20. This lot is part of the Phoenix Addition Plat Alteration #1. Conditions listed in the Covenants and Declarations as
conditions of short plat approval include:
1) Each lot is limited to construction of one single-family detached dwelling unit that complies with the setbacks
for R-I1I (20 feet in the front, 10 feet in the rear and 5 feet on sides next to neighbors) with a roof area of 2,000
square feet, driveway with a maximum width of 16 feet, and a plan to collect, treat and infiltrate impervious
surfaces on site.
2) All exterior building mounted lights shall be shielded and pointed downward; the use of mercury vapor, hallogen
or other high -intensity exterior lighting is prohibited.
3) The lot is subject to the Tree Conservation Ordinance. The minimum number of tree units to be retained and/or
planted in the R-III zone is 30 tree units per 40,000 square feet, or 4 tree units per 5,000 square feet. The applicant
or representative shall sign a Tree Conservation Affidavit form prior to receiving the building permit.
4) All stormwater construction and maintenance shall be in accordance with the approved Final Stormwater
Maintenance Report and Plans for the Phoenix Addition together with the Stormwater Maintenance Procedures.
Future lot owners are responsible for the maintenance of stormwater swales and infiltration beds.
30. Trees to be preserved must be protected during construction. An inspection by Planning staff must be completed
prior to any clearing or other site work.

and protective fencing secured by posts set at least 12" into the ground installed in
accordance with the requirements of 19.06.150. All tree identification and fencing shall
be installed prior to site development and construction and shall remain and be
maintained until home construction is 100% completed.
3. Install any trees on the lot required by the approved tree conservation plan.

We have reviewed the above building permit application submitted October 27, 2008 for
building and zoning requirements. On November 17, I left a phone message that a site plan
indicating which trees are being removed, retained and or/planted is needed. Lots in the Phoenix
Addition short plat must comply with the Tree Conservation Ordinance, which requires a
minimum of four tree units on a 5,000 square -foot lot (such as Lot 14. There are a variety of
ways to meet this requirement; for example, retaining an existing tree measuring 1" to 6"
diameter at 4-1/2 feet above the ground equals one tree unit.
Once we receive .this information, your building permit application would be considered
complete. Once minor improvement permit MIP08-110 for the utility connections and rain
garden plan is ready to be issued, both permits would be issued at the same time.
Please be aware that if required information is not received withinl80 days after an application
submittal date (i.e. April 27, 2009), the application may be considered expired.

I have provided the lateral and gravity load engineering for the Lee Gabriel
Residence located in I t.t, . ti p J hin ton at 62 Machias L.oz 11, This letter
adds information to letter 9425 of 10.22.1
At the request of the builder I have reviewed my "typical roof nailing" detail of
sheet S2 of my engineering. The detail shows the roof sheathing nailing to the
bird blocking between rafters at the supporting wall. Per the builder/owner this
blocking has been omitted and replaced with a full depth 2x nailed to the rafter
tails.
For this 12 sided roof this is acceptable. One function of bird blocking it to
support the rafters from rolling over. On long rectangular roofs there is a
possibility that a force perpendicular to the rafters could roll all rafters. With a 12
sided roof all rafters cannot be rolled with a single direction force.
The builder chose not to install bird blocking because the rafters are secured with
the tail board, the roof sheathing does not break over the exterior wall, and the
soffits are closed.

The undersigned Whirlwind Il L.L.C.., a Washington Limited Liability Company are the
legal and equitable owners of the following described real property located in Jefferson County, State
of Washington:
Lots 11-16, Block 7; Lots 1-12, 15 and 16, Block 8; and Lots 3-8, Block 9; all in Phoenix
Addition, Plat Alteration No. 1 to the City of Port Townsend, Jefferson County, WA;

Recitals: Grantors desire to provide for present and future uses of said property consistent with its
highest and best for residential purposes, and providing for the protection and preservation of the
character of the property and its neighborhood. Grantors further desire that the property shall be and
remain subject to the terms of these restrictive covenants for all purposes, including but not limited to
any future sale, transfer conveyance or lease of the property or portion of it, or any future
development thereof:
NOTE: Certain terms of this Declaration are established pursuant to conditions of City of Port
Townsend approval. Those items shall not be amended or modified without the written
consent of the Development Services Department, City of Port Townsend.
THEREFORE, it is hereby declared, covenanted and provided that:
A. COVENANTS AND DECLARATIONS AFFECTING ALL LOTS:
1. Restrictions created by this document affect all the above -described parcels. They are and shall
be, construed running with the land binding upon the Grantors and all subsequent owners and
occupiers of the land or any interest therein. It is the intent of the Grantors that the restriction shall
bind and restrict the land, the Grantors and all subsequent owners, their heirs, grantees, personal
representatives, successors and assigns, alike.

2. These Declarations shall be governed by the laws of the State of Washington, and all disputes
between lot owners subject to these covenants will first be presented to arbitration, by a Firm or
Person, qualified and licensed to practice Arbitration in the State of Washington. The cost of
Arbitration will be apportioned equally between the parties associated with the arbitration. (See
Section D for disputes subject to arbitration.)
3. All disputes between Iot owners subject to these covenants unresolved by Arbitration and any
legal action involving the City will only be enforced in the Superior Court of the County of Jefferson,
State of Washington.
4. Grantors re -dedicate to the City for in perpetuity any areas dedicated as streets or rights of way as
shown on the face of the face of the Phoenix Addition, Plat Alteration No. i to the City of Port
Townsend.
5. No Mobile, Manufactured or Modular homes will be permitted to be erected, located or parked on
said parcels or lots.
6. There shall be no heat pumps or exterior mechanical heating, cooling or ventilation (fans, etc.)
devices on said parcels and lots which exceed a maximum decibel reading of _77
7. Building exteriors shall not be clad or sided with vinyl or aluminum material.
8. Fences, arbors or trellis shall not be constructed of vinyl or aluminum materials.
9. A minimum roof pitch of 6/12 is required on all gable roofs. A minimum 30 Year Architectural
Shingle is required on all gable roofs. All roofs less than 6/12 pitch will be concealed with a
minimum 24" parapet wall.
10. All mechanical equipment, i.e., fuel storage tanks (except solar collectors); propane tanks; heat
pumps or exterior heating; and, cooling or ventilation devices shall be screened so as not to be visible
from any Public Right of Way.
11. Landscape will be with plants appropriate for site topography and soil types, emphasizing
drought tolerant varieties with low watering requirements. Turf grass will be limited to 25% of
landscaped area and be a drought tolerant variety requiring less irrigation and minimal maintenance.
12. No inoperable vehicles, recreational vehicles, trailers (whether for recreational, utility, storage or
any other similar use), trailer able recreational devices such as boats, jet skis, personal water craft or
off -road vehicles/motorcycles will be stored or parked adjacent to or along any property line of said
parcels and lots.
13. All garages, carports, outside storage or other accessory structures shall be attached to permanent
concrete foundations, comply with setbacks and are constructed to comply with roof pitch and
exterior wall/roof covering material as described herein.
14. No temporary structures, signs, tents, tarpaulins or yurts (except for Real Estate Sales Signs)
shall be located or erected on said parcels and lots for longer than 7 days.

15. All garages, carports, outside storage or other accessory structures shall be equipped with a door
adequate to prevent their contents from being visible from any Public Right of Way and be kept
closed except when in use.
16. All trash collection devices, rubbish containers, recycling containers or composting appliances
shall be located on the individual lots or parcels they service. They will be adequately screened and
maintained to prevent bird, animal, rodent or insect attractions or infestation.
17. All satellite dishes, radio antennas and other communication devices must be permanently
attached to the dwelling units they serve. They shall be located above the top edge of the fascia and
may not project above the ridge of the roof to which they are attached.
18. Improvements and maintenance for the sole use and benefit of any individual parcel or lot shall
be at the expense and burden of the owner(s) of those parcels or lots, free of lien or liability against
the owner(s) of the other parcels or lots, the owners of which shall be held harmless for such costs,
unless there is an advance written agreement to the contrary between owners who may agree to
apportion and share in such expenses among them.
19. Owners are limited in their use of the City street for parking as follows: no owner shall utilize
more than one on -street parking space for parking in connection with the use of their lot. This
limitation is intended to prevent any one owner from using the street to park more than one vehicle
owned by that owner. This limitation does not prevent City parking code enforcement, and no one
has any assigned or private on -street parking. This limitation does not prevent temporary use of more
than one space for guests and visitors. The limitation is intended as a private covenant affecting lot
owners in of the Phoenix Addition, Plat Alteration No. 1 to the City of Port Townsend.
B. COVENANTS AND DECLARATIONS AFFECTING ALL LOTS -THESE ARE
CONDITIONS OF SHORT PLAT APPROVAL DETERMINED BY THE CITY OF PORT
TOWNSEND: The Covenants and Declarations in Section B are created by the Grantors Carol
Wise, Anne McLaughlin and Whirlwind II L.L.C. and are conditions of plat approval
determined by the City of Port Townsend. As such, these conditions are enforceable by the
City. They are also enforceable by other lot owners. See Section D below.
20. Each lot is limited to the construction of one single-family detached dwelling unit. The dwelling
unit must comply with the setbacks for the R-11I zone and the roof area of the dwelling unit shall be
limited to 2,000 square feet. The site plan for each lot shall include a plan for collection, treatment
and infiltration of impervious surfaces on -site. The driveway serving the residence shall be limited
to a maximum width of 16-feet.
21. There shall be no high -intensity exterior lighting units such as mercury vapor, halogen, or other
lighting units designed for high levels of aerial lighting; all exterior lighting units shall be installed
and maintained only to project low intensity downward -projecting flood or path lighting and shall not
be permitted to intrude on the dark privacy of surrounding parcels and lots.
22. The illumination intensity shall be kept to a minimum and all lighting fixtures shall be shielded
and pointed downward, including lighting for signs. Pole mounted light fixtures shall not exceed 15
feet in height. All Iighting shall be as approved by the City of Port Townsend Director of
Development Services Department.

23. Owners, purchasers and lessees are hereby notified that all lots are subject to the City's approved
Tree Conservation Ordinance which can be obtained from the City of Port Townsend Development
Services Department. Limitations on tree removal, requirements to protect certain trees and/or plant
new trees and signing of a tree conservation affidavit as a condition of building or other site
development permits may be required. Interested parties should contact the City of Port Townsend
for additional information on tree conservation measures applicable to any lot.
24. The West 10 feet of Lots 3 through 8, inclusive, in Block 9, (and the North 10 feet of Lots 8,
through 11, inclusive, Block 8), Phoenix Addition, Plat Alteration No. 1, to the City of Port
Townsend is subject to a restriction prohibiting removal of all trees 18 inches or more in diameter as
measured at a point on said tree four feet above ground level without approval by the City of Port
Townsend Development Services Department.
25. All storm water construction and maintenance shall be in accordance with the approved Final
Storm water Management Report and Plans for the Phoenix Addition, Plat Alteration No.l to the
City of Port Townsend, together with the Storm water Maintenance Procedures all dated February
27, 2007 prepared by Washington Engineers, and on file with the City Engineer for the City of Port
Townsend, WA. And incorporated herein by reference as though full set forth. Any change to the
adopted plan or procedures shall be with the written approval of the City of Port Townsend.
26. The above referenced Storm water Maintenance Procedures prescribe minimum maintenance
requirements for owners within Blocks 7, 8 and 9 of Phoenix Addition, Plat Alteration No. 1 to the
City of Port Townsend. In the event of any conflict between the provisions of said Plan or
Maintenance Procedures and this declaration, this declaration shall prevail. A copy of the approved
maintenance obligations is attached as Exhibit A to these Covenants, Conditions & Restrictions. The
City shall be responsible for maintenance of the storm water catch basins within the right-of-way.
Future lot owners are responsible for maintenance of the storm water swales and infiltration beds.
27. The obligations set forth in this Section B are joint and several obligations of the owners of
property within Blocks 7, 8 and 9 of Phoenix Addition, Plat Alteration No. 1 to the City of Port
Townsend. This means that in the event of a breach (or threatened breach) of an obligation, the
obligation may be enforced against all owners or only one or some of the owners, and any one owner
may be held liable for the entire correction and enforcement. In the event of correction and
enforcement by one owner or less than all owners, then that owner or those owners have the right of
contribution over and against offending owners, except there is no right of contribution by one whose
acts or omissions (including acts or omissions of their guests, tenants, representatives or invitees)
gave rise to the obligation.
C. EASEMENT AFFECTING LOTS 7 and 8, BLOCK 9, REPLAT OF BLOCKS 7,8 AND 9
OF PHOENIX ADDITION TO THE CITY OF PORT TOWNSEND
28. The sewer easement across Lots 7 and 8 in Block 9 in the Phoenix Addition, Plat Alteration No.
1 to City of Port Townsend is reserved for the benefit of the City of Port Townsend for the purpose
of underground utility easement rights over, through, under and across and said lots in perpetuity for
utility lines, and include the following:

a. The City shall have the right at all times to enter the described easement area for the
purpose of inspections and maintaining the property, including but not limited to inspecting,
maintaining, improving, repairing, construction, reconstructing, locating and relocating any utility
lines or curb, gutter or sidewalk improvements. The City shall provide notice of 24 hours for all
scheduled work except in the case of emergency.
b. Any costs associated with inspection, maintenance, improvement, repair, construction,
reconstruction and improvements upon the property undertaken by the City shall be borne by the
City.
c. Structures and/or permanent storage within the above -described easement, or any use of or
within the easement that interfere, in the City's judgment, with the City's use of the easement, are
prohibited.
d. In connection with any inspection, maintenance, improvement, repair, or construction or
reconstruction, the City shall restore the property (easement and any immediately adjacent area) to
rough grading conditions, but is not responsible for any restoration or repair of landscaping,
vegetation or any improvements within the easement.
e. Any damage to the easement or improvements in the easement caused by a lot owner or
their guests, tenants, representatives or invitees shall be repaired at the sole cost and expense of said
owner.
D. VIOLATIONS AND REMEDIES
29. Zoning Code Violation — Applies only to City Enforcement of Paragraphs under Sections B and
C above. A violation of the terms of Paragraphs under Sections B and C of this Declaration is a
violation of the zoning code of the City of Port Townsend, and the City may take code enforcement
for a violation or threatened violation of this Declaration in the same manner and with all the rights
available to the City under its zoning code.
30. Enforcement Rights — Applies to City for City Enforcement of Paragraphs under Sections B and
C above, and to Owner(s) for Enforcement of Paragraphs under Sections A and B above. In addition
to any enforcement action by the City, the City may enforce Paragraphs under Sections B and C, and
any Owner(s) may enforce Paragraphs under Sections A and B above, by bringing an action in law or
in equity in a court of competent jurisdiction to enforce the terms of this Declaration, including:
a. To enjoin the violation, ex parte if necessary, by temporary or permanent
injunction; and/or
b. To require the restoration of any affected property to the condition that existed
prior to the injury arising from a violation of the terms of this Declaration.

The document is a supplement to the Stormwater Design Manual for the project and is
intended to provide a maintenance plan to ensure the continued proper operation of all
stormwater facilities associated the Replat of Blocks 7, 8 and 9 of the Phoenix Addition
to the City of Port Townsend. Lack of maintenance could lead to local flooding, water
damage and costly repairs or replacements of these or other infrastructure_ The total
area served by the stormwater system is approximately 4.79 acres, including runoff
from the streets and an allowance for 20% impervious coverage on each lot_ For those
lots wioth more than 20% impervious coverage, additional on -site measures such as
use of pervious pavements and roof drain infiltration systems will be required.
Stormwater Sytem ,Description:
The stormwater system construction consists of a series of catch basins and piping that
collects surface water from the roadway and landscaped areas on the site and diverts
the stormwater to a series of infiltration beds that are located throughout the plat. The
intent of the design is to implement low impact development (LID) techniques for
stormwater management on the site and to eliminate the need for a large detention
pond.
