other work on the site. Emergency spill and cleanup procedures shall be explained to all workers on the site and a point of contact will be designated. All heavy equipment involved with the construction shall be inspected daily for leaks. Any equipment leaking hazardous materials is prohibited from conducting any work waterward of the OHWM until the leak is repaired. 6_ If construction equipment inadvertently damages the shoreline environment, the applicant shall notify the City and any other responsible agencies (Le. State Fish & Wildlife, Ecology) immediately. The applicant shall be responsible for repairing the shoreline to its preexisting condition to the satisfaction of the responsible agencies. Expiration: Pursuant to 2.4(A) of the SMP, this exemption shall automatically expire one year from the date of issuance. In consideration of the above, the proposal is found exempt from the requirement of a shoreline substantial development permit.
