This consulting Fire Code Inspector is in receipt of the above -referenced permit application for outdoor
commercial kitchen operated under a temporary metal "carport" shelter for the Kiwanis Club Fish Fry
event during the Rhododendron Festival.
The following findings and stipulations are required for permit approval:
1, The structure is not subject to International Fire Code Chapter 24 as a membrane structure, since it
is considered a Type II manufactured construction classification by this plans examiner.
2. Any side -walls of the structure shall be composed of metal or a minimum of '/z-inch plywood or
flame -resistive material bearing a certification label meeting Class II flame spread retardance.
3. Two [2] portable fire extinguishers shall be provided, having a minimum rating of 3-A:40-B:C, and
in addition, [1] Class K portable fire extinguisher shall be provided.
4. All cooking and heating equipment shall be listed or approved for such use by a qualified listing or
approval entity under the International Fire Code Chapter 45.
Where commercial food service appliances use LP -Gas, containers shall be less than sixty [60]
gallons water capacity and be located outside of the structure and maintaining a 10-foot setback
from ignition sources, especially open flame appliances, and the container safety valve[s] is to be
aimed away from said structure.
NFPA 96, Chapter 12, Section 12.1 "Cooking Equipment" requires that "all deep fat fryers shall be
installed with at least a 16-inch space between the fryer and surface flames from adjacent cooking
equipment." This is the location between the deep fat flyers, and the open -flame cookers.
There is a provision for reduction of the required clearance in NFPA 96, Section 12.1.2.5: "Where
a steel or tempered glass baffle plate is installed at a minimum of 8-inches in height between the
fryer and surface flames of the adjacent appliance, the requirement for a 16-inch spacing shall not
apply. "
7. Temporary electrical service to the subject structure shall meet the National Electrical Code, and us
of any electrical supply chords shall be provided protection from foot traffic.
8. The Kiwanis Club proposes the use of the basement of the American Legion Hall facility for
serving event patrons. The Club shall be responsible for maintaining the safety and egress
provision for such assembly:
a. Maintain a minimum of two [2] exits from the basement.
b. Insure that the exit lights and emergency lighting is functional.
c. Provide fire extinguishers at each exit way.
d. No commercial cooking devices are allowed in the basement, however, the commercial food
warmers are allowed.
The event structure and assembly occupancy shall be subject to inspection by a qualified inspector prior
to the event.

Port Townsend Municipal Code, Section 16.04.140, Vested Rights - Substantially Complete Building Pennit
Application: Application for all land use and development permits required under ordinances of the city shall be
considered under the zoning and other land use control ordinances in effect on the date a fully complete building permit
application, meeting the requirements identified in this section, is filed with the Building and Community Development
Department.
An application for a building permit shall be considered complete when an application meeting all of the
requirements of Section t06.3 of the Uniform Building Code, 1997 Edition, is submitted which is consistent with all
then applicable ordinances and laws. An application for a partial permit under Section 106.4.1 of the Uniform Building
Code, 1997 Edition, shall not be considered complete unless it meets all requirements stated above and contains plans

National Fuel Gas Code
9.13 Food Service Equipment Counter Appliances.
9.13.1 Vertical Clearance. A vertical distance of not less than 48 in. (1.2 m) shall be
provided between the top of all food service hot plates and griddles and combustible
material.
9.13.2 Clearance for Listed Appliances. Listed food service counter appliances such as
hot plates and griddles, food and dish warmers, and coffee brewers and urns, where
installed on combustible surfaces, shall be set on their own bases or legs and shall be
installed with a minimum horizontal clearance of 6 in. (150 mm) from combustible
material, except that at least a 2 in. (50 mm) clearance shall be maintained between a
draft hood and combustible material. Food service counter appliances listed for
installation at lesser clearances shall be installed in accordance with their listing and the
manufacturers' instructions.
9.13.3 Clearance for Unlisted Appliances. Unlisted food service hot plates and griddles
shall be installed with a horizontal clearance from combustible material of not less than
18 in. (460 min). Unlisted gas food service counter appliances, including coffee brewers
and urns, waffle bakers, and hot water immersion sterilizers, shall be installed with a
horizontal clearance from combustible material of not less than 12 in. (300 mm).
Reduced clearances for gas food service counter appliances shall be in accordance
with 1'abt!q ,2.3 . Unlisted food and dish warmers shall be installed with a horizontal
clearance from combustible material of not less than 6 in. (150 min).
9.13.4 Mounting of Unlisted Appliances. Unlisted food service counter appliances shall
not be set on combustible material unless they have legs that provide not less than 4 in.
(100 mm) of open space below the burners and the combustible surface is protected with
insulating millboard at least Y4in. (6 mm) thick covered with sheet metal not less than
0.0122 in. (0.3 mm) thick, or with equivalent protection.
9.14 Hot Plates and Laundry Stoves.
9.14.1 Listed domestic hot plates and laundry stoves installed on combustible surfaces
shall be set on their own legs or bases. They shall be installed with minimum horizontal
clearances of 6 in. (150 mm) from combustible material.
9.14.2 Unlisted domestic hot plates and laundry stoves shall be installed with horizontal
clearances to combustible material of not less than 12 in. (300 min). Combustible
surfaces under unlisted domestic hot plates and laundry stoves shall be protected in an
approved manner.
9.14.3 The vertical distance between tops of all domestic hot plates and laundry stoves
and combustible material -shall be at least 30 in. (760 mm).

Chapter 6 Installation of .,P-Gas Systems
6.17.9 Use in Buildings for Demonstrations or Training, and Use of Small
Cylinders.
6.17.9.1 Cylinders used temporarily inside buildings for public exhibitions or
demonstrations, including use in classroom demonstrations, shall be in accordance with
the following:
(1) The maximum water capacity of a cylinder shall be 12 lb (5.4 kg) [nominal 5 lb
(2 kg) LP -Gas].
(2) If more than one such cylinder is located in a room, the cylinders shall be
separated by at least 20 ft (6.1 m).
6.17.9.2 Cylinders used temporarily in buildings for training purposes rel,aterl to the
installation and use of LP -Gas systems shall be in accordance with the following.
(1) The maximum water capacity of individual cylinders shall be 245 lb (l l l kg)
[notuinal 100 lb (45 kg) LIB --Gas capacity], but not, more than. 20 lb (9.1 kg) of
LIB -Gas shall be placed in a single cylinder.
(2) If more than one such cylinder is located in the same room, the cylinders shall
be separated by at least 20 ft (6.1 n.).
(3) The training location shall be acceptable to the authority having )ttrisdiction.
(4) Cylinders shall be promptly removed from, the building when the training class
has terminated.
6.17.9.3' Cylinders used in buildings as part of approved self-contained torch assemblies
or similar appliances shall be in accordance with the following
(1) Cylinders used in buildings shall comply with UL 147A, Standard for Non -
refillable (Disposable) 7}pe Fuel Gas Cylinder, Assemblies.
(2) Cylinders shall have a maximum water capacity of 2.7 lb (1.2 kg).
6.17.9.4 Cylinders used with commercial food service appliances shall be used inside
restaurants and in attended commercial food catering operations in accordance with the
following:
(1) Cylinders and appliances shall be listed.
(2) Commercial food service appliances shall not have more than two 1.0 oz (296
ml) nonrefillable butane gas cylinders, each having a maximum capacity of 1.08
lb (0.490 kg).
(3) Cylinders shall comply with UL 1471, Statidardfor Non -refillable (Disposal)
Type Metal Container Assemblies br Butane.
(4) Cylinders shall be connected directly to the appliance and shall not be
manifolded.
(5) Cylinders shall be an integral part of the listed, approved, commercial food
service device and shall be connected without the use of a rubber hose.
(6) Storage of cylinders shall be in accordance with 8.3. L
3. Cylinders used for t..,'uing purposes related to the installation ak. use of LP -Gas systems shall
be in accordance with the following.
(1) The maximum water capacity of individual cylinders shall be 245 lb. [nominal 100 lb LP -Gas
capacity], but not more than 20 lb of LP -Gas shall be placed in a single cylinder.
(2) If more than one such cylinder is located in the same room, the cylinders shall be separated
by at least 20 ft .
(3) The training location shall be acceptable to the authority having jurisdiction.
(4) Cylinders shall be promptly removed when the training class has terminated.
4. Cylinders used as part of approved self-contained torch assemblies or similar appliances shall
be in accordance with the following:
(1) Cylinders used in buildings shall comply with UL 147A, Stand rrd for Non -refillable
(Disposable) Type Fuel Gas Cylinder Assemblies.
(2) Cylinders shall have a maximum water capacity of 2.71b.
5. Cylinders used with commercial food service appliances shall be used inside restaurants and in
attended commercial food catering operations in accordance with the following:
(1) Cylinders and appliances shall be listed
(2) Commercial food service appliances shall not have more than two [21 10-oz. non -refillable
butane gas cylinders, each having a maximum capacity of 1.08 lb.
(3) Cylinders shall comply with UL 14713, Standard for Non -refillable (Disposal) Type Metal
Container Assemblies for Butane.
(4) Cylinders shall be connected directly to the appliance and shall not be manifolded.
(5) Cylinders shall be an integral part of the listed, approved, commercial food service device
and shall be connected without the use of a rubber hose.
(6) Storage of cylinders shall be in accordance with 83.L

This consulting Fire Code Official is in receipt of the above -referenced permit application for outdoor
commercial kitchen operated under a temporary metal "carport" shelter for the Kiwanis Club Fish Fry
event during the Rhododendron Festival.
The following findings and stipulations are required for permit approval:
The structure is not subject to International Fire Code Chapter 24 as a membrane structure, since it
is considered a Type II manufactured construction classification by this plans examiner.
2. Any side -walls of the structure shall be composed of metal or a minimum of '/2-inch plywood or
flame -resistive material bearing a certification label meeting Class II flame spread retardance.
3. Two [2] portable fire extinguishers shall be provided, having a minimum rating of 3-A:40-B:C, and
in addition, [1] Class K portable fire extinguisher shall be provided.
4. All cooking and heating equipment shall be listed or approved for such use by a qualified listing or
approval entity under the International Fire Code Chapter 45.
Where commercial food service appliances use LP -Gas, containers shall be less than sixty [60]
gallons water capacity and be located outside of the structure and maintaining a 10-foot setback
from ignition sources, especially open flame appliances, and the container safety valve[s] is to be
aimed away from said structure.
6. NFPA 96, Chapter 12, Section 12.1 "Cooking Equipment" requires that "all deep fat fryers shall be
installed with at least a 16-inch space between the fryer and surface flames from adjacent cooking
equipment-"
There is a provision for reduction of the required clearance in NFPA 96, Section 12.1.2.5: "Where
a steel or tempered glass baffle plate is installed at a minimum of 8-inches in height between the
fryer and surface flames of the adjacent appliance, the requirement for a 16-inch spacing shall not
apply "
Temporary electrical service to the subiect structure shall meet the National Electrical Code, and us
of any electrical supply chords shall be provided protection from foot traffic.
8. The Kiwanis Club proposes the use of the basement of the American Legion Hall facility for
serving event patrons. The Club shall be responsible for maintaining the safety and egress
provision for such assembly:
a. Maintain a minimum of two [2) exits from the basement.
b. Insure that the exit lights and emergency lighting is functional.
C. Provide fire extinguishers at each exit way.
The event structure and assembly occupancy shall be subject to inspection by a qualified inspector prior
to the event.

Jurisdiction over all tents, canopies and membrane structures is' derived from Section 2404 of the
International Fire Code, 2003 Edition.
A permit is required under Chapter 1, Section 105.6.4.4, for a temporary membrane structure that is in
excess of 200 square feet, or a canopy structure that is in excess of 400 square feet. Air -pressurization
supported structures intended for human occupancy are subject to additional standards of safety in Chapter
31 of the International Building Code.
1 PE OF STRUCTURE
❑ Membrane structure: An air -inflated, air -supported, cable, or frame -covered structure, erected for less
than 180 days and not otherwise defined as a tent, canopy, or awning.
E] Tent: structure, enclosure or shelter constructed of fabric or pliable material supported by any manner

or internal combustion engines such as generators. Support ropes and guy wires are considered as part
of the temporary membrane structure, tent or canopy.

2. Date the fabric was last treated with flame -resistant solution;

❑ A permanently affixed label bearing the identification of the size and fabric or material type shall be
present for membrane structures, tents, or canopies.
❑ Fire Retardant Appurtenances. Structure sidewalls, drops, curtains, tops, floor coverings, buntings,
decorative materials and effects, of membrane structures, tents, and canopies shall be composed of
certified flame -resistant material or shall be treated with flame retardant in an approved manner, and/or
bear an approved label as meeting the requirements of flame resistance under NFPA 701, and that such
flame resistance is effective for the period specified by the permit.
❑ Hay, straw, shavings or similar combustible materials shall not be located within a membrane
structure, tent, or canopy containing an assembly occupancy, except materials necessary for the daily
feeding and care of animals. Sawdust and shavings utilized for a public performance or exhibit shall
not be prohibited provided the sawdust and shavings are'kept damp.
❑ Combustible materials shall not be permitted under stands or seats at any time.
❑ Areas adjacent to the tent or air -supported structure shall be maintained clear of all combustible
materials or vegetation that could create a fire hazard within twenty [201 feet from the structure.
❑ Combustible trash shall be removed at least once a day from the structure during the period the
structure is occupied by the public
❑ "No Smoking" signs shall be conspicuously posted.
❑ Spot or effect lighting shall only be by electrical power service, and all combustible construction
located within six [6] feet of such equipment shall be protected with an approved non-combustible
insulation no less than 9.25 inches thick.
❑ Safety film. Motion pictures can only be displayed with safety film.
❑ A minimum clearance of at least three [31 feet between the fabric envelope and all contents located
inside the tent or membrane structure is required.
❑ Portable fire extinguishers shall be provided at each exit, with a minimum rating of 2-A:10-B:C.
❑ Occupant load requirements shall be posted, as assigned by the fire code official or building official.
Structure size in square feet, less required egress aisle[s], divided by occupancy factor:
1. Chairs only, not fixed = 7 square feet. per person, net Total Occupancy

adequately roped, braced and anchored to prevent collapse. The Fire Code Official or Building
Official may ask for documentation as to structural stability as approved by a licensed engineer or
architect.
❑ Seating and aisle[sl in temporary membrane structures, -tents, or canopies shall be meet the aisle and
seating arrangement requirements of International Fire Code Chapter 10, Section 1024.6:
1. Forty-eight [481 inches for aisle with seating on both sides, exception: thirty-six [36] inches where
the aisle does not serve more than 50 seats.
2. Thirty-six inches for aisle having seating on only one side
,3. Converging aisles shall combine the required aisle widths
4. Where seating rows have 14 or fewer seats, the minimum clear aisle access -way width shall not be
less than twelve [12] inches measured as the clear horizontal distance from the back of the row
ahead and the nearest projection of the row behind.
5. For rows of seating served by an aisle or doorway at only one end of the row, the milti.tntinl clear
width of 12-inches between rows shall be increased by 5/8`�-inches for every additional seat beyond
seven[7] seats, but the minimum clear width is not .required to. exceed 22 inches. -

National Fuel Gas Code
9.13 Food Service Equipment Counter Appliances.
9.13.1 Vertical Clearance. A vertical distance of not less than 48 in. (1.2 m) shall be
provided between the top of all food service hot plates and griddles and combustible
material.
9.13.2 Clearance for Listed Appliances. Listed food service counter appliances such as
hot plates and griddles, food and dish warmers, and coffee brewers and urns, where
installed on combustible surfaces, shall be set on their own bases or legs and shall be
installed with a minimum horizontal clearance of 6 in. (150 mm) from combustible
material, except that at least a 2 in. (50 mm) clearance shall be maintained between a
draft hood and combustible material. Food service counter appliances listed for
installation at lesser clearances shall be installed in accordance with their listing and the
manufacturers' instructions.
9.13.3 Clearance for Unlisted Appliances. Unlisted food service hot plates and griddles
shall be installed with a horizontal clearance from combustible material of not less than
18 in. (460 mm). Unlisted gas food service counter appliances, including coffee brewers
and ums, waffle bakers, and hot water immersion sterilizers, shall be installed with a
horizontal clearance from combustible material of not less than 12 in. (300 mm).
Reduced clearances for gas food service counter appliances shall be in accordance
with 'Table 9.23 b . Unlisted food and dish warmers shall be installed with a horizontal
clearance from combustible material of not less than 6 in. (150 mm).
9.13.4 Mounting of Unlisted Appliances. Unlisted food service counter appliances shall
not be set on combustible material unless they have legs that provide not less than 4 in.
(100 mm) of open space below the burners and the combustible surface is protected with
insulating millboard at least Yin. (6 mm) thick covered with sheet metal not less than
0.0122 in. (0.3 mm) thick, or with equivalent protection.
9.14 Hot Plates and Laundry Stoves.
9.14.1 Listed domestic hot plates and laundry stoves installed on combustible surfaces
shall be set on their own legs or bases. They shall be installed with minimum horizontal
clearances of 6 in. (150 mm) from combustible material.
9.14.2 Unlisted domestic hot plates and laundry stoves shall be installed with horizontal
clearances to combustible material of not less than 12 in. (300 mm). Combustible
surfaces under unlisted domestic hot plates and laundry stoves shall be protected in an
approved manner.
9.14:3 The vertical distance between tops of all domestic hot plates and laundry stoves
and combustible material shall be at least 30 in. (760 mm).

Chapter 6 Installation of LP -Gas
6.17.9 Use in Buildings for Demonstrations or Training, and Use of Small
Cylinders.
6.17.9.1 Cylinders used temporarily inside buildings for public exhibitions or
demonstrations, including use in classroom demonstrations, shall be in accordance with
the following:
(1) The maximum water capacity of a cylinder shall be 12 lb (5.4 kg) [nominal 5 lb
(2 kg) LP -Gas].
(2) If more than one such cylinder is located in a room, the cylinders shall be
separated by at least 20 ft (6.1 ra).
6.17.9.2 Cylinders used temporarily in buildings for training purposes related to the
installation and use of LP -Gas systems shall be in accordance with the following:
(1) The inaxinium water capacity of individual cylinders shall be 245 lb (I 11 kg)
(nominal 100 lb (45 kl,),) I.,P-Gas capacity], but not more than 20 lb (9.1 kg) of
LP -Gas shall be placed in a single cylinder.
(2) If more than one such cylinder is located in the same room, the cylinders shall
I . be sepm-ated by at least 20 ft (6.1 in),
(3) The training location shall be acceptable to the authority having jurisdiction.
(4) Cylinders shall be promptly removed from the building When the training class
has terminated.
6.17-9.3 * Cylinders used in buildings as part of approved sel f-contained torch assemblies
or sinfilar appliances shall be in accordance With the following:
(1) Cylinders used in buildings shall comply with UL 147A, Standard for Non -
refillable, (Disposable) Type Fuel as Cylinder Assemblies.
(2) Cylinders shall have a niaxinium water capacity of 2,.7 lb (1.2 kg).
6.17.9.4 Cylinders used with commercial food service appliances shall be used inside
restaurants and in attended commercial food catering operations in accordance with the
following:
(1) Cylinders and appliances shall be listed.
(2) Commercial food service appliances shall not have more khan two 10 oz (2%
ml) nonrefillable butane gas cylinders, each having a maximum capacity of 1.08
lb (0.490 kg).
(3) Cylinders shall comply with UL 14711,Slandard.for Non -refillable (Disposal)
. Type Metal Container Asseinbliesfor Butane.
(4) Cylinders shall be connected directly to the appliance and shall not be
manifolded.
(5) Cylinders shall be an integral part of the listed, approved, commercial food
service device and shall be connected without the use of a rubber hose.
(6) Storage of cylinders shall be in accordance with 8.3.1.
3. Cylinders used for raining purposes related to the installation and use of LP -Gas systems shall
be in accordance with the following:
(1) The maximum water capacity of individual cylinders shall be 245 lb. [nominal 100 lb LP -Gas
capacity], but not more than 20 lb of LP -Gas shall be placed in a single cylinder.
(2) If more than one such cylinder is located in the same room, the cylinders shall be separated
by at least 20 ft .
(3) The training location shall be acceptable to the authority having jurisdiction.
(4) Cylinders shall be promptly removed when the training class has terminated.
4. Cylinders used as part of approved self-contained torch assemblies or similar appliances shall
be in accordance with the following:
(1) Cylinders used in buildings shall comply with UL 1.47A, Standard for Non -refillable.
(Disposable) Type Fuel Gas Cylinder Assemblies.
(2) Cylinders shall have a maximum water capacity of 2.7 lb.
5. Cylinders used with commercial food service appliances shall be used inside restaurants and in
attended commercial food catering operations in accordance with the following:
(1) Cylinders and appliances shall be listed.
(2) Commercial food service appliances shall not have more than two [2] 10-oz. non -refillable
butane gas cylinders, each having a maximum capacity of 1.08 lb.
(3) Cylinders shall comply with UL 14713, Standard for Non -refillable (Disposal) Type Metal
Container Assemblies for Butane.
(4) Cylinders shall be connected directly to the appliance and shall not be manifolded.
(5) Cylinders shall be an integral part of the listed, approved, commercial food service device
and shall be connected without the use of a rubber hose.
(6) Storage of cylinders shall be in accordance with 8.3.1.
❑ Flammable and Combustible liquids shall not be used in tents, canopies, or membrane structures,
and stored outside in an approved manner not less than fifty [50] feet there -from.
❑ Air -inflated or supported structures are regulated under Section 2403.10 of the International Fire
Code.
❑ Canopies have an automatic sprinkler requirement when the existing permanent structure is
provided an automatic sprinkler system, and the canopies exceed four [4] feet in projection, and where
combustibles are stored or handled

2403.12.2, which includes;.
1. Occupant load of less than 10, one [ 1 ]exit, not less than three [3] feet in width, or,
2. Occupant load of less than. 199, two [2] exits, each with a width of 72 inches minimum, spaced at
equal intervals around the perimeter of the structure, or,
3. Occupant load of less than 4, three [3] exists, each.., with a width of 72 inches minimum, spaced at
equal intervals around the perimeter of the structure
❑ Exit openings shall remain open unless curtains are provided on a metal support and contrast in color,
or colors, with the color of the tent. Use of doors shall, insure that the swing path is in the direction of
exit travel.
❑ Aisle widths shall not be less than 44-inches in seating areas, and aisles shall be progressively
increased in width to provide, at all points, not less than one [1] foot of additional aisle width for each
fifty persons served by such aisle at that point.
❑ The required width of exits, aisles and passageways shall be maintained at all times to a public way.
❑ Exit signs shall be installed at exits and shall be self -luminous or internal or external illuminated. Exit
signs shall depict the direction of travel when occupancy exceeds 50 persons.
❑ Exits shall be illuminated with light [not less than 11 Lux] while the structure is occupied
❑ Cooking and/or heating equipment shall be of a listed or approved type, and installed as specified in
the International Mechanical Code and International Fuel Gas Code, and vented to outside air, and
not located within 10 feet of an exit or combustible materials. 1lowever, use of solid flan nables,
butane or other similar devices, for warming of foods,, cooling demonstrations and similar operations,
which do not pease an ignition hazard, is allowed.
1. Patio Heaters and similar non -vented appliances are not approved for use inside structures,
unless specifically listed or approved for use indoors.
2. LPG containers less than 125 gallons, may be eligible for a zero setback provided there is a 10-
foot setback frOni ignition sources, and safety valves are aimed away front the structure.
3. Butane gas containers used in the structure are limited to no snore than two [2] 10-ounce containers
connected directly to the appliance at any time, and not with a manifold or connected by hose.
❑ Open flame or other devices emitting flame, fire, or heat or any flammable or combustible liquids,
gas charcoal, or other cooking device or any other non -approved devices shall not be permitted inside
or located within twenty [20] feet of the tent, canopy or membrane structure[s] while open to the
public unless approved by the fire code official.
❑ LP -gas fuel containers shall be located outside of the tent, and meet the setback requirements from the
structure based on container size, using the International Fuel Gas Code, 2003 Edition, and/or:
1, Containers of 500 gallons or less capacity shall have minimum separation between the container
and the structure of not less than ten [ 10] feet, shall be secured to prevent unauthorized movement,
and protected to prevent tampering, damage by vehicles, or other hazards.
2. Cylinders used temporarily inside buildings for public exhibitions or demonstrations,
including use in classroom demonstrations, shall be its accordance with the following:
(1) The maximum water capacity of a cylinder shall be 12 lb [nominal 5 lb LP -Gas].
(2) If more than one such cylinder is located in a room, the cylinders shall be separated by at least
20 ft
