GENERAL CONDITIONS
1. Contractors working on this project are required to have a Labor & Industries contractor's
registration number and a City business license. Failure to provide proof of this documentation prior to
work may result in job shut down while this is accomplished.
2. Temporary erosion and sediment control (TESL) measures shall be installed on-site and inspected
prior to beginning construction; call 385-2294. Measures shall include installation of silt fencing and
graveled construction entrance (see attached details). Soils exposed during construction shall be
temporarily stabilized with mulching, plastic sheeting, etc. Soils shall be permanently stabilized with
seeding, plantings, sodding, etc. once construction is complete. Applicant is responsible for protection of
adjacent properties.
3. All elements of engineering including nailing, holdowns, sheathing, and alternate braced wall panels
(ABWP) require inspection prior to cover.
4. Owner or owner's agent shall review and oversee correction of any and all deficiencies noted by
required inspections.
5. Re-inspection is required after any corrections are completed.
6. The Building Department is unable to pass final inspection on your project until Public Works
requirements have been completed and inspected. For Public Works inspection call 385-2294; a
minimum of twenty-four hours notice is required. Public Works approval must be received prior to
scheduling the Building Department's final inspection.
7. Final Inspections and Certificate of Occupancy are required PRIOR to occupancy.
8. All building permits expire if no progress has been made within six months, or if no inspections are
done by the Building Department within one year. Call for at least one inspection per year to keep your
building permit active.
9. Revisions require review and approval prior to making changes in the field. Contact the Building
Department at 379-3208 prior to making changes to the approved plans.

I am responding to your December 5, 2003 letter to Public Works Director Clow. You, Mr.
Clow and I met December 8 to discuss the issues raised in your letter. You presented some
potential cost figures of$45,000 or more to meet the City road standard. As set forth in your
letter, you asserted that requiring an expenditure at this level was unreasonable. We discussed
the basis of the City development standards. Mr. Clow estimated a much lower cost, in the
range of$10,000, to meet the City road standard. We briefly discussed, without any
resolution, whether a waiver application would be approved. Any final determination on a
waiver could only come after a complete submittal, with payment of fees. Based on our
conversation today, we are not considering your letter to be a waiver request at this time
You were going to review this matter, including cost estimates, further with your client. If
following that review, you would like to discuss this matter further, please advise.
One option your clients might consider is to see if there is a possibility of working with other
property owners on Cleveland Street to develop the infrastructure on a joint, less costly, basis.

I represent Mark Raney who has filed a building permit application with you for
development of Lots 13 and 14, Block 1, Weymouth & Dyer Addition, City of Port
Townsend.
I understand that this building permit is conditioned upon Mr. Raney paving Cleveland
Street from 25(h Street.
First, I don't believe this fits with the City's current policy of neighborhood appropriate
streets. My client believes that his neighbors are happy with the nature of the street
development as it presently stands. 25`h Street is chip-sealed, but all of the roads in the
neighborhood feeding off of 25'h (other than Sheridan) are gravel. This is a low density

does allow a waiver of the requirement that my client provide an asphalt road.
Enclosed please find four photographs showing my client's property and abutting
streets. Please note that there is already a driveway which would serve the home to be
built. The neighbors have no objection to the gravel driveway remaining as the means
of ingress and egress for Mark Raney.
Therefore, I respectfully submit, that there will be no harm to the neighbors nor the
public in general by continuing the status quo. Under the criteria provided in the
ordinance, the street is adequate for current and potential pedestrian and vehicular
traffic. I respectfully submit that the proposed stub of asphalt road should be installed
at a later time when the area density has increased and the network of roads can be
paved in a practical and coherent scheme.
In reviewing the Code provisions, I believe criteria 14, 15 and 16 apply. I understand
the City does not have a form for making a waiver application as provided in PTMC
12.04.160 (d). Please consider this my good faith attempt to meet your waiver

I believe that this paving requirement amounts to a taking under Sparks v. Douglas
County, 127 Wn.2d 901, 904 P.2d 738 (1995). The law requires a person developing
property to only make certain dedications or contributions which are "roughly
proportional" to the impact of the development. Clearly the building of a single1arnily
residence on two lots in a low density area of Port Townsend is not such an impact. My
client has looked at the cost of paving this street and it will foreclose his development of
the property. He is disabled and has two children who live with him three days per
week. The modular home he intended to build on this property would have provided his
family with affordable housing.
A more recent case, Benchmark v. City of Battleground, 94 Wn.App 537 (1999)
requires substantive due process in your development standards. If Mr. Raney were
putting in a multi-home development, clearly infrastructure is reasonable. When Mr.
Raney is simply adding one footprint into a low-density R-3 zone, it is unreasonable to
require him to put in an asphalt road far superior to anything abutting it.
My client is willing to enter into a no protest agreement regarding formation of an LID for
road improvements. This would allow the development of a road at a time when it is
truly suitable to the needs of the community with the cost shared among all of the
road's users. Of course, my client would have a right to review the assessment of costs,
but not the formation of the LID.
Time is of the essence since my client hopes to break ground this winter. Please let me
know in writing if this paving requirement is necessary for a permit and if there are any
other reasons for delay in issuing the permit.

The City of Port Townsend Development Services Department is currently reviewing your
building permit file. Based on our review, we have determined that fees in the amount of$97.00 0
for the Temporary Certificate of Occupancy, plus $245.00 for inspection hours of water and
sewer main in Cleveland Street, have not been paid. The total comes to $342.00 payable to the
City of Port Townsend.
We are aware you are occupying the manufactured home as of August 6, 2004. This is a
violation of Section R113 of the 2003 International Residential Code. We have had several
conversations with you regarding the illegal occupancy and the payment of these fees. If the
above fees are not paid by September 1, 2005, by the authority of the Port Townsend Municipal 5
Code, Chapter 20.10, possible criminal and civil action will follow. Under the criminal and civil
actions, you would be charged $100.00 per day for each day the violations continue to exist.
