acknowledge city code requires the property owner to reside in either the principle or accessory residence in order
to rent or lease the other unit.

I'll do the Planning sign off after I've looked at a couple of things. In general, its fine. There's no
change in footprint proposed & no ADU size limit is required when the ADU is within the SFR;
however, it may still need an on -site parking space. The one shown on the plans is partially in the right-
of-way.
I'll need to look at the Rosewind PUD file to recall what it says about parking in general and ADU's. If
the PUD doesn't deal with it specifically, this may need a Public Works Director's decision on whether
on -street parking for an ADU is OK. It would seem like we'd want that approval (or denial) before
we'd issue the BP. In looking at the aerial photo, it doesn't even appear they have 2 on -site spaces to
begin with and the house elevations in the file don't show a garage. Again, these parking questions
could be addressed as part of the Rosewind PUD approval. I'll check it out tomorrow.
It will also need a Notice to Title recorded as a condition where Owner acknowledges they must live in
either ADU or main SFR in order to rent the other unit. I put one together & put it in the BP file for
issuance with the BP. I put a condition regarding this into CHET.

I've looked through the Rosewind PUD to "refresh" my memory of what the parking arrangements
were. While modified parking standards were made "crystal7' clear in either the staff report, the Council
decision or the PUD agreement, I seem to recall that none of the lots are required to provide on -site
parking. The project was, in exchange, required to create parking on -street, in unopened right-of-ways
and in the common areas shown on their approved plan. Looking at aerial photos, this seems to be
borne out. Even though some lots appear to have on -site parking, others clearly do not. I know it's an
old project but can you confirm what got approved related to parking?
The new subject project (BLD08-253 is a new ADU within an existing SFR's unfinished basement) may
raise a question of what they "vested" under. Certainly there are other ADU's at Rosewind but I just
don't recall them (Planning staff wouldn't have necessarily seen any previous ADU submittals prior to
CHET).
Obviously, ADU's were a permitted use at the time of PUD approval and they didn't require additional
on -site parking back then. However, an ADU now requires an on -site space, unless waived by the PW
Director. I believe the subdivision statues vest applications with respect to density, etc. for a period of 5
years, so I don't know how to approach this. How'd you like to proceed?

I have received an application for an MIP for the installation of a parking space for an ADU on City property in the
Rosewind PUD. The proposal is for one new parking space on the south leg of the "Y" at the west end of
Woodland between 237 Woodland and 231 Woodland off of San Juan. I've attached an aerial for your review. I
will need something in writing from you, Ken, if you will allow this ADU parking on City property. It appears that
there is already parking on that property (City).

2/4/09 — Met with Mr. Weimeister RE: ADU parking. Informed him that, per code,
parking needed to be on -site for the ADU unless approved by PW Director to be in r-o-w
adjacent to lot. Conferred with F2 about process & she agreed that an MIP was the
application used to seek such approval. Gave application to Mr. W & asked him to return
it with fee & sketch showing how parking (including existing spaces for SFR) would
occur, what improvements were already there (paved driveway), etc.
He asked about parking in Rosewind Common space. I said if they got approval from
RW Board to do so, provide map showing where along with written verification from the
Board and we could consider it.
AIso gave him copy of Notice to Title for ADU. Said that once we resolved parking
issue, permit could be issued. Notice to Title recording would need to occur before final
of BP.

0. Nominal R-values are for wood frame assemblies only or assemblies built in accordance with Section 601.1.
1. Minimum requirements for each option listed. For example, if a proposed design has a glazing ratio to the conditioned floor
area of 13%, it shall comply with all of the requirements of the 15% glazing option (or higher). Proposed designs which cannot
meet the specific requirements of a listed option above may calculate compliance by Chapters 4 or 5 of this Code.
2. Requirement applies to all ceilings except single rafter or joist vaulted ceilings complying with note 3. 'Adv' denotes
Advanced Framed Ceiling.
3_ Requirement applicable only to single rafter or joist vaulted ceilings where both (a) the distance between the top of the
ceiling and the underside of the roof sheathing is less than 12 inches and (b) there is a minimum 1-inch vented airspace above the
insulation. Other single rafter or joist vaulted ceilings shall comply with the "ceiling" requirements_ This option is limited to 500
square feet of ceiling area for any one dwelling unit.
4. Below grade walls shall be insulated either on the exterior to a minimum level of R-10, or on the interior to the same level as
walls above grade. Exterior insulation installed on below grade walls shall be a water resistant material, manufactured for its
intended use, and installed according to the manufacturers specifications. See Section 602.2.
5. Floors over crawl spaces or exposed to ambient air conditions.
6. Required slab perimeter insulation shall be a water resistant material, manufactured for its intended use, and installed
according to manufacturers specifications_ See Section 602.4_
7. Int. denotes standard framing 16 inches on center with headers insulated with a minimum of R-10 insulation.
8_ This wall insulation requirement denotes R-19 wall cavity insulation plus R-5 foam sheathing.

If you are a consumer interested in having work done by a contractor, this brochure can help
you by:
Explaining how the Washington state contractor registration program works.
• Describing how the contractor registration law protects consumers.
• Outlining the requirements for contractors.
Washington state law requires all contractors
to be registered. General contractors must
maintain a $6,000 bond and specialty
contractors must maintain a $4,000 bond.
(Specialty contractors are those who participate
in no more than two trades and do not
subcontract work to other contractors.)
It is against state law for any contractor to
submit bids or perform any contracting work
without being registered with the Department
of Labor and Industries. It also is illegal for
contractors to advertise without including their
12-character contractor registration number in
the advertisement.
The contractor registration law exists to
protect consumers from incompetent and/or
fraudulent contractors.
Requiring contractors to be bonded gives
consumers some financial protection against
unsatisfactory or incomplete work. Dissatisfied
consumers may take civil action to obtain
restitution by taking action against a contractor's
bond in Superior Court.
The law also requires contractors to carry
insurance for property damage and public
liability. It also ensures that contractors have a
current Unified Business Identifier (UBI)
Account Number and Federal Employer
Account Number.
Any correspondence you send to a contractor
should clearly state that bids will not be accepted
unless the contractor provides a valid registration
number.
While the law does not guarantee perfect
performance, it improves'the likelihood that
the contractor does competent work.
A maximum $3,000 fine and a misde-
meanor infraction can be levied against any con-
tractor who performs work or submits a bid with-
out being registered with Labor and Industries.
1. Make sure your contractor is properly
registered.
2. Be wary of contractors who ask you to
pick up the building permit.
3. Plan your project carefully, including
detailed plans, if necessary.
4. Try to get at least three written bids on
each job.
5. Ask contractors for references.
6. Ask what inconveniences might arise.
7. Obtain a written contract.
8. Make sure you understand the terms
before you sign anything'.
9. Be cautious about paying for work not yet
completed.
10. Put all change orders in writing.
11. Make frequent inspections and consult
your local building department.
12. Avoid making final payment until you
have received a lien release from
suppliers and subcontractors.
Risks . • liabilities
When hiring an unlicensedcontractor and acting
as your own contractor:
1. You are responsible for the medical and time
loss costs of employees injured while working
on your project.
2. You may be liable for all unpaid taxes.
3.` Your homeowner's insurance may not cover
work done by an unlicensed contractor.
4. The law requires complete disclosure of all
work that has been done on your home, if you
resell. You may be required to do work over
again that has been done without permits, or
inspections. Non -disclosure can lead to civil
action being taken against you.
5. You may be placing yourself and your family in
a life -threatening situation, especially when hir-
ing unlicensed people to install plumbing, elec-
trical wiring, heating systems or wood stoves.
6. Suppliers can place a lien on your home for
non-payment of materials by your contractor.
7. Unpaid workers can place a lien on your
property.
8. When problems arise, your only recourse is a
lengthy and costly civil action — if there are
any assets of value to attach, and if you can
find the contractor.
Insurance protection
Contractors are required to carry at least
$20,000 in property damage insurance coverage
and $100,000 in bodily injury or death insurance.
You are encouraged to verify the contractor's
insurance coverage with his or her agent, as the
department's records may not reflect current
coverage.

5 p.m., excluding state holidays. The information
line allows you to check whether commercial and
resi-dential contractors are registered and properly
bonded.
Our staff can tell you if the contractor currently
is registered, if action against the bond is pending,
or, if legal acton has been taken against the
contractor's bond in the past.
We also can tell you how long a contractor has
been registered.
