The existing concrete bulkhead will be fully replaced with a new rock bulkhead in accordance with the details below. Total footage of replacement bulkhead proposed is 143 linear feet. The beach waterward of the existing bulkhead will also be cleaned up to remove the concrete debris from the beach. This will only extend as far waterward as allowed by the authorizing agencies. The replacement bulkhead will be constructed with large A & B size basalt rock, "A" rock weighing 3-7 tons and "B",.rock weighing 1-3 tons. PO Box 375 Kingston, WA 98346 Project Location/Legal Description: The subject site is located at 2215 Washington Street, Port Townsend Bay, City of Port Townsend, Washington. NW `/4 Section of Section 11, Township 30N, Range 1 W, on Jefferson County tax parcel number 957602701. Proposal: The proposal involves repairing of the existing but severely deteriorating shoreline protection structure (bulkhead) and beach clean up for approximately 143' of shoreline, in the urban shoreline designation. The existing broken concrete debris and rock bulkhead will be fully replaced with a new rock bulkhead in accordance with the details submitted with the application. The beach for the entire length of the lot will be cleaned up. The beach clean up will extend only as far waterward as allowed by the authorizing agencies, including the Washington State Department of Fish and Wildlife under their HPA permit. The replacement bulkhead will be constructed with large A & B size rock ("A" rock weighing 3-7 tons and "B" rock weighing 1-3 tons). The base rocks will be keyed into the beach approximately 3 feet below the beach grade and the remaining rocks stacked on top of them, height to a total approximately 6-8" above beach grade. Quarry spalls will be placed behind the armor rock and filter fabric placed between the spalls and the bank. Delivery of all equipment and materials will be by land via Kearney St. The project will be subject to all conditions of the WDFW HPA permit and may not proceed prior to issuance of that permit and those of the shoreline exemption, consistent with the City of Port Townsend 2007 Shoreline Master Program. Adjacent Waterbody: Port Townsend Bay. SMP Shoreline Designation: Urban LUP08-058 Nesset Shoreline Exemption Findings & Conclusions The proposal by Mr. Nesset to undertake repair and replacement of the existing shoreline protection structure within the shoreline of the City of Port Townsend, is exempt from the requirement of a substantial development permit. Specifically, the proposal constitutes: X Normal Maintenance and Repair _Development not exceeding $5,000 _Single-family home for owner's use Other: 2. The proposal will not materially interfere with the public use of public lands and waters or the private use of adjacent private lands nor will it result in any material expansion or change in use beyond that previously existing. There is no change in use proposed and no impact to public access. 3. The proposal is consistent with the policies of the Shorelines Management Act (SMA) and the City's Shorelines Master Program (SMP). Protection of existing structures is a fundamental goal of the SMA and the city's SMP. The proposal involves repair of an existing bulkhead that protects a lawfully established commercial establishment in an existing building. Protection of existing lawfully established structures is consistent with the goals of the Shoreline Management Act. 4� The nature of these repairs will require in -water construction and mechanized equipment for a limited period of time. In water work shall be conducted within inwater work periods for this location (July 15, 2007 to February 15, 2008) or as further limited by the Washington State Department of Fish & Wildlife or US Army Corp of Engineers. Environmental impacts associated with the proposal have been analyzed pursuant to the State Environmental Policy Act (SEPA). The City of Port Townsend issued a Determination of NonSignificance (DNS) in conjunction with the SEPA Environmental Checklist on June 11, 2008. (Exhibit A). Impacts to the biological environment were based upon the recommendations of the Washington State Department of Fish and Wildlife. The aforementioned DNS and Environmental Checklist are incorporated herein by reference. No significant, adverse environmental impacts that could not be mitigated were identified in the SEPA determination. Decision Based on the foregoing Findings and Conclusions, LUP 08-054 is hereby APPROVED subject to compliance with the following CONDITIONS: All development shall be in substantial conformance with the narrative and development plans submitted in the application for Shoreline Exemption. There shall be no further expansions to or addition of any structures without prior review for conformance with the L UP08-058 Nesset Shoreline Exemption 2 Shoreline Master Program and any other applicable laws and ordinances. 2. This exemption does not excuse the proponent from complying with other local, state and - federal ordinances, regulations, or statutes applicable to the proposed development including but not limited to the city's critical areas ordinance, US Army Corps of Engineers, and Hydraulic Project Approval (HPA) from Washington Department of Fish and Wildlife. 3. In water work shall be conducted within inwater work periods for this location (July 15, 2007 to February 15, 2008) unless further restricted by permitting agencies. 4. The use of mechanized equipment shall be the minimum necessary to complete the permitted repairs and shall comply with any conditions of the associated HPA. 5. If construction equipment inadvertently damages the shoreline environment, the applicant shall notify the City and any other responsible agencies (i.e. State Fish & Wildlife, Ecology) immediately. The applicant shall be responsible for repairing the shoreline to its preexisting condition to the satisfaction of the responsible agencies. 6. If city street rights -of -way are to be used for staging and/or access the applicant must first obtain a City Minor Improvement Permit (MIP). 7. To avoid environmental health hazards during construction, emergency spill and cleanup procedures shall be explained to all workers on the site and a point of contact will be designated. All heavy equipment involved with the construction shall be inspected daily for leaks. Any equipment leaking hazardous materials is prohibited from conducting any work below the OHWM until the leak is repaired. All construction contracts shall specify that all diesel, gasoline and air -powered equipment must be properly muffled or silenced. 9. The applicant must abide by all conditions of the WSDFW HPA permit, and permits from the USACE, and supply copies of said permits to the City of Port Townsend, Development Services Division, prior to start of construction. 10. The applicant must dispose of all demolition and construction debris generated on -site and during beach clean up must at a permitted facility. Further, the applicant is encouraged to reuse or recycle as possible all leftover construction and beach clean up materials. Expiration: Pursuant to 2.4(A) of the SMP, this exemption shall automatically expire one year LUP08-058 Nesset Shoreline Exemption from the date of issuance.
