SUBJECT: Accessory Dwelling Unit at 1309 11"' Street
Dear Mr. Butler:
On May 28 we received a Manufactured Home Title Elimination application from Jefferson Title that
listed you as the new owner of a 1968 manufactured home at 1309 11th Street. During our site visit, we
saw what appears to be an accessory dwelling unit (ADU) next to the home.
Accessory dwelling units require a building permit that includes a life -safety inspection and
issuance of a separate house number. In addition, we prepare a Notice to Title that the owner
signs and records with the Jefferson County Auditor. Our records do not indicate that we have
permitted an ADU for this property. The cost is $130.50.
Enclosed are sections 17.16.010.0 and 17.16.020.0 of the Port Townsend Municipal Code
regarding ADUs.
On June 6, DSD Director Leonard Yarberry signed the Manufactured Home Title Elimination
form. I informed Julia Mae Kennedy at Jefferson Title that an inspection fee of $50.00 is due,
but no one has paid the fee or picked up the paperwork yet. She said she would notify Joseph
Hadden, the current homeowner.

C. Accessory 0wolling Units. This chapter provides standards for
the establishment of accessory d ellih,6 units within the structure of
a single-family residence or an outbuilding which is accessory to
such residence. Apessory duelling units are allowed in order to:
1. Allow more energy efficient use of large, older homes;
2. Provide more affordable housing opportunities for Port
Townsend residents;
3. Provide additional density with minimal cost and disruption
to existing neighborhoods; and
4. Allow individuals and smaller households to retain large
houses as residences.
PTMC 17.16.020
C. Accessory Dwelling Units . Limitations on Use. One
accessory dwelling unit (ADU) may be established only as an
accessaryuse to a single-family, detached residence (and
specifically, not including a duplex, triplex or fourplex), provided the
following conditions are continuously met:
1. A certificate of occupancy pursuant to the currently adopted
city construction codes shall be obtained from the building official
and posted within the ADU. The code inspection and compliance
required to obtain a certificate of occupancy in an existing building
shall be restricted to the portion of the building to be occupied by an
ADU and shall apply only to new construction rather than existing
components, except that any high hazards (i.e., smoke detectors,
fire exits, stairways, LP gas appliances and fire separation) shall be
corrected. Where additional fire separation is unduly burdensome,
the building official may authorize a fire alarm system in lieu of
required fire separation.
2. The owner of the subject property shall reside on the
premises, whether in the main or angq dry dwelling; provided, that
in the event of illness, death or other unforeseeable event which
prevents the owner's continued occupancy of the premises, the
director may, upon a finding that discontinuance of the ADU would
cause a hardship on the owner and/or tenants, grant a temporary
suspension of this owner -occupancy requirement for a period of
one year. The director may grant an extension of such suspension
for one additional year, upon a finding of continued hardship. In the
case of an ADU established prior to March 6, 1995, but after
August 17, 1971, if the property on which the ADU is located
complies with all of the requirements of this section except owner -
occupancy, the ADU property may continue without occupancy by
the owner until sold, exchanged or otherwise transferred to a
different owner.
3. Neither the main nor aiq s I ory dwelling gn'it shall be used
as a transient accommodation.
4. ADUs established in an outbuilding shall not exceed 800
square feet in floor area, and under no circumstance shall the total
lot coverage of the primary residence along with the ADU exceed
the standard allowed in the underlying zoning district.
5. In order to preserve the outward appearance of single-
family neighborhoods, the front of the house shall have only one
exterior entrance.
6. An ADU may be established in a residence or outbuilding
that is legal, nonconforming with respect to required setbacks if
entrances are no closer than five feet to neighboring property lines,
and if each side window that is closer than five feet to a side
property line and that is also closer than 20 feet to either the front
or rear property line is permanently glazed with translucent
material; provided, that the director may permit an entrance as
close as three feet to a neighboring property line upon a finding that
no feasible alternative exists.
7. Repealed by Ord. 29.39.
D. accessory Dwelling Un t — Exception for Legal,
Nonconforming Adces; 'Oicy Dwelling Units. Notwithstanding the
provisions of subsection C of this section, in the case of an ADU
established prior to August 17, 1971, and continuously occupied
thereafter, the ADU may continue without compliance with PTMC
17.16.020(C)(1) and (C)(2), provided a certificate of occupancy is
obtained pursuant to PTMC 17.16.0201(C)(1).
(Note; The fee for inspection and issuance of a certificate of
occupancy for an 16cess6ry dwelling unit shall be the same as that
established in the currently adopted International Building Code for
a special inspection. For the purposes of determining system
development charges or utility or infrastructure requirements, a
single-family residence with an ee ry Welling uhlt which does
not separately connect to city water or sewer service shall have the
same charges and the same requirements as a single-family

Who can develop an Accessory Dwelling Unit (ADU)?
An ADU is defined as a separate dwelling unit with separate cooking facilities that are substantially
contained within the structure of a single-family residence or an outbuilding that is accessory to such
residence. ADU's can be developed in districts zoned as R-I, R-II, or R-III. The owner of the single-
family home must occupy either the primary unit or the ADU and must meet the regulations outlined
in Section 17.16.020 of the Port Townsend Municipal Code.
What requirements must be met to develop an ADU?
An ADU established in an outbuilding may be 800 square feet in utilized floor area regardless of the
size of the main residence.
The front of the house may have only one exterior entrance.
Neither the main or accessory dwelling unit may be used as a transient accommodation, i.e., occupied
for periods less than 30 days.
An ADU may be established in a residence or outbuilding that is legal, nonconforming ("grand
fathered") with respect to required setbacks. However, entrances may be no closer than five feet to
neighboring property lines. An entrance as close as three feet to a neighboring property line may be
allowed if no feasible alternative exists. In addition, any side window closer than five feet to
neighboring property lines and which is also closer than twenty feet to either the front or rear property
line must be permanently glazed with translucent material.
One additional off-street parking space is required to establish an ADU, provided the off-street'"
parking requirements for the other uses on the site are continuously met. Under certain conditions, an
on -street parking space may satisfy this requirement, subject to approval by the Public Works
Director.
What will the permit, building code, and Public Works requirements be for the ADU?
Please refer to the sheet titled ADU Code Requirements.
How does a pre-existing unit become legal?
If an ADU was established prior to the effective date of the Port Townsend Zoning Code (August 17,
1971) and continuously occupied thereafter, the ADU may continue without compliance with the
requirement that the owner occupy either the ADU or the primary unit, or that the ADU meet size
limitations (see above). However, a certificate of occupancy is required (see sheet titled ADU Code
Requirements).

1. What are the utility requirements for establishing an Accessory Dwelling
Unit (ADU)?
❑ The ADU and the home may share a common side sewer line to the sewer main.
❑ A minimum of one water meter will be required for the property; it may serve both the
ADU and the home.
2. What Building Code requirements have to be satisfied when converting an c.vistin
structure to include an ADU?
❑ Utili item;. The entire structure may be served by one shared underground service lateral from
the utility's main to the structure for water and sewer, respectively. The water shut-off must
be accessible to the occupants of both units. If liquid petroleum gas (LPG) or fuel oil is
supplied to the ADU, again, a shut-off must be accessible to the occupants of both units.
❑ 1 lcctrical. A single, shared electrical service, a single meter, and a single main service panel
would be allowed to serve the ADU and primary residence, provided that a) the occupants
of both dwelling units have equal and unrestricted access to the main electrical shut off
device, and b) the capacity of the service panel shall be sufficient to safely handle the
electrical loads attributed to two dwelling units, as determined by the electrical code in
effect at the time of application.

separation between dwelling units. This includes horizontal and vertical assemblies as well
as one hour rated door assemblies in tenant separation.

3. What Building Code requirements have to be satisfied when developing an ADU in a new
structure Or with an addition?

supply and waste plumbing systems. Each dwelling unit must, however, be provided its
own separate hot water appliance, and occupants of each dwelling unit must have equal and
unrestricted access to the main water shut-off valve.

4. What is the permit process to obtain ADU designation?
❑ If the ADU is a new structure or an addition, the ADU requirements will be included with
the building permit issued for the new structure or addition. If the ADU is being established
in an existing structure, you may need to apply for a building permit depending on the
improvements required. If a permit is required for improvements, once they are complete
and final inspection is passed, a Certificate of Occupancy (CO) will be issued pursuant to
the International Residential Code (IRC) after the project is finaled.
5. Will the ADU have a separate address?
❑ Yes. The address must be posted on the ADU with 5-inch tall house numbers. If the
numbers are not visible from the street, additional 3-inch tall house numbers must be posted
on the street at the most direct path to the ADU. This address will be used for mail delivery
and 911 emergency service response.
