Street After respectful consideration of the above referenced application, the Port Townsend Director of Development Services hereby adopts the following Findings, Conclusions and Decision. Findings of Fact 1. Ms. Long met with Development Services staff June 14, 2006 through a Customer Assistance meeting to discuss several ways to divide the property. Staff said at the time more information was needed as the property is located west of Kah Tai Lagoon and according to City maps may be located in the wetland buffer. 2. The legal description of Ms. Long's property is Eisenbeis Addition Block 22, Lots 21 to 26. The property is located on the east side of Landes Street between 16`h Street and 18t" Street. The addresses of the existing residence and detached ADU, located on portions of Lots 24 through 26, are 1644 and 1646 Landes Street. 3. On June 20, 2006 the City Development Services Department received a Lot Line Adjustment application and permit fees from Ms. Long. The application and materials were found to be incomplete as a wetlands consultant still needed to detemune if the property is in a critical area or critical area buffer as defined by the Critical Area Chapter 19.05 of the Port Townsend Municipal Code (PTMC). 4. The City's ArcReader map, based on aerial photos from 2004, indicates the east portions of Lots 24, 25 and 26 are mapped in the Kah Tai Lagoon "buffer" area. June 23, 2006 the applicant e-mailed City staff photos of the site. Looking east from the subject property, the photos and the map show that the neighboring house at 1721 Kuhn Street as well as two accessory structures exist bet` ee4.Ms. Long's property and Kah Tai Lagoon. From the trial) it appears that the cast property, pie of the subject property is approximately 160 fcet from the edges of tltc es along Kah Tai Lagoon, and approximately 200 feet from the waters edge. 5. On June 23, 2006 Ms. Long placed the Lot Line Adjustment application on hold as she was also considering revising the application to sell a portion of Lot 21 to her neighbor to the south, Pamela B. Street, at 1620 Landes Street. 7. On July 6,2006 DOE replied by e-mail to Judy Surber that under the new Washington State Wetland Rating System for Western Washington (2004) Kali Tai ranks as a Categoly 11 Coastal Lagoon, both in scoring and based upon Special Characteristics. 8. July 21, 2006 Ms. Long submitted a Level I Wetland Assessment dated July 15, 2006 from Olympic Wetland Resources, Inc. In the report r)ixie Liewellin, Principal Biologist for Olympic Wetland Resources, Inc., states, "Coastal Lagoons require a 200 foot buffer measured perpendicular to the wetland edge. According to the City of Port Townsend maps, the southeast corners of the subject lots are within that buffer... According to field measurements Lot 23 is 225 feet from the wetland edge. It is possible that Lot 21 is within the buffer since a straight line was not possible due to buildings and dense blackberry thickets. This parcel under review for a lot line adjustment that will define a potential building lot and a buffer for a neighboring parcel. The parcel includes Lots 21 through 26 with the area of focus being Lots 21, 22, and 23. The Department of Ecology determined that Kah Tai rates as a Category H Coastal Lagoon. Coastal Lagoons requires a 200 foot buffer measured perpendicular to the wetland edge. According to the City of Port Townsend maps, the southeast corners of the subject lots are within that buffer. During the assessment a wetland edge was determined by examining soils and vegetation layers. The wetland is also defined by a drop in topography. Although a wetland delineation was not conducted, the approximate wetland edge was established and measurements were made to known property lines with a Chainman II hip chain. According to field measurements Lot 23 is 225 feet from the wetland edge. It is possible that that Lot 21 is within the buffer since a straight line was not possible due to buildings and the dense blackberries thickets. The buffer between Lot 21 and Kah Tai Lagoon is significantly impacted with a house, a shop with an access road, and an open mowed field. In this case a waiver should be granted (19.05.110E (8)) since development has eliminated all buffer functions and values within this portion of the Kah Tai Lagoon buffer. Final authority over wetland determinations and associated buffers rests with the City of Port Townsend Development Services Department. Dear Suzanne: Provided they are 200' away, they will not need a shoreline exemption. Given Chris Byrne's and Dixie's input, and provided they agree to plant some native vegetation at the end of their lot closest to the wetland, I would agree that they do not need a critical area permit. The waiver quote, is to me, not exactly on point. The waiver is used when there is a permit, to then reduce or waive the buffer requirement. It doesn't waive the permit requirement. In this case, because they do not need the permit because they are out of the buffer. Good work. Pat, To follow up with the grading and building permit for Gary Wood at 1630 Landes: Last Friday I spoke with Chris Byrne of the Port Angeles WDFW office (360) 417-1426. He said if they can stay out of the wetland buffer, he doesn't see a problem with the single-family and detached garage. The owner came in Friday and vef t�rl, including the infiltration trench, will be landward (as near to Landes Street as possible) of the 200 foot Kah Tai Buffer. As Dixie Llewellin states in her July 15, 2006 Level I Wetland Assessment, there is a house, shop with an access road and open mowed field between the 1630 Landes St. property and Kah Tai. 19.05.110.E.8 states that 8. Buffer Waivers. Application of the buffers set forth in this section may be waived by the director in instances where either of the following findings are made: a. The parcel to be developed lies landward of an existing and substantial structural development on an intervening lot which separates the parcel from the wetland and has effectively eliminated the function and value to be derived from the required buffer width; or b, The parcel to be developed lies landward of an existing constructed roadway which separates the parcel from the wetland and has effectively eliminated the function and value to be derived from the required buffer width. Dear Suzanne: The section that Dixie quotes from (19.05.110.E.8) waives the buffer, not the permit requirement. We could certainly use it to apply to the buffer requirements in a minor CAO permit. Whether we could get to 19.05.040.C.3 for development on Lot 21 based on her letter seems less likely to me. For one thing, this isn't just a wetland buffer issue, it's also a critical area under the wildlife section of the critical area code. C. Regulated Development. 1. Development occurring on lands and waters containing documented habitats for plant and animal species listed in the Washington Department of Fish and Wildlife's Priority Habitats and Species Program Report. At this time, the only priority habitats and species known to be identified and mapped by the Department of Wildlife in Port Townsend are the following: a. Bald eagles; b. Great blue herons; c. Brant and harlequin feeding areas; d. Waterfowl concentrations at Kah Tai Lagoon; e. Waterfowl wintering area at golf course pond. There will at minimum need to be a discussion with WDFW about the priority habitat issue and whether they agree with Dixie that there are no impacts to waterfowl concentrations at Kah Tai. With the new wetland rating system, the buffer could extend up to 300' if the wildlife habitat value were high. I think it is appropriate to request a study and then, depending on the findings, potentially a minor critical area permit that addresses priority species and habitat and any wetland buffer that may (or if waived, not) be needed. The area is controversial. We received a grading permit last week (GRD08-010) to remove vegetation and excavate for new SFR at 16th and Landes. (Garry Wood is the owner.) As part of a lot line adjustment in 2006 Dixie Llewellin did a Level 1 wetland assessment as the property is west of Kah Tai Lagoon. In her report she said it's possible one of the lots is within the wetland buffer (200 feet), but it's about 225 feet away from the wetland edge. Another house, shop, access road and field are in-between this property and the Lagoon. She suggested a waiver (19.05.110.E.8) be granted "since development has eliminated all buffer functions and values within this portion of the Kah Tai Lagoon buffer." The parcel includes Lots 21 through 26 with the area of focus being Lots 21, 22, and 23. The Department of Ecology determined that Kah Tai rates as a Category 11 Coastal Lagoon. Coastal Lagoons requires a 200 foot buffer measured perpendicular to the wetland edge. According to the City of Port Townsend maps, the southeast corners of the subject lots are within that buffer. During the assessment a wetland edge was determined by examining soils and vegetation layers. The wetland is also defined by a drop in topography. Although a wetland delineation was not conducted, the approximate wetland edge was established and measurements were made to known property lines with a Chainman II hip chain. According to field measurements Lot 23 is 225 feet from the wetland edge. It is possible that that Lot 21 is within the buffer since a straight line was not possible due to buildings and the dense blackberries thickets. The buffer between Lot 21 and Kah Tai Lagoon is significantly impacted with a house, a shop with an access road, and an open mowed field. In this case a waiver should be granted (19.05.1 l0E (8)) since development has eliminated all buffer functions and values within this portion of the Kah Tai Lagoon buffer. Final authority over wetland determinations and associated buffers rests with the City of Port Townsend Development Services Department.
