"~' Printery Communications 631 Tyler Street Port Townsend, WA 98368 Re: Interior Remodel of Existing Attic Space Cc~ The Printery Buildintr Permit #BLD97-170 • • Dear Mike, As you know, the above-referenced building permit was issued with the requirement for the proposed second floor shower to be designed in accordance with Chapter I 1 of the Uniform Building Code (iJBC) which contains the 1997 State Regulations for Barrier- Free Facilities; Section 1106.11.10 of the Washington State Amendments to the UBC applies specifically to shower stalls. Scott Swanter, Nowak Plumbing, visited the building department last week with a question regarding the applicability of barrier-free design criteria for the proposed second floor shower. According to Scott, the barrier-free design is not practical given the existing features of the second floor space. As such, the shower could be installed without meeting accessible guidelines or could be eliminated. Chapter 11 states that if full compliance is technically infeasible, the alteration shall provide accessibility to the maximum extent feasible. Technically infeasible is defined as "an alteration that has little likelihood of being accomplished because existing structural conditions would require removing or altering aload-bearing member which is an essential part of the structural frame, or because site constraints prohibit modifrcations or addition of elements, spaces, or features which are in full and strict compliance with the minimum requirements for new construction and necessary to provide accessibility. " In the case of the Printery building, it appears the requirement for a fully complaint shower stall would likely meet this definition based on the constraints of the existing attic space. Construction plans indicate the existing first floor of the Printery building provides an accessible bathroom for each sex; the toilet facility on the second floor, in which the proposed shower is located, will contain an accessible water closet and lavatory. The second floor contains the manufacturing area of the business and is an area not frequented by the public. The shower is intended for the owners' personal use and, as a safety precaution for employees working in this area in the event of a chemical spill. Due to existing building constraints, the historic nature of the Printery building, and the safety concerns addressed by the shower's installation, the Building Official has determined that the shower may be constructed without meeting the full requirements of Chapter 11 provided it complies with all possible accessible design provisions of Section 1106.11.10 to the maximum extent feasible including grab bars, clear floor space, thresholds, etc. If you have additional questions, I can be reached at 379-5086. A minimum of twenty-four hours notice is reouired. Public Works aouroval must be received prior to scheduling the Building Department's final inspection. 7. Final Inspections are required prior to occupancy; A Certificate of Occupancy is required fora non- residential project. 8. All building permits ezpire if no progress has been made within six months, or if no inspections are done by the Building Department within one year. Call for at ]east one inspection per year to keep your building permit active. 9. Revisions require submittal & approval prior to making changes in the field.
